According to Items 12-2), 23-27) and 23-28) of article 20 of the Law of the Republic of Kazakhstan "About architectural, town-planning and construction activities in the Republic of Kazakhstan" and subitem 478-1) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan" of PRIKAZYVAYU:

1. Approve the enclosed Rules of maintaining, suspension, cancellation (response) of permissions in the automated register of permissions in the field of construction.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of maintaining, suspension, cancellation (response) of permissions in the automated register of permissions in the field of construction

Chapter 1. General provisions

1. These rules of maintaining, suspension, cancellation (response) of permissions in the automated register of permissions in the field of construction (further - Rules) are developed according to Items 12-2), 23-27) and 23-28) of article 20 of the Law of the Republic of Kazakhstan "About architectural, town-planning and construction activities in the Republic of Kazakhstan" (further - the Law) and subitem 478-1) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864, which determine procedure for maintaining, suspension, cancellation (response) of permissions in the automated register of permissions in the field of construction.

2. Maintaining the automated register of permissions in the field of architecture, town planning and construction is performed for the purpose of:

1) systematization of data on permissions of the first and second category, automation subjects by means of the state information system;

2) informing physical persons and legal entities of the Republic of Kazakhstan on the data containing in the automated register of permissions in the field of construction.

3. The basic concepts used in these rules:

1) authorized body in the field of architecture, town planning and construction (further - authorized body) - the central state body performing management in the field of architecture, town planning and construction;

2) allowing bodies - licensors and the bodies authorized on issue of permissions of the second category;

3) data on permission - the complete information on permission including all data of the document and change history of the status of permission;

4) the state information system (further - System) - the information system intended for implementation in electronic form of licensing regarding obtaining, renewal, suspension, renewal and the termination (response) of permission with assignment of identification number, the direction of the notification and ensuring these processes;

5) the automated register of permissions in the field of construction (further - the automated register) - component of information system for the organization of carrying out construction for the principle of "one window", integrated with information systems of state bodies, containing the information about subjects of construction;

6) the applicant - physical person or legal entity, branch or representation of the legal entity, the licensee, the owner of permission of the second category who addressed to the relevant allowing organ for passing of licensing or the allowing procedure or who directed the notification;

7) the licensee - physical person or legal entity, and also branch of the foreign legal entity which object of activity is rendering financial services, having the license;

8) the owner of permission of the second category - the physical person or legal entity having the valid permission of the second category;

9) unique identification number of permission (further - UINR) - the unique identification number assigned to permissions of the first category the state information system of the permissions and notifications issued before enforcement of these rules;

10) the status of permission - the characteristic of current status of permission changed in process of implementation of allowing procedures;

11) historical data - information on the permissions issued or sent to the period of temporary or permanent absence at allowing and state bodies, possibility of maintaining the state electronic register of permissions and notifications;

12) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the EDS and confirming reliability of the electronic document, its accessory and invariance of content;

13) personal account - the Section of information system which contains the personal information about the user collected from different state databases;

14) the state control of the automated register of permissions in the field of construction - process of collection and the analysis of data System during the implementing of the procedure of licensing, observance by subjects of requirements of the legislation of the Republic of Kazakhstan, including compliance to the established allowing requirements (further - Monitoring).

4. Establishment of access rights and ensuring functioning of the Register is performed by authorized body. Maintaining the Register is made by authorized body.
