About some questions of provision of exclusive export right of separate types of the steel procurements made by domain and converter method

1. Approve enclosed:

1) the list of separate types of the steel procurements made by domain and converter method for which export the exclusive right is granted;

2) the list of participants of foreign trade activity which are granted exclusive right;

3) Rules of suspension or cancellation of the exclusive license for export of separate types of the steel procurements made by domain and converter method.

2. Determine Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan by the licensor on implementation of issue of the exclusive license for export of separate types of the steel procurements made by domain and converter method, provided by the subitem 1) of Item 1 of this resolution.

3. The exclusive license for export of separate types of the steel procurements made by domain and converter method is valid from start date of its action till December 31, 2025 inclusive and can be limited to effective period of the agreement in foreign trade (contract) or effective period of the document which is the basis for issue of the exclusive license.

4. To industry ministry and constructions of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to take the measures following from this resolution.

5. This resolution becomes effective after day of its first official publication and is effective till December 31, 2025 inclusive.

Rules of suspension or cancellation of the exclusive license for export of separate types of the steel procurements made by domain and converter method

Chapter 1. General provision

1. These rules of suspension or cancellation of the exclusive license for export of separate types of the steel procurements made by domain and converter method (further – Rules), are developed according to part four of Item 7 of Article 37 and article 45 of the Law of the Republic of Kazakhstan "About permissions and notifications", and also Items 19 and 20 of Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries are applied No. approved by the Decision of Council of the Eurasian economic commission of November 24, 2023 125, and determine procedure for suspension or cancellation of the exclusive license for export of separate types of the steel procurements made by domain and converter method (further – the exclusive license).

2. For the purposes of these rules the following concepts are used:

1) licensor – Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan;

2) the licensee – the participant of foreign trade activity to whom the exclusive export right of separate types of the steel procurements made by domain and converter method according to this resolution is provided.

Chapter 2. Procedure for suspension or cancellation of the exclusive license for export of separate types of the steel procurements made by domain and converter method

3. The licensor makes the decision on suspension of action of the exclusive license in cases:

1) voluntary address of the licensee;

2) suspensions of action of one or several documents based on which the exclusive license was granted;

3) non-presentations by licensees quarterly to the fifteenth following reporting quarter, the report on course of execution of the exclusive license to the licensor;

4) instructions by licensees of false information in quarterly reports on course of execution of the exclusive license;

5) availability of court resolution.

4. In case of approach of the case specified in the subitem 1) of Item 3 of these rules, the licensor within five working days from the date of submission of the corresponding address by the licensee makes the decision on suspension of action of the exclusive license for the term specified in the address.
