Chapter 1. General provisions

1. These rules of use of zones of the regime territories and the territories adjoining to them (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About architectural, town-planning and construction activities in the Republic of Kazakhstan", other regulatory legal acts and the state standard rates in the field of architecture, town planning and construction and determine procedure for use of zones of the regime territories and the territories adjoining to them.

2. In these rules the following concepts are used:

1) zones of the regime territories - the territories within settlements and out of their limits, intended for placement of the protected objects;

2) the territories adjacent to zones of the regime territories, - the territories which are directly adjoining borders of the regime territories according to requirements of these rules.

Chapter 2. Procedure for use of zones of the regime territories and the territories adjoining to them

Requirements of these rules extend to all subjects of architectural, town-planning and construction activities within borders of the regime territories and the territories adjoining to them established according to the legislation in the field of architectural, town-planning and construction activities.

4. Zones of the regime territories and territories adjoining to them are territorial objects of architectural, town-planning and construction activities of special regulation and town-planning regulation.

5. Zones of the regime territories and territories adjoining to them include special zones with the placed (placed) objects of particular treatment to which sanitary protection and conservation zones, according to the legislation in the field of architectural, town-planning and construction activities are established.

6. The zones of the regime territories and the territories adjoining to them intended for placement of the protected objects in settlements are the parcels of land limited on perimeter to distance of 100 (hundred) meters, and out of settlements 1 (one) kilometer from external borders of the parcels of land.

Regulations in case of construction of the new objects placed in the territories adjacent to zones of the regime territories are determined by distance, altitude and number of storeys in the state standard rates in the field of architecture, town planning and construction.

7. By provision of the parcel of land for conducting construction activities within the territories specified in Item 6 of these rules, the act of the choice and the scheme of withdrawal of the parcel of land are approved with the interested state bodies according to Item 2 of Article 43, item 4 of Article 44-1 and Item 10 of Article 44-2 of the Land code of the Republic of Kazakhstan.

8. Use of zones of the regime territories and the territories adjoining to them is performed according to the approved town-planning projects (master plans and drafts of the detailed layout) according to the legislation in the field of architectural, town-planning and construction activities.
