About the Standard instruction on clerical work in state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan

According to article 13 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and article 57 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Approve the Standard instruction on clerical work in state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan it (is applied).

2. To state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan to perform clerical work according to the Standard instruction on clerical work in state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan.

3. To the agency of innovations and digital technologies in case of the President of the Republic of Tajikistan to carry out explanatory work with the purpose of effective implementation of electronic clerical work.

4. To the central public authorities since July 1, 2025, to local authorities of the government, self-government institutions of settlements and dekhot, the companies, organizations and other state organizations of the Republic of Tajikistan since January 1, 2027 to perform complete electronic document management by means of single interdepartmental electronic document management system.

5. Declare invalid the order of the Government of the Republic of Tajikistan of July 28, 2017 No. 358 "About the Standard instruction on clerical work in state bodies, organizations, the companies and other organizations of the Republic of Tajikistan" since January 1, 2027.

The standard instruction on clerical work in state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan

1. General provisions

1. The standard instruction on clerical work in state bodies, the companies, organizations and other state organizations of the Republic of Tajikistan (further - the Instruction) establishes process clerical work and control and regulates work with documents from the moment of their preparation, receipt, accounting, use, storage and the subsequent address to archiving through single interdepartmental electronic document management system (further - system) in the central and local executive bodies of the government, self-government institutions of settlements and villages, the companies, organizations and other state organizations (further - departments).

The system is the software product determined by authorized body in the sphere of electronic document management and the digital signature by means of which the electronic document management between participants of information exchange is performed.

2. The process clerical work connected with legislative activity in Majlisi milli and Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, and procedure for consideration of actions for declaration and cases in courts are performed according to the procedure, established by the legislation.

3. Addressed to the President of the Republic of Tajikistan, the Government of the Republic of Tajikistan and Executive office of the President of the Republic of Tajikistan documents are submitted in paper form on the official form and color seal.

4. The operating procedure with the documents having the data which are the state secret is performed according to the legislation of the Republic of Tajikistan on protection of the state secret.

5. Language of clerical work and correspondence between departments are performed according to requirements of the Law of the Republic of Tajikistan "About state language of the Republic of Tajikistan". In appropriate cases of department can correspond with legal entities and physical persons in one of foreign languages (Russian or English) in accordance with the established procedure.

6. In case, existence of internal electronic document management system, participants of information exchange in accordance with the established procedure, will shall carry out integration with single system.

7. In case, absence of electronic document management system, participants of information exchange, shall use single system.

8. Obligations on observance of requirements of this Instruction are assigned on structural division of department.

9. The common directorship and control of observance of requirements according to this Instruction is exercised by the head of department directly and through structural division on clerical work.

10. Heads of structural divisions of department shall inform workers of this Instruction and explain operating procedure with electronic documents (further - documents) by means of system.

11. Employees of department bear the personal responsibility for fulfillment of requirements of this Instruction.
