About approval of the Technical regulation about marking of tires

Based on Item and) Article 4 and part (2) article 16 of the Law No. 306/2023 on marking of energy-requiring products (The official monitor of the Republic of Moldova, 2023, Art. No. 426-429, 738) DECIDES: the Government

This Technical regulation partially shifts (article 1-4, of article 6-11 and Appendix I-VI) Regulations (EU) 2020/740 of the European parliament and Council of May 25, 2020 about marking of tires taking into account fuel efficiency and other parameters, about modification of Regulations (EU) 2017/1369 and about cancellation of Regulations (EU) No. 1222/2009 (The text relating to EES) (CELEX: 32020R0740), published in the Official magazine of the European Union by L 177 of June 5, 2020.

1. Approve the Technical regulation about marking of tires it (is applied).

2. Provide to Department of Energy, as required, review and updating of the Technical regulation about marking of tires.

3. Requirements of the Technical regulation about marking of tires are not applied to the available inventories of tires within 12 months from the date of its publication in the Official monitor of the Republic of Moldova.

4. The technical regulation about marking of tires becomes effective after 11 months from the date of its publication in the Official monitor of the Republic of Moldova.

5. From the effective date the Technical regulation about marking of tires to declare invalid the Order of the Government No. 685/2018 about approval of the Regulations on marking of tires (The official monitor of the Republic of Moldova, 2018, Art. No. 295-308, 832), with subsequent changes.

6. To impose control over the implementation of this resolution on the Department of Energy.

The technical regulation about marking of tires

Chapter I. General provisions, scope of application and determinations

1. The technical regulation about marking of tires (further – the Technical regulation) establishes base for submission of the harmonized information on parameters of tires by means of marking to give to end users opportunity of the conscious choice upon purchase of tires for the purpose of increase in safety, protection of health and cost and ecological efficiency of the sector of road transportation by assistance to use of tires, effective from the point of view of fuel consumption, steady, safe and creating low noise levels.

2. This Technical regulation is applied to the tires C entered on the market 1, of tires C2 and tires C3.

3. This Technical regulation is not applied in the relation:

3.1. the recovered tires;  

3.2. professional off-road tires;

3.3. the tires provided for installation only on cars which first registration is performed till October 1, 1990;

3.4. reserve tires for temporary use like T;

3.5. the tires having index of speed less than 80 km/h;

3.6. tires which nominal rim diameter does not exceed 254 mm or constitutes at least 635 mm;

3.7. the tires equipped with additional devices for improvement of properties of coupling such as snow tires;

3.8. the tires provided for installation only on the vehicles intended only for races.

4. In sense of this Technical regulation the following determinations are applied:

4.1. the distributor – physical person or legal entity of chain of supply, except for the supplier, the presenting product at the market;

4.2. technical documentation – documentation, sufficient to allow supervision bodies to estimate the accuracy of the label of tires and the information leaflet of product behind the market;

4.3. the label of tires – the graphical chart in printing or electronic format, including in the form of sticker, containing symbols for informing end users on characteristics of the tire or batch of tires concerning the parameters provided in appendix No. 1;

4.4. the information leaflet of product – the standard document containing information provided in appendix No. 3, in printing or electronic format;

4.5. the supplier – according to the definition given in the Law No. 306/2023 on marking of energy-requiring products;

4.6. the tire identifier – code, usually alphanumeric, distinguishing certain type of the tire from other types of tires under the same trade name or the same trademark of the supplier;

4.7. the importer – any physical person or legal entity from the Republic of Moldova which imports product from the third country on the market of the Republic of Moldova;

4.8. introduction on the market – according to the definition given in the Law No. 306/2023 on marking of energy-requiring products;

4.9. the technical promotional material – documentation in printing or electronic format constituted by the supplier for amendment of the promotional material information provided in appendix No. 4;

4.10. parameter – such characteristic of the tire which makes essential impact on the environment, traffic safety or health in usage time of the tire, for example deleting of the tire, run, rolling resistance, coupling on wet surface, external noise of swing, coupling on snow or coupling on ice;

4.11. class C1 tires – the tires developed generally for road vehicles of categories M 1, N 1, by O1 and O2;

4.12. class C2 tires – the tires developed generally for vehicles of categories M 2, M 3, by N, O3 and O4 with load-carrying capacity index on one design МЕНЬШЕ ИЛИ РАВНО121 and value of speed category> "N";

4.13. class C3 tires – the tires developed generally for vehicles of categories M 2, M 3, by N, O3 and O4 with one of the following indexes of load-carrying capacity:

4.13.1. load-carrying capacity index on one design <121 and value of speed category <"M";

4.13.2. load-carrying capacity index on one design> 122;

4.14. the recovered tires – worn-out tires which are recovered by replacement of worn-out protector by new material;

4.15. the reserve tire for temporary use like T – type of the reserve tires for temporary use developed for use with more high pressure than pressure established for the standard and strengthened tires;

4.16. the professional off-road tire – the tire of special purpose used in particular in cross-country conditions;

4.17. the producer – any physical person or legal entity which makes product or orders designing or production of product and realizes this product under own name or trademark;
