About approval of Regulations about new foodstuff

Based on part (3) article 14 of the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, 2019, Art. No. 59-65, 120), with subsequent changes, DECIDES: the Government

1. Approve Regulations about new foodstuff it (is applied).

2. The list of new foodstuff affirms the order of the Minister of Agriculture and the food industry, is published in the Official monitor of the Republic of Moldova and regularly updated according to the changes made at the European Union level.

3. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry and the National agency on safety of foodstuff.

4. Declare invalid the Order of the Government No. 925/2009 about approval of Sanitary regulations about new foodstuff (The official monitor of the Republic of Moldova, 2010, Art. No. 4-6, 16), with subsequent changes.

5. This resolution becomes effective after three months from the date of publication in the Official monitor of the Republic of Moldova.

Regulations about new foodstuff

The regulations about new foodstuff shift Art. 1 (1) and (2), Art. 2 (1), (2) a subitem) and b), Art. 3 (2) a subitem), d) and f), Art. 4 (1) and (2), Art. 10 (1) and (2) Regulations (EU) 2015/2283 of the European parliament and Council of the November 25, 2015 about new foodstuff making changes to Regulations (EU) No. 1169/2011 of the European parliament and Council and canceling Regulations (EC) No. 258/97 of the European parliament and Council and Regulations (EC) No. 1852/2001 of the Commission (CELEX: 32015R2283, European Union published in the Official magazine of series L 327 of December 11, 2015, with the last amendments made by Regulations (EU) 2019/1381 of the European parliament and Council of June 20, 2019.

I. General provisions

1. The regulations about new foodstuff (further - Regulations) establish rules of introduction of new foodstuff on the market of the Republic of Moldova.

2. The purpose of these Regulations is introduction on the market of new foodstuff when ensuring high level of protection of health of the person and consumer interests.

3. These Regulations do not extend on:

3.1. genetically modified foodstuff provided in the Law No. 394/2023 on genetically modified foodstuff and sterns;

3.2. foodstuff if they are used in quality:

3.2.1. the food enzymes provided in the Sanitary regulations about food enzymes approved by the Order of the Government No. 1056/2016;

3.2.2. the food supplements provided in the Sanitary regulations about food supplements approved by the Order of the Government No. 229/2013;

3.2.3. the food fragrances provided in the Order of the Government No. 1245/2018 about approval of sanitary regulations about vkusoaromatichesky additives and some food ingredients with vkusoaromatichesky properties for use in and on food and about the smoking fragrances used or held for use in or on food;

3.2.4. extraction solvents, foodstuff, used or held for use in case of production, and food ingredients provided in Sanitary regulations about the extraction solvents used in case of the production of foodstuff and food ingredients approved by the Order of the Government No. 671/2020.

4. For the purposes of these Regulations the determinations stated in the Law No. 306/2018 on safety of foodstuff and also the following concepts are applied:

4.1. new foodstuff - any foodstuff which was not used in wide scales for consumption by the person in the territory of the Republic of Moldova till May 15, 1997 and which belongs at least to one of the following categories:

4.1.1. foodstuff with new or intentionally the changed molecular structure if such structure was not used in quality or as a part of foodstuff in the territory of the Republic of Moldova till May 15, 1997;

4.1.2. the foodstuff consisting, allocated or made from microorganisms, fungi or seaweed;

4.1.3. the foodstuff consisting, allocated or made from materials of mineral origin;

4.1.4. the foodstuff consisting, allocated or made from plants or their parts, except as specified, when such products have history of safe consumption in the territory of the Republic of Moldova and consists, is allocated or made from plant or kind of the same type received as a result of use:

4.1.4.1. traditional methods of cultivation which were not used for production of foodstuff in the territory of the Republic of Moldova till May 15, 1997;

4.1.4.2. nonconventional methods of cultivation which were not used for production of foodstuff in the territory of the Republic of Moldova till May 15, 1997 if such methods do not lead to the essential changes in structure or structure of foodstuff influencing their nutrition value, metabolism or level of undesirable substances;

4.1.5. the foodstuff consisting, allocated or the foodstuff made from such animals made from animals or their parts, except for the animals received as a result of use of traditional methods of cultivation who were used for production of foodstuff in the territory of the Republic of Moldova till May 15, 1997 and have history of safe consumption in the territory of the Republic of Moldova;

4.1.6. the foodstuff consisting, allocated or made from cages or fabrics, derivatives from animals, plants, microorganisms, fungi or seaweed;

4.1.7. the foodstuff which appeared as a result of production process which was not applied to production of foodstuff in the territory of the Republic of Moldova till May 15, 1997 and which leads to the essential changes in structure or food texture influencing its nutrition value, metabolism or level of undesirable substances;

4.1.8. the foodstuff containing the made nanomaterials as they are determined in subitem 4. 5, or consisting of them;
