About approval of the Regulations on forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget

For the purpose of streamlining of questions of forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget according to Articles 28, 29 and 58 Budget codes of the Kyrgyz Republic articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget according to appendix.

2. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget" of December 30, 2017 No. 855;

2) Item 1 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic concerning pricing" of September 27, 2022 No. 530.

3. This resolution becomes effective after seven days from the date of official publication.

Regulations on forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget

Chapter 1. General provisions

1. This Regulations on forming of the list of the investment projects realized in the form of the capital investments financed from the republican budget (further - the Provision), establish procedure for forming and projects implementation of budget investments in the form of the capital investments financed from the republican budget by the means provided on the capital investments.

2. In this Provision the following concepts and terms are used:

1) the project of budget investments in the form of the capital investments - action for realization of the capital investments which task is creation or reproduction of fixed assets;

2) the capital investments - the budgetary funds allocated for creation and reproduction of fixed assets:

- construction of new objects, capital repairs, reconstruction and development of design and exploration work;

- hardware of premises of the state (municipal) bodies;

- acquisition of machines, equipment and other equipment;

3) object of budget investments in the form of the capital investments - buildings, structures and constructions (office buildings, technical constructions, highways) created (reconstructed) as a result of project implementation of budget investments in the form of the capital investments;

4) the state customers of objects of budget investments in the form of the capital investments are the main managers of budgetary funds (further - GRBS) given authority on construction, capital repairs and reconstruction of objects and also on preparation of the design estimates for objects of budget investments in the form of the capital investments;

5) the government treasury bonds (further - state treasury bills) - long-term government securities with interest income (coupon);

6) customers builders of objects of budget investments in the form of the capital investments:

- budgetary institutions, including organizations of objects under construction;

- the organizations which are under authority of the state customer;

- the non-state commercial organizations receiving budget investments on the terms of acquisition in property by the state of shares (shares) of these organizations by the cost equivalent to the size of budget investments in the form of the capital investments or on returnable basis;

- the organizations authorized by GRBS on accomplishment of functions of the customer builder of object of budget investments in the form of the capital investments.

3. The subjects to production and non-productive appointment created with attraction of budget investments in the form of the capital investments are transferred to the public or municipal authority.

Chapter 2. Forming and approval of the list of the investment projects realized in the form of the capital investments

The authorized state body on forecasting and budget implementation (further - authorized state body) in accordance with the established procedure annually approves the list of the investment projects realized in the form of the capital investments (further - the list) with determination of source of financing on the basis of requests of the state customers (GRBS) and according to orders of the President of the Kyrgyz Republic, the Chairman of the Cabinet of Ministers of the Kyrgyz Republic and Toraga of Jogorku Kenesh of the Kyrgyz Republic.

Also proposals of deputies of Jogorku Kenesh of the Kyrgyz Republic, the decision of Jogorku Kenesh of the Kyrgyz Republic and the address of members of kurultai as offers for inclusion in the List are considered.

5. In priority procedure are included in the List:

1) the objects which are subject to completion in the current year;

2) objects of high construction readiness;

3) the emergency objects and objects which were injured owing to emergency situations, having everything the necessary conclusions of authorized state bodies;

4) the objects determined in orders of the President of the Kyrgyz Republic, the Chairman of the Cabinet of Ministers of the Kyrgyz Republic and Toraga of Jogorku Kenesh of the Kyrgyz Republic.

The list is constituted for each state customer separately, with observance of administrative, functional and economic classification of expenses of the republican budget.

6. The authorized state body approves the list of the construction objects, capital repairs and reconstruction financed from the republican budget in the form of the capital investments and distributes in process of need of the state customers no later than one month after approval of the law on the republican budget for the corresponding year and in accordance with the established procedure sends information to special-purpose committee of Jogorku Kenesh of the Kyrgyz Republic.

7. GRBS create the following document package for each of investment projects and represent to authorized state body:

1) data on technical condition of object (for reconstruction or capital repairs);
