About some questions of Council for management of National fund of the Republic of Kazakhstan

1. Form Council for management of National fund of the Republic of Kazakhstan in case of the President of the Republic of Kazakhstan (further - Council).

2. Approve enclosed:

1) structure of Council;

2) Regulations on Council.

3. Recognize invalid some presidential decrees of the Republic of Kazakhstan according to appendix to this Decree.

4. This Decree becomes effective from the date of its signing and extends to the legal relationship which arose since January 1, 2025.

Regulations on Council for management of National fund of the Republic of Kazakhstan

Chapter 1. General provisions

1. Council on management of National fund of the Republic of Kazakhstan (further - Council) is advisory advisory body in case of the President of the Republic of Kazakhstan.

2. In the activities Council is guided by the Constitution of the Republic of Kazakhstan, legal acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, this Provision and other regulatory legal acts of the Republic of Kazakhstan.

3. Decisions of Council have advisory nature.

Chapter 2. Tasks of Council

4. The main objectives of Council are rendering assistance and development of recommendations to the President of the Republic of Kazakhstan concerning use of means of National fund of the Republic of Kazakhstan (further - Fund) and managements of pension assets of the single accumulation pension fund.

Council considers questions of use of fund according to Article 63 of the Budget code of the Republic of Kazakhstan.

5. Council for accomplishment of tasks performs:

1) development of offers on increase in efficiency of forming and use of fund;

2) consideration and development of offers on the size of the guaranteed transfer from Fund in the republican budget;

3) consideration and development of offers on amounts and the directions of the target transfers from Fund in the republican budget directed according to the decision of the President of the Republic of Kazakhstan to financing of crucial objects and projects of all-country value in the absence of alternative sources of financing;

4) consideration and development of offers on financing of projects of all-country value by fund by acquisition of debt securities of National welfare fund taking into account results of examination of projects;

5) development of offers on the list of the permitted financial instruments and transactions with them, except for intangible assets, for placement in Fund;

6) development of offers on increase in effective management of pension assets of the single accumulation pension fund;

7) consideration and development of offers on the directions of investment of pension assets of the single accumulation pension fund;

8) development of offers on determination of the list of the financial instruments permitted to acquisition at the expense of pension assets of the single accumulation pension fund;

9) consideration of the annual activities report of the single accumulation pension fund.

Chapter 3. Organization of activities of Council

6. Council is headed by the chairman.

7. Chairman of the board:

1) performs the common directorship of activities of Council;

2) is determined by the place and time of holding meetings of Council;

3) presides over meetings of Council. In the absence of the chairman according to its order one of members of council presides over meetings;

4) gives instructions, obligatory for execution, to members of council.

8. Members of council:

1) make offers according to the plan of work of Council, to the agenda of its meetings and procedure for discussion of questions;

2) participate in preparation of materials for meetings of Council, drafts of its decisions;

3) take part in discussion of the questions considered at meeting of Council.

9. Council in the procedure established by the legislation of the Republic of Kazakhstan and within the competence:

1) involves state bodies, and also institutes of civil society in discussion of questions of activities of Fund and management of pension assets of the single accumulation pension fund;

2) makes relevant decisions on cases in point.

10. Meetings of Council are held in internal and (or) correspondence forms as required and at least once a year in the terms determined by the chairman of the board and drawn up by the protocol.

The meetings of Council connected with the questions specified in the subitem 3) of Item 5 of this provision are held only in presentia.

Meetings of Council are competent in the presence of two thirds of his members. Delegation by members of council of the powers to other officials is not allowed.

11. Decisions of Council are made by a simple majority vote from total quantity of the members of council who were present at meeting or by poll of members of council. In case of separation of voices equally the voice of the chairman is decisive.

12. Working body of Council is the Administration of the President of the Republic of Kazakhstan.
