PRESIDENTIAL DECREE OF THE REPUBLIC OF BELARUS

of December 2, 2024 No. 439

About transformation of especially protected natural territories

For the purpose of effective functioning of the public nature protection institutions "Berezinsky Biospheric Reserve", "Braslau Lakes and "National park "Pripyat" I decide national park:

1. Transform the Berezinsky biospheric reserve and national parks Braslau Lakes, "Pripyat", having changed their borders, the mode of protection and use.

2. Bring in the Presidential decree of the Republic of Belarus of February 9, 2012 No. 59 "About some questions of development of especially protected natural territories" the following changes:

To be reworded as follows the regulations on the Berezinsky biospheric reserve approved by the Decree it (is applied);

to be reworded as follows the borders, the area and structure of lands of the Berezinsky biospheric reserve approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of the conservation zone of the Berezinsky biospheric reserve approved by the Decree (are applied);

To be reworded as follows the regulations on National park Braslau Lakes approved by the Decree it (is applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of National park (are applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of reserved zone of National park (are applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of zone of regulated use of National park (are applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of recreational zone of National park (are applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of economic zone of National park (are applied);

the Braslau Lakes approved by the Decree to be reworded as follows borders, the area and structure of lands of the conservation zone of National park (are applied);

To be reworded as follows the regulations on National park "Pripyat" approved by the Decree it (is applied);

to be reworded as follows the borders, the area and structure of lands of National park "Pripyat" approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of reserved zone of National park "Pripyat" approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of zone of regulated use of National park "Pripyat" approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of recreational zone of National park "Pripyat" approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of economic zone of National park "Pripyat" approved by the Decree (are applied);

to be reworded as follows the borders, the area and structure of lands of the conservation zone of National park "Pripyat" approved by the Decree (are applied).

3. To provide to the Vitebsk regional executive committee within two months withdrawal from farmlands of agricultural purpose of the parcels of land of Braslavsky District Agroservice open joint stock company with total area of 0,84 of hectare, Kuropolye-agro open joint stock company by the total area of 1,02 of hectare, Druysky open joint stock company by the total area of 0,06 of hectare, Ekzito of Prime limited liability company by the total area of 193,72 of hectare, Slobodka-agro open joint stock company by the total area of 27,50 of hectare, agricultural production cooperative "Beacon Braslavsky" total area of 3,34 of hectare in the territory of Braslavsky district of the Vitebsk region and their provision in permanent use to the public nature protection institution "National park Braslau Lakes with transfer of these parcels of land from category of lands of agricultural purpose in category of lands of nature protection, improving, recreational, historical and cultural appointment without additional approval of possibility of provision of farmlands of agricultural purpose.

4. This Decree becomes effective in the following procedure:

Item 3 and this Item - after official publication of this Decree;

other provisions of this Decree - in two months after its official publication.

Regulations on the Berezinsky biospheric reserve

1. The Berezinsky biospheric reserve (further - the reserve) is announced on lands of Dokshitsky, Lepelsky and Ushachsky districts of the Vitebsk region and Borisovsky district of the Minsk region for the purpose of preserving in natural state of valuable natural complexes and objects, studying of animal and the flora, typical and unique ecosystems and landscapes characteristic of zone of the mixed woods of Eastern Europe, creation of conditions for providing the natural course of natural processes. Distinctive feature of the reserve is the unique complex of the forest and wetland ecosystems which almost completely kept the natural appearance.

2. The reserve is in management of Administration of the President of the Republic of Belarus. Control of the reserve is exercised of the public nature protection institution "Berezinsky Biospheric Reserve" (further - organization) which is acting on the basis of the Charter, approved Managing affairs of the President of the Republic of Belarus.

3. The mode of protection and use of the reserve is established by the Law of the Republic of Belarus of November 15, 2018 No. 150-Z "About especially protected natural territories", and also this Provision.

4. The earth of the reserve are used according to the legislation setting legal regime of special protection concerning the natural territories which are subject to special protection and the management plan by the reserve approved by Administration of the President of the Republic of Belarus in coordination with the Ministry of Natural Resources and Environmental Protection and also with National academy of Sciences of Belarus.

