About approval of the Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic

For the purpose of increase in efficiency of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic, according to article 11 of the Law of the Kyrgyz Republic "About hunting and hunting economy", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic according to appendix.

2. Recognize to invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic" of August 11, 2016 No. 440;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic" of August 11, 2016 No. 440" of March 30, 2018 No. 173;

3) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic" of August 11, 2016 No. 440" of March 24, 2023 No. 164;

4) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic" of August 11, 2016 No. 440" of August 23, 2023 No. 423.

3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This resolution becomes effective after ten days from the date of official publication.

Regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic

Chapter 1. General provisions

1. The regulations on procedure for carrying out tender on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic (further - the Provision) establish procedure for carrying out tender, standard form of the agreement on conducting okhotkhozyaystvenny activities and procedure for its conclusion and termination.

2. In this Provision the following concepts are used:

1) okhotkhozyaystvenny activities - type of economic activity on preserving and steady use of hunting animals in hunting grounds, to their reproduction and increase in productivity of hunting grounds;

2) hunting grounds - the territories or water areas with certain borders serving as the habitat of hunting animals on whom the rights of conducting okhotkhozyaystvenny activities can be granted to legal entities;

3) hunting resources - specific and quantitative set of hunting animals;

4) okhotpolzovatel - the legal entity (irrespective of pattern of ownership and legal form) having the right of conducting okhotkhozyaystvenny activities on certain hunting grounds provided according to the agreement on conducting okhotkhozyaystvenny activities signed with authorized state body in the field of hunting and hunting economy (further - authorized body);

5) intereconomic okhotustroystvo - complex of works on delimitation of sites of the hunting grounds intended for implementation of okhotkhozyaystvenny activities and the priority directions of its development, to establishment of zones of preserving types of wild animals;

6) the right of conducting okhotkhozyaystvenny activities - provision to legal entities (okhotpolzovatel) on certain hunting grounds according to the agreements on conducting okhotkhozyaystvenny activities signed with authorized body according to the scheme of placement of hunting grounds determined within intereconomic okhotustroystvo;

7) special tender committee - the commission created by authorized body for the organization and carrying out tender on provision of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds;

8) the agreement on conducting okhotkhozyaystvenny activities - the agreement between authorized body and okhotpolzovatel on conducting okhotkhozyaystvenny activities on certain hunting grounds for the purpose of establishment, change or the termination of legal relations.

3. The right of conducting okhotkhozyaystvenny activities on certain hunting grounds of the Kyrgyz Republic is granted to legal entities (okhotpolzovatel) on competitive basis.

4. Hunting grounds of the Kyrgyz Republic are subdivided on:

1) hunting grounds on which the right of conducting okhotkhozyaystvenny activities is in accordance with the established procedure granted to someone;

2) hunting grounds on which the right of conducting okhotkhozyaystvenny activities (free hunting grounds) is not granted to someone.

5. The authorized body with involvement of specialists of the state okhotoustroitelny organization / organization and National academy of Sciences of the Kyrgyz Republic determines (in the course of intereconomic okhotustroystvo) borders and the areas of sites of the hunting grounds intended for maintaining on them legal entities of okhotkhozyaystvenny activities (the organization of hunting farms).

Chapter 2. Creation, structure and competence of the commission on provision to legal entities of the right of conducting okhotkhozyaystvenny activities on certain hunting grounds

6. The authorized body is the organizer of tender and the relevant order creates special tender committee (further - the commission), ensures its functioning, the organization and carrying out tenders.

7. The commission is created in number of at least 7 people.
