Based on Articles 173, 408 and 410 Agreements on association between the Republic of Moldova on the one hand both the European Union and European Atomic Energy Community and their state members on the other hand, ratified by the Law No. 112/2014 (The official monitor of the Republic of Moldova, 2014, Art. No. 185-199, 442), the Government DECIDES:

These changes partially shift:

The directive 2009/48/EU of the European parliament and Council of June 18, 2009 about safety of toys published in the Official magazine of the European Union of series L 170 of June 30, 2009 (CELEX: 32009L0048), with the last amendments made by the Directive (EU) 2021/903 of the Commission of June 3, 2021;

The directive 2014/30/EU of the European parliament and Council of February 26, 2014 about harmonization of the laws of the state members concerning electromagnetic compatibility published in the Official magazine of the European Union of series L 96 of March 29, 2014 (CELEX: 32014L0030), with the last amendments made by Regulations (EU) 2018/1139 of the European parliament and Council of July 4, 2018;

The directive 2014/35/EU of the European parliament and Council of February 26, 2014 about harmonization of the laws of the state members concerning provision in the market of electric equipment, held for use in certain limits of tension published in the Official magazine of the European Union of series L 96 of March 29, 2014 (CELEX: 32014L0035);

Regulations (EU) 2016/425 of the European parliament and Council of March 9, 2016 about individual protection equipment and about cancellation of the Directive of Council 89/686/EEC, published in the Official magazine of the European Union of series L 81 of March 31, 2016 (CELEX: 32016R0425);

Regulations (EU) 2016/426 of the European parliament and Council of March 9, 2016 about the equipment using the burned gaseous fuel, and about cancellation of the Directive 2009/142/EU, published in the Official magazine of the European Union of series L 81 of March 31, 2016 (CELEX: 32016R0426).

1. Approve changes which are made to some orders of the Government (about technical regulations in the field of electric equipment and individual protection equipment, the equipment using gaseous fuel, electromagnetic compatibility of the equipment, and also safety of toys) it (is applied).

Changes which are made to some orders of the Government (about technical regulations in the field of electric equipment and individual protection equipment, the equipment using gaseous fuel, electromagnetic compatibility of the equipment, and also safety of toys)

In the Technical regulation "Ensuring Presence in the Market of Electric Equipment, Held for Use in Certain Limits of Tension" approved by the Order of the Government No. 745/2015 (Official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 838), with subsequent changes, to make the following changes:

1.1. in all text of the word "main safety requirements" in any grammatical form shall be replaced with words "the safety purposes" in the corresponding grammatical form, and shall be replaced with words the words "economic agent" in any grammatical form "the economic operator" in the corresponding grammatical form;

1.2. state Item 1 in the following edition:

"1. This Technical regulation extends to electric equipment, held for use with rated voltage from 50 to 1 000 V of alternating current and from 75 to 1 500 V of direct current, except for electric equipment and the phenomena listed in Item 2.

The purpose of this Technical regulation is ensuring compliance of electric equipment presented at the market, to the requirements providing the high level of protection of health and safety of people, pets and also protection of property, guaranteeing at the same time functioning of the domestic market.";

1.3. the subitem h) Item 2 to state in the following edition:

"h) special electric equipment for use on vessels, aircrafts or the railroads which corresponds to the safety provisions established by the international organizations in which the Republic of Moldova consists;";

1.4. state Item 3 in the following edition:

"3. For the purposes of this Technical regulation the following concepts are used:

ensuring presence in the market - delivery of electric equipment for its distribution, consumption or use in the market of the Republic of Moldova within business activity on paid or free basis;

introduction on the market - the first ensuring presence of electric equipment in the market of the Republic of Moldova;

producer - physical person or legal entity which makes electric equipment or for which electric equipment realizing this equipment under own name or trademark is developed or made;

the authorized representative - any physical person or legal entity with the location in the Republic of Moldova which was in writing authorized by the producer to carry out certain tasks from his name;

the importer - any physical person or legal entity with the location in the Republic of Moldova which enters on the market of the Republic of Moldova electric equipment from the third country;

the distributor - any physical person or legal entity in supply chain, except the producer or the importer, the providing presence of electric equipment in the market;

economic operators - the producer, the authorized representative, the importer and the distributor;

the technical specification - the document ordering technical requirements to electric equipment;
