1. Approve enclosed:

Rules of the conclusion, change, termination and agreement cancelation about conditions of implementation of regulated types of activity of gas supply (regulatory contracts), and also control of execution of regulatory contracts;

changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective since September 1, 2025.

Rules of the conclusion, change, termination and agreement cancelation about conditions of implementation of regulated types of activity of gas supply (regulatory contracts), and also control of execution of regulatory contracts

I. General provisions

1. These rules determine procedure for the conclusion, change, termination and agreement cancelation about the conditions of implementation of regulated types of activity in the field of gas supply (regulatory contracts) satisfied by the organization performing regulated type of activity on rendering transportation services of gas on gas distribution networks (further respectively - regulatory contracts, the gas-distributing organization), and also control of execution of regulatory contracts.

The regulatory contract is signed by federal executive body in the field of regulation of rates, the management official of the subject of the Russian Federation and the gas-distributing organization (further - the parties).

2. Regulations of the Civil code of the Russian Federation on the agreement are applied to the regulatory contract if other is not established by the Federal Law "About Gas Supply in the Russian Federation".

3. Effective period of the regulatory contract cannot be less than 3 and more than 10 years.

The concepts used in these rules correspond to the concepts accepted in the Civil code of the Russian Federation of the Federal Law "About Gas Supply in the Russian Federation", and also in other regulatory legal acts in the field of gas supply.

II. Procedure for the conclusion, change and termination of the regulatory contract

The gas-distributing organization having intention to sign the regulatory contract with federal executive body in the field of regulation of rates and the management official of the subject of the Russian Federation sends the mailing or electronically by means of the official site on the Internet (further - Internet network) to federal executive body in the field of regulation of rates the following documents:

a) statement for the conclusion of the regulatory contract with appendix of the draft of the regulatory contract;

b) the letter signed by the management official of the subject of the Russian Federation which contains information on approval of the draft of the regulatory contract;

c) the copy of the decision of executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) about establishment at limit of the average size of the special allowance to rates for gas transportation services on gas distribution networks of the gas-distributing organization provided by the order of the Government of the Russian Federation of May 3, 2001 No. 335 "About procedure for establishment of special allowances to rates for gas transportation by the gas-distributing organizations for financing of programs of gasification of housing and communal services, the industrial and other bodies located in the territories of subjects of the Russian Federation";

d) the copy of the conclusion of executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) about justification of offers of the gas-distributing organization concerning establishment (change) of the prices (rates);

e) the draft of the regional program of the gasification of housing and communal services, industrial and other bodies including the list of sources and the amounts of financing of the actions determined by the draft of the regulatory contract connected with construction and (or) with reconstruction of gas distribution networks and their objects (further respectively - the program of gasification, action for gasification), or the project of modification of the program of gasification;

e) the report of the these rules of offers which arrived according to Item 7 to the draft of the regulatory contract with indication of on each of them the motivated line item containing information on accounting (not accounting) in the draft of the regulatory contract of such offer.

5. For the purpose of carrying out public discussion of the draft of the regulatory contract the gas-distributing organization sends to executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) the notification with appendix of the draft of the regulatory contract and calculation of the rates for gas transportation services for gas distribution networks necessary for implementation of actions on gasification.

The executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) within 15 working days from the date of receipt of the specified notification and documents attached to it posts on the official site in Internet network the following materials:

a) draft of the regulatory contract;

b) the price levels offered to establishment (review) on gas transportation services on gas distribution networks;

c) impact assessment of the rates for gas transportation services offered to establishment (review) on gas distribution networks on the change in price for gas for all categories of consumers of the gas-distributing organization and on change of cumulative payment of citizens for utilities on average on the subject of the Russian Federation and on certain municipalities of the subject of the Russian Federation.

6. Within 10 working days from the date of placement of the materials specified in Item 5 of these rules on the official site of executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) in Internet network interested persons send to executive body of the subject of the Russian Federation in the field of state regulation of the prices (rates) of the offer to the draft of the regulatory contract the mailing or electronically by means of the official site in Internet network.
