RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of provision of services on medical attendance of the population for a fee from legal entities and physical persons

According to part ten of Article 18 of Bases of the legislation of Ukraine on health protection the Cabinet of Ministers of Ukraine decides:

1. Approve the list of cases in case of which healthcare institutions of the state and municipal pattern of ownership can provide services in medical attendance of the population for a fee from legal entities and physical persons which is applied.

2. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. Determine that:

1) the healthcare institutions operating in form of business of the public or municipal institution can perform the additional (economic) activities provided by their charters and independently establish payment for it;

2) in the state and municipal healthcare institutions:

the list of services in medical attendance of the population which can be provided for a fee from legal entities and physical persons, their cost are published on the website of healthcare institution and are placed at information stands in healthcare institution;

the list of the services in medical attendance of the population provided by healthcare institution for patients free of charge at the expense of means of the government or local budget, in particular within the program of the state guarantees of medical attendance of the population, is published on the website of healthcare institution and is placed at information stands in healthcare institution;

provision of services on medical attendance of the population for a fee from legal entities and physical persons is drawn up by the relevant supporting documents, entered into electronic health care system with indication of payment source, and calculation is perfromed only in non-cash form.

5. Provide to the Ministry of Health provision of the generalized explanations on application of this resolution.

6. This resolution becomes effective since January 1, 2025, except Item 2 of this resolution which becomes effective from the date of publication of this resolution.

The list of cases in case of which healthcare institutions of the state and municipal pattern of ownership can provide services in medical attendance of the population for a fee from legal entities and physical persons

Cases in case of which legal entities and physical persons perform complete payment of the rendered services in medical attendance of the population

1. Provision of services on medical attendance of the population without the direction of the doctor, except cases when the direction is not required according to the legislation.

2. Provision of services on medical attendance of the population under contracts with legal entities.

3. Provision of services on medical attendance of the population in the healthcare institutions relating to the sphere of management of Public administration of cases and the state bodies entering the sector of safety and defense, to the patients who are not belonging to the attached contingent.

4. Provision of services on medical attendance of the population which do not become covered according to the program of the state guarantees of medical attendance of the population.

Cases in case of which legal entities and physical persons perform payment of additional services

5. Provision of services on medical attendance of the population at the place of residence (stay) of the patient at the independent choice of the patient on condition of lack of the indication for their provision.

6. The independent choice of the attending physician when rendering specialized medical care in planned procedure in stationary conditions.

7. Stay in chamber with the increased level of comfort and service for the independent choice of the patient.

Changes which are made to Resolutions of the Cabinet of Ministers of Ukraine

1. The paragraph the fifth Item 12 of appendix to the resolution of the Cabinet of Ministers of Ukraine of December 25, 1996 No. 1548 "About establishment of powers of executive bodies and executive bodies of city councils on price regulation (rates)" (ZP of Ukraine, 1996, No. 21, Art. 596; Official Bulletin of Ukraine, 2017, No. 27, Art. 787, No. 51, Art. 1573; 2018, No. 19, Art. 636; 2019, No. 43, Art. 1492; 2020, No. 62, Art. 2006; 2021, No. 22, Art. 1016; 2023, 19, the Art. 1087) to exclude No.

Item 1 of the list of paid services which can be provided by organizations of education, other organizations and organizations of education system relating to the state and municipal pattern of ownership, the Cabinet of Ministers of Ukraine approved by the resolution of August 27, 2010 No. 796 (The Official Bulletin of Ukraine, 2010, No. 67, to Art. 2410; 2018, No. 68, Art. 2289; 2021, No. 88, the Art. 5656) to add with the subitem of 31 following contents:

"31) provision by the institutions of higher education performing training of professionals and specialists in health sector, scientific institutions, other organizations and organizations of education system of the services connected with:

profound training of separate objects over amount of services of the curriculum;

working off by students of the higher educational institutions performing training of professionals and specialists in health sector, practical, laboratory and seminar training on profile disciplines which were passed by them without valid excuse;

liquidation by students of the academic difference which arises owing to disagreements of curricula, in case of their translation and updating in the institutions of higher education performing training of professionals and specialists in health sector;

repeated studying by the deducted students of separate disciplines and rates with the subsequent examination and offsettings;

training of foreigners in internship, medical residency, postgraduate study, doctoral studies, their professional training;

passing by doctors, druggists/pharmacists and other professionals in health sector of cycles of thematic enhancement, cycles of specialization and professional training over the state order on the self-supporting beginnings;

training of doctors - interns, druggists-interns and doctors - residents on terms of the contract for means of legal entities and physical persons;

provision of services on legalization of education documents in health sector;
