About approval of the Regulations on federal state control (supervision) in the field of transport safety

1. Approve the enclosed Regulations on federal state control (supervision) in the field of transport safety.

2. Realization of the powers of Federal Service for the Oversight of Transport provided by this resolution is performed within the established number of staff and the salary fund of employees of central office and territorial authorities of Federal Service for the Oversight of Transport, and also budgetary appropriations provided to the specified Service by the Federal Law on the federal budget for the corresponding financial year and planning period on management and management in the sphere of the established functions.

3. Recognize invalid:

Regulations on federal state control (supervision) in the field of transport safety

I. General provisions

1. This Provision establishes procedure for the organization and implementation of federal state control (supervision) in the field of transport safety (further - federal supervision).

2. Subject of federal supervision is observance by subjects of transport infrastructure, the carriers, builders of objects of transport infrastructure, divisions of transport safety, training centers specialized by the organizations, bodies of certification which are the organizations which are under authority of competent authorities in the field of ensuring transport safety, the certifying organizations, the legal entities, individual entrepreneurs authorized by subjects of transport infrastructure or carriers on booking and (or) execution of travel documents (tickets) and transfer of personal data about passengers in the automated centralized bases of personal data about passengers and personnel (crew) of vehicles on behalf of subjects of transport infrastructure or carriers and citizens (further - controlled persons) mandatory requirements established by the legislation of the Russian Federation in the field of transport safety (further - mandatory requirements).

3. Federal supervision is exercised by Federal Service for the Oversight of Transport and territorial authorities of Federal Service for the Oversight of Transport (further - territorial authorities).

4. The officials authorized on implementation of federal supervision are:

a) Head of the Federal Service for the Oversight of Transport, his deputies;

b) head of territorial authority, his deputies;

c) officials of Federal Service for the Oversight of Transport and territorial authorities to which job responsibilities according to their official regulations implementation of powers on federal supervision belongs (further - the inspector).

5. The officials authorized on decision making about holding control (supervising) actions are:

a) Head of the Federal Service for the Oversight of Transport, his deputies;

b) head of territorial authority, his deputies.

II. Objects of federal supervision

6. Objects of federal supervision (further - objects of control) are:

a) activities of controlled persons for ensuring transport safety in the relation:

objects of transport infrastructure (including objects of transport infrastructure under construction) and (or) vehicles;

the separate courts and (or) other watercrafts determined by the Government of the Russian Federation according to part 8.1 of article 12.3 of the Federal law "About Transport Safety" with the nuclear reactor, courts and (or) other watercrafts transporting nuclear materials, objects of transport infrastructure and (or) groups of objects of transport infrastructure around which safety areas are established;

b) results of activities of controlled persons, including works and services which are directly connected with ensuring transport safety:

accreditation of the specialized organizations in the field of transport safety;

evaluating vulnerability of objects of transport infrastructure and vehicles;

categorization of objects of transport infrastructure according to part 1 of article 6 of the Federal law "About Transport Safety";

certification of forces of ensuring transport safety;

forming and maintaining the automated centralized bases of personal data about passengers and personnel of vehicles;

the direction of the notification provided by part 12 of article 12.3 of the Federal law "About Transport Safety";

implementation of protection of objects of transport infrastructure and (or) vehicles from acts of illegal intervention;

preparation of forces of ensuring transport safety.

7. The Federal Service for the Oversight of Transport and territorial authorities perform accounting of objects of control with use of the departmental automated information and analytical systems performing storage, collection and data processing and providing activities of Federal Service for the Oversight of Transport when planning and holding control (supervising) actions.

Information on objects of control is entered by the officials of territorial authorities specified in item 4 of this provision in the unified register of types of federal state control (supervision), regional state control (supervision), municipal control which forming and maintaining are performed according to appendix No. 1 to the Rules of maintaining the federal state information system "Federal Register of the State and Municipal Services (Functions)" approved by the order of the Government of the Russian Federation of October 24, 2011 No. 861 "About the federal state information systems providing electronic submission of the state and municipal services (implementation of functions)" (further - the unified register of types of control).

Entering of information on objects of control into the unified register of types of control can be performed with use of single system of interdepartmental electronic interaction.

III. Risk management of damnification (damage) to the values protected by the law when implementing federal supervision

8. When implementing federal supervision the system of assessment and risk management of damnification (damage) to the values protected by the law is applied.

9. The Federal Service for the Oversight of Transport when implementing federal supervision refers objects of control to one of the following categories of risk of damnification (damage) to the values protected by the law (further - categories of risk):

a) extremely high risk;

b) high risk;

c) average risk;

d) low risk.

10. Reference of objects of control to categories of risk is performed by officials of territorial authority in the location of object of control or implementation of activities of controlled person according to criteria according to appendix.
