Article 1. Basic concepts

For the purpose of this Federal Law the following concepts are used:

1) the act of illegal intervention - the illegal action (failure to act), including act of terrorism which is menacing to safe activities of transport complex, entailed damnification of life and to human health, material damage or created threat of approach of such effects;

1. 1) zone of transport safety - object of transport infrastructure, its part (land, underground, air, surface), the vehicle for which according to requirements for ensuring transport safety the specific mode of the admission of physical persons, vehicles and cargo transfer, baggage, cabin baggage, personal belongings, other material objects, and also animals is set;

1. 2) respect for transport safety - accomplishment by the physical persons following or being on objects of transport infrastructure or vehicles, the requirements established by the Government of the Russian Federation;

1. 3) certification of forces of ensuring transport safety - establishment of compliance of knowledge, abilities, skills of forces of ensuring transport safety, personal (psychophysiological) qualities, level of physical training of separate categories of forces of ensuring transport safety to requirements of the legislation of the Russian Federation about transport safety for the purpose of acceptance by the subject of transport infrastructure of the decision on the admission (impossibility of the admission) of forces of ensuring the transport safety to performance of work which is directly connected with ensuring transport safety or about discharge from accomplishment of such work;

1. 4) the certifying organizations - the legal entities accredited by competent authorities in the field of ensuring transport safety according to the procedure, determined by the Government of the Russian Federation by representation of the federal executive body performing functions on development of state policy and the normative legal regulation in the field of transport approved with federal executive body in the field of safety control of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs, for processing of personal data of separate categories of persons employed, directly connected with ensuring transport safety, or carrying out such work, for the purpose of check by the subject of transport infrastructure of data, provided by Items 1 - 6 parts 1 of article 10 of this Federal Law, and also for acceptance by bodies of certification of the decision on certification of forces of ensuring transport safety;

1. 5) the safety area - the part of the territory determined according to part 8.1 of article 12.3 of this Federal Law, water, airspace around separate vessels and (or) other floating craft with the nuclear reactor or vessels and (or) other floating craft transporting nuclear materials, object of transport infrastructure on which measures for protection of object of transport infrastructure, the vessel and (or) other floating craft with the nuclear reactor or vessels and (or) other floating craft transporting nuclear materials from acts of illegal intervention according to the established features of protection them from acts of illegal intervention are implemented;

2) categorization of objects of transport infrastructure (further also - categorization) - reference of objects of transport infrastructure to certain categories taking into account the degree of threat to making of the act of illegal intervention and its possible effects;

3) competent authorities in the field of ensuring transport safety - the federal executive bodies authorized by the Government of the Russian Federation to perform functions on rendering the state services in the field of ensuring transport safety;

4) ensuring transport safety - realization of the system of the legal, economic, organizational and other measures in the field of transport complex corresponding to threats of making of acts of illegal intervention determined by the state;

5) objects of transport infrastructure - the technological complex including:

a) railway stations and stations, bus stations and bus stations;

b) the infrastructure facilities of extra street transport determined by the Government of the Russian Federation;

c) tunnels, platforms, bridges;

d) maritime terminals, water areas of seaports;

e) ports which are located on inland waterways and in which landing (disembarkation) of passengers and (or) transshipment of the increased danger, shipping hydraulic engineering constructions are performed;

e) located in internal seawaters, in territorial sea, exclusive economic zone and on the continental shelf of the Russian Federation artificial islands, installations, constructions, including flexibly or the floating (mobile) drilling rigs (platforms), offshore floating (portable) platforms which are stationary fixed according to the project documentation on their creation in the location, except for underwater constructions (including wells);

g) airfields and airports;

h) the sections of highways determined by the Government of the Russian Federation, railway and inland waterways, helidromes, landing sites, and also the providing functioning of transport complex of the building, construction and the room for servicing of passengers and vehicles, loading, unloading and storage of dangerous goods on which transportation special permission, and (or) loads of the increased danger is required;

i) buildings, structures, constructions providing management of transport complex, its functioning used by federal executive bodies in the field of transport, their territorial authorities and the subordinated organizations, and also objects of communication systems, navigation and mission control of vehicles air, railway, sea and inland water transport, determined by the federal executive body performing functions on development of state policy and normative legal regulation in the field of transport in coordination with federal executive body in the field of safety control of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs;

5. 1) bodies of certification - competent authorities in the field of ensuring transport safety, their territorial subdivisions, and also the organizations which are under authority of competent authorities in the field of ensuring transport safety and authorized by them on certification of forces of ensuring transport safety;

6) assessment of vulnerability of objects of transport infrastructure and vehicles - determination of degree of security of objects of transport infrastructure and courts to which the rules of merchant shipping and the requirement of protection of courts and port means established by international treaties of the Russian Federation, and also the vessels of the icebreaker fleet used for posting on sea lanes from threats of making of acts of illegal intervention are applied;

6. 1) assessment of protection of the ocean ship and port means - the determination of degree of security of the ocean ship, the water area of seaport, maritime terminal which is carried out according to requirements of international treaties of the Russian Federation in the field of protection of courts and port means;

6. 2) ceased to be valid according to the Federal Law of the Russian Federation of 03.04.2023 No. 107-FZ

7) carrier - the legal entity or the individual entrepreneur who assumed obligation to bring the passenger, the load entrusted to them by the sender, baggage, cargo baggage from the point of departure in destination, and also to issue load, baggage, cargo baggage to person (receiver) authorized on its obtaining;

7. 1) divisions of transport safety - the performing protection of objects of transport infrastructure and vehicles against acts of illegal intervention (including based on the contract with the subject of transport infrastructure) divisions of departmental protection of federal executive bodies in the field of transport and (or) the legal entities accredited for this purpose in accordance with the established procedure;

7. 2) forces of ensuring transport safety - persons responsible for ensuring transport safety in the subject of transport infrastructure, on object of transport infrastructure, the vehicle, including the personnel of the subject of transport infrastructure or division of transport safety which are directly connected with ensuring transport safety of objects of transport infrastructure or vehicles;

7. 3) loads of the increased danger - the dangerous goods carried by the Government of the Russian Federation to the loads posing the increased hazard to life and human health and for the environment;

8) the specialized organizations in the field of ensuring transport safety - the legal entities accredited by competent authorities in the field of ensuring transport safety according to the procedure, established by the Government of the Russian Federation, for evaluating vulnerability of objects of transport infrastructure and vehicles;

9) subjects of transport infrastructure - the legal entities, individual entrepreneurs and physical persons who are owners of objects of transport infrastructure and (or) vehicles or using them on other legal cause. The subject of transport infrastructure of the airport, airfield or helidrome of civil aviation person owning airfield or helidrome on the property right, under lease or on other legal cause and operating such airfield or such helidrome for the purpose of ensuring take-off, landing, taxing and the parking of civil air vehicles is recognized;

10) transport safety - condition of security of objects of transport infrastructure and vehicles from acts of illegal intervention;

11) vehicles - the devices intended for transportation of the physical persons, loads, baggage, cabin baggage, personal belongings, animals or the equipment established on the specified vehicles of devices, in the values determined by transport codes and charters, and including:

a) the vehicles of road transport used for regular public conveyance and baggage or public conveyance and baggage by request or used for transportation of dangerous goods on which implementation the special permission issued according to procedure, stipulated in Item the 13th article 11 of the Federal Law of November 8, 2007 to No. 257-FZ "About highways and about road activities in the Russian Federation and about modification of separate legal acts of the Russian Federation" is required;

b) the air vehicles of civil aviation used for implementation of commercial air transportations and (or) accomplishment of aerial works;
