About approval of the Method of calculation of rates for the services rendered by the Agency of water transport of the Republic of Moldova, Nomenclature of services and size of rates for the services rendered to them

Based on part (4) article 15 of the Law No. 98/2012 on the supervisory branch public control (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes, parts (2) Article 63 of the Merchant Marine Code of the Republic of Moldova approved by the Law No. 599/1999 (The official monitor of the Republic of Moldova, 2001, Art. No. 1-4, 2), with subsequent changes, and parts (2) article 6 of the Law No. 235/2006 on the basic principles of regulation of business activity (The official monitor of the Republic of Moldova, 2006, Art. No. 126-130, 627), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Method of calculation of rates for the services rendered by the Agency of water transport of the Republic of Moldova according to appendix No. 1;

1.2. The nomenclature of the services rendered by the Agency of water transport of the Republic of Moldova and the size of rates for the services rendered to them, according to appendix No. 2.

2. In the subitem 2) Item 12 of the Order of the Government No. 706/2018 on creation of the Agency of water transport of the Republic of Moldova (The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 816), with subsequent changes, the text ", except for appendices No. 3 and 4" to exclude.

3. Recognize invalid appendices No. 3 and 4 to the Order of the Government No. 1128/2006 about creation of public organization "Service of the Harbor Captain "Dzhyurdzhyulesht"" and the state company "Register of shipping" (The official monitor of the Republic of Moldova, 2006, Art. No. 158-160, 1220), with subsequent changes.

4. To impose control over the implementation of this resolution on the Ministry of infrastructure and regional development.

Method of calculation of rates for the services rendered by the Agency of water transport of the Republic of Moldova

I. General provisions

1. This Technique regulates procedure of payments and changes of rates for the services rendered for a fee to physical persons and legal entities (further – rates) the Agency of water transport of the Republic of Moldova (further – the Agency), according to its competence established by regulations.

2. Rates for the rendered services are developed according to the rules and the principles provided in this Technique and submitted to the Government for approval in the procedure established by the legislation.

3. The rates calculated according to this Technique are applied to all physical persons and legal entities, being receivers of the services rendered by the Agency irrespective of pattern of ownership and legal form.

4. The technique establishes structure and structure of the costs / expenses included in rates.

5. Rates are calculated on the basis of non-commercial formula which provides covering of the expenses / costs connected with process of rendering services.

6. Rates are established based on regulations of the labor costs measured in man-hours, the pay level of work of the involved personnel and fees of compulsory national social insurance.

7. When calculating rates for the services in registration following from obligations of the port State and flag state correction coefficients depending on type, age and the tonnage of the vessel are applied, and when calculating rates for services in technical inspection of courts and watercrafts – correction coefficients in each separate case depending on the size of the vessel, total power of engines, total power of generators, the size of refrigerating chambers, quantity of heavy lift gears.

II. Cost structure and expenses on the rendered services

8. Straight lines and the distributed material costs connected with process of rendering services include the consumed materials and services used in the course of rendering services.

9. Straight lines and the distributed staff expenses include compensation of the personnel which are directly participating in process of rendering services.

10. Administrative expenses include the expenses connected with process of the organization, servicing and management of the Agency for the purpose of implementation of the powers by it on rendering services. These expenses include:

10.1. theoretical consumptions on compensation and fees of compulsory national social insurance of the staff of the Agency indirectly participating in process of rendering services;

10.2. depreciation expenses, content, servicing and repair of tangible and intangible assets;

10.3. expenses on safety control and labor protections;

10.4. maintenance costs of information systems, electronic and post communication services;

10.5. rent expenses, employment and utilities, preparation / retraining of personnel, etc.;

III. Procedure of payments of rates

11. Rates are established based on the in-depth study of costs and expenses incurred by the Agency in previous period of activities, in the last two years.

12. The rate for the rendered service is determined by the following formula and, if necessary, is adjusted by application of the correction coefficients specified in Item 7:
