About approval of Rules of execution of the act of sampling and its forms

According to Item 7 of article 6 of the Law of the Republic of Kazakhstan of January 14, 2016 "About precious metals and gemstones" PRIKAZYVAYU:

1. Approve:

1) Rules of execution of the act of sampling according to appendix 1 to this order;

2) form of the act of sampling according to appendix 2 to this order.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within five working days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of execution of the act of sampling

1. General provisions

1. These rules of execution of the act of sampling (further – Rules) are developed according to Item 7 of article 6 of the Law of the Republic of Kazakhstan of January 14, 2016 "About precious metals and gemstones" (further – the Law) and determine procedure for execution of the act of sampling.

2. In these rules the following basic concepts are used:

1) precious metals – gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium and osmium) in any condition and type;

2) the primary goods containing precious metals – the raw precious metals (including Dore's alloy in the form of ingot, cathodic metals), zinc rainfall, scrap and waste of precious metals, ores and concentrates of precious metals, the ores, concentrates and ashes of non-ferrous metals, semi-products of production of non-ferrous metals containing precious metals;

3) representative test (further – test) – the representative part of the primary goods containing precious metals, characterizing structure and properties of all amount of the primary goods containing precious metals;

4) authorized body – the central executive body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of regulation of production of precious metals and turnover of precious metals and gemstones, the primary goods containing precious metals, jewelry and other products;

5) authorized organization – the legal entity accredited according to the legislation of the Republic of Kazakhstan on accreditation in the field of assessment of conformity on conducting examination.

2. Procedure for execution of the act of sampling

4. The act of sampling is filled in with use of technical means or legible handwriting ink of black or blue color as follows.

In Item 1 of the act of sampling general information is specified:

the name of the individual entrepreneur or legal entity having intention to export the primary goods containing precious metals from the territory of the Republic of Kazakhstan;

surname, name, middle name (in the presence), position of person which selected tests;

place of employment, surname, name, middle name (in the presence), position of persons which are present when sampling;

the name of the regulating technical document according to which sampling is performed;

the location of the primary goods containing precious metals;

route of the direction of the primary goods containing precious metals.

In Item 2 of the act of sampling data on conditions of sampling and the used technical means are filled in.

In Item 3 of the act of sampling the table containing data on the selected tests is filled in:

in column 1 – sequence number of the selected test;

in column 2 – the name of the primary good containing precious metals;

in column 3 – the weight of the selected test in grams;

in column 4 – individual number of test;

in column 5 – type of packaging.

In item 4 of the act of sampling in case of origin notes of the present persons with indication of their surname, name, middle name (in the presence) and positions are noted.

In Item 5 of the act of sampling are put down:

signatures of the present persons, and also person who drew up the statement of sampling with indication of their position, surname, name, middle name (in the presence);

date of creation of the act of sampling;

seal of the individual entrepreneur or legal entity having intention to export the primary goods containing precious metals from the territory of the Republic of Kazakhstan;

the signature of person who received copy of the act of sampling with indication of its position, surname, name, middle name (in the presence) and the dates of receipt of copy.

5. The sampling report is drawn up in triplicate:

the first copy remains at the individual entrepreneur or the legal entity having intention to export the primary goods containing precious metals from the territory of the Republic of Kazakhstan;

the second copy – for submission to authorized organization;

the third copy – for submission to authorized body.
