About approval of Methodological regulations of processing of the transit declaration in the New computerized transit system

According to Item 414, Item 641 of the Regulations on enforcement of the Customs code No. 95/2021, approved by the Order of the Government of the Republic of Moldova No. 92/2023 (Monitorul Oficial al Republicii Moldova, 2023, No. 93-96, 193), with the subsequent amendments, I ORDER to the Art.:

1. Approve Methodological regulations of processing of the transit declaration according to appendix.

2. From the moment of implementation of the New computerized transit system to submit transit declarations to electronic system of transit according to the approved Methodological regulations this order.

3. To management on development and information security to take necessary measures for accomplishment of provisions of this order.

4. This order becomes effective since July 1, 2024 and is published in the Official monitor of the Republic of Moldova.

Methodological regulations of processing of the transit declaration

Chapter I. General provisions

1. These methodological regulations of processing of the transit declaration (further - Methodological regulations) establish procedure for provision, carrying out and control of the transit mode in the territory of the Republic of Moldova with use of the New computerized transit system (further - NKTS).

2. In case of application of this Regulations the terms below mean:

1) AAR – Anticipated Arrival Record - record about the expected arrival: the electronic message containing information taken from the transit declaration automatically generated by appendix NKTS in case of release for transit which is transferred from customs post of departure to customs post of appointment;

2) ATR - Anticipated Transit Record - record about the expected transit: the electronic message containing information taken from the transit declaration automatically created by appendix NKTS in case of release for transit which is transferred from customs post of departure to customs post of transit;

3) appendix NKTS – the online application allowing economic operators to register and transfer elements of electronic data for declaration of goods in customs regime of transit;

4) registration office of incidents - the next customs post to which incidents occurred during the transit procedure.

5) request about the subsequent control - the document requesting Customs Service of the subsequent control of provided information and any documents, forms, permissions or data concerning transit transaction for the purpose of check of authenticity of records, provided information and seals;

6) permission to release for transit - action by means of which the Customs Service leaves in the order of the holder of the mode of customs transit the goods which passed customs clearance for the purposes provided by the mode of transit under which they are placed;

7) LOI – List of Items - List of objects: the document which is printed out from appendix NKTS, accompanying goods to customs post of appointment, drawn up according to the provisions established by Customs Service;

8) LRN – Local Reference Number - local reference number – the reference number provided by the holder of the transit mode for identification of the transit declaration in appendix NKTS;

9) MRN – Master Reference Number – the main referensny number assigned by competent customs post of the transit declaration;

10) NKTS – The new computerized transit system – the electronic system used for management and control of transit system;

11) the plan of providing going concern - the procedure based on use of the paper documents constituted for ensuring submission of the transit declaration and monitoring of transit transaction when it is impossible to apply the procedure based on electronic methods of data processing;

12) competent division of Customs Service – department of transit of central office, with powers on confirmation and holding procedure of research of transit transactions.

3. B the purposes of application of NKTS the term "customs of departure" corresponds to the term "customs post of departure", "customs of appointment" corresponds to the term "customs post of appointment", and the term "customs of transit" corresponds to the term "customs post of transit".

Chapter II. Information procedure

Section 1. Creation of the transit declaration

4. Declaration of goods for the purpose of provision of the mode of transit is performed by filling and authentication by the holder, is direct or through the representative, in appendix NKTS of the transit declaration.

5. At this stage of the transit declaration LRN entered by the holder of the transit mode is appropriated.

6. After filling the transit declaration goes through appendix NKTS to competent customs post of departure.

7. Submission of the transit declaration in customs post of departure is performed with observance of the following conditions:

1) the accuracy and integrity of information entered in the transit declaration is provided;

2) authenticity and reliability of the supporting documents introduced in the transit declaration is provided;

3) to provide observance of all obligations following from placement of the goods brought in the transit declaration.

8. In case of submission of the transit declaration the holder/representative submits goods and accompanying transport documents to customs post of departure on conditions, stipulated in Article 163 Customs codes.
