About implementation of professional activity of the psychologist

The parliament adopts this organic law.

Chapter I. General provisions

Article 1. Subject and field of regulation

This law regulates:

a) principles, organizational conditions, procedure and forms of implementation of professional activity of the psychologist;

b) requirements to persons performing professional activity of the psychologist;

c) basic rights, obligations and responsibility of the psychologist when implementing of professional activity by him;

d) creation, procedure for the organization and functioning of National board of psychologists (further - Board).

Article 2. Scope of application

Operation of this law extends on:

a) citizens of the Republic of Moldova, and also the foreign persons specified in part (1) article 2 of the Law on integration of foreigners in the Republic of Moldova No. 274/2011, who perform professional activity of the psychologist;

b) legal entities irrespective of form of business and type of property, with the location in the Republic of Moldova which perform the activities relating to the field of regulation of this law.

Article 3. Legal basis of activities of the psychologist

Professional activity of the psychologist is performed with observance of provisions of the Constitution of the Republic of Moldova, this law and other regulations, and also according to international treaties which party is the Republic of Moldova.

Article 4. Basic principles of implementation of professional activity of the psychologist

When implementing professional activity the psychologist is guided by the following principles:

a) competence and professionalism;

b) responsibility and professional integrity;

c) independence, impartiality and free competition;

d) observance of the rights and fundamental freedoms of the person;

e) obligation of preliminary receipt of freely expressed consent;

f) maintaining confidentiality of information and professional secrecy.

Article 5. Concepts

For the purposes of this law the following concepts mean:

1) psychological assistance - enrollment of the services provided by the psychologist to the receiver for the purpose of rendering to it support in the solution of emotional, cognitive, behavioural problems which can include assessment, consultation, therapy, provision of recommendations about the strategy of adaptation in case of difficulties and other;

2) the certificate on free practice - the legal act issued according to this law confirming qualification of person for implementation of activities in the mode of free practice for one of psychological specializations;

3) the receiver of services of psychological assistance (further - the receiver) - person or group of persons, receiving psychological assistance;

4) activities of the psychologist under observation - the activities for rendering psychological assistance performed by the psychologist in the course of preparation under direct observation of the supervisor it agrees to the standards approved by Board;

5) the psychologist performing activities in the mode of free practice (further - freely practicing psychologist) - the psychologist having the certificate on free practice on one or several specializations issued by Board according to this law;

6) the report on psychological assessment - the document constituted by the psychologist, containing the description of specific features of the identity of the receiver, assessment of its condition at the time of receipt of psychological assistance, the forecast of its further development and the recommendation about the solution of psychological problems and/or to improvement of emotional, cognitive and social condition of the receiver;

7) professional secrecy - data or information on private life of person which became known to the psychologist owing to the professional or job responsibilities and which confidentiality he shall keep;

8) service of psychological assistance - the service provided by the psychologist in public or private sector for the salary or in the mode of free practice independently or under the direction of or the superviziy skilled psychologist;

9) specialization in the field of psychological assistance - receipt of new competences of the narrow field of psychology;

10) superviziya - activities for continuous professional training within which the supervisor directs other psychologist and gives it support for the purpose of assistance it to professional development, acquisition of new knowledge and competences;