Land users, the parcels of land (part of the parcels of land) of which are included the lands forming the reserve, and also other physical persons and legal entities performing economic and other activity in the reserve shall observe the mode of its protection and use established by this Provision and other acts of the legislation setting legal regime of special protection concerning the natural territories which are subject to special protection.

5. In the territory of the reserve all types of activity, except for are prohibited the activities specified in Item 2 of article 26 of the Law of the Republic of Belarus "About especially protected natural territories".

6. On specially allocated sites of the reserve which are not including valuable natural complexes and objects for the purpose of which preserving the reserve appeared types of activity, aimed at providing functioning of the reserve and life activity of the citizens living in its borders, the Republic of Belarus specified in Item 3 of article 26 of the Law "About especially protected natural territories" are allowed.

7. The mode of protection and use of the reserve is considered in case of development and implementation of concepts, forecasts, programs, action plans, schemes of industry development of Dokshitsky, Ushachsky and Lepelsky districts of the Vitebsk region and Borisovsky district of the Minsk region which realization is connected with use of natural resources and (or) can make impact on the environment, and also in case of development and projects implementation and schemes of land management, town-planning projects, industry schemes of placement and development of production and objects of transport and engineering infrastructure, projects of land reclamation, development plans for mining operations, projects of reasons for borders of mountain branches, projects of the water protection zones and coastal strips, the republican complex scheme of placement of fishing grounds, forest management projects, projects of okhotoustroystvo and the layout of rest areas of Dokshitsky, Ushachsky and Lepelsky districts of the Vitebsk region and Borisovsky district of the Minsk region.

8. Protection of the reserve is provided with officials of organization to whom functions of the state forest protection are assigned.

9. For the purpose of protection of the territory of the reserve on public roads in its borders check-points can be created.

Borders of the Berezinsky biospheric reserve (further - the reserve) pass:

in the north:

in the territory of the Dokshitsky district of the Vitebsk region - from northwest corner of quarter No. 13 of the Berezinsky forest area of the public nature protection institution "Berezinsky Biospheric Reserve" (further - the Berezinsky forest area) in east direction on northern border of the specified quarter to point of intersection with border of quarter No. 6 of the Berezinsky forest area, then in the northern direction on the western border of quarter No. 6 and east direction on northern borders of quarters No. 6, of 7, 15 Berezinsky forest areas, crossing in a straight line strip of withdrawal of Berezino Highway N-2642 - Ugoltsa - Chernitsa 1, to extreme western corner of border of quarter No. 8A of the specified forest area, further in the northern direction on the western borders of quarters No. 8A, 2A, 1B of the Berezinsky forest area to area border, further in east direction on area border to point of its crossing with border of quarter No. 1B of the Berezinsky forest area;

in the territory of Ushachsky district of the Vitebsk region - in the northeast direction on northern border of quarter No. 1B of the Berezinsky forest area to point of its crossing with area border;

in the territory of the Dokshitsky district of the Vitebsk region - in northeast, southern, east and northeast directions on northern border of the area to point of its crossing with border of quarter No. 1A of the Berezinsky forest area;

in the territory of Ushachsky district of the Vitebsk region - in northern, east and southeast directions on northern border of quarter No. 1A of the Berezinsky forest area to point of its crossing with area border;

in the territory of the Dokshitsky district of the Vitebsk region - in the southern, southeast and east directions on eastern frontier of the area to border of Lepelsky district of the Vitebsk region;

in the east:

in the territory of the Dokshitsky district of the Vitebsk region - in southwest, southeast, crossing in a straight line strip of withdrawal of the highway R-86 Bogushevsk - Senno - Lepel - Myadel, the southern, southeast, southwest and southern directions on eastern frontier of the area to the place of vytok of the channel Berezinsky from the lake. Smoothly;

in the territory of Lepelsky district of the Vitebsk region - from the place of vytok of the channel Berezinsky from the lake. The reserve of 86 377,25 of hectare is located in Dokshitsky, Lepelsky and Ushachsky districts of the Vitebsk region and Borisovsky district of the Minsk region.

The parcels of land (part of the parcels of land) of the public nature protection institution "Berezinsky Biospheric Reserve" enter into structure of the lands of the reserve forming its territory:
