3. To chiefs of educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) to take measures for registration of the specified Charters in judicial authorities in the established legislation procedure;

2) to organize studying of the specified Charters by staff and to provide management with them in practical activities;

3) to take the measures following from this order.

4. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan and the Department of personnel policy.

5. This order becomes effective from the date of its signing.

Chapter 1. General provisions

1. Republican public institution "Almaty academy of the Ministry of Internal Affairs of the Republic of Kazakhstan of Makan Esbulatov" (further - Academy) is the non-profit organization having the status of the legal entity, created in form of business of organization.

2. Type of Academy - republican public institution.

3. It is created by the order of the Government of the Republic of Kazakhstan of June 1, 1999 No. 675 "About creation of public institution "Academy of the Ministry of Internal Affairs of the Republic of Kazakhstan".

The academy according to the Order of the Government of the Republic of Kazakhstan of September 30, 2010 No. 1009 "About some measures for increase in efficiency of law-enforcement activities and judicial system in the Republic of Kazakhstan" is provopriyemnik of public institution "Almaty academy of the Ministry of Internal Affairs of the Republic of Kazakhstan".

4. The academy in the activities is guided by the Constitution of the Republic of Kazakhstan, the laws, acts of the President of the Republic of Kazakhstan, other regulatory legal acts, and also this Charter.

5. Founder of republican public institution is the Government of the Republic of Kazakhstan.

6. The Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs) is the authorized body exercising general management by Academy, and also functions of the person of law concerning property of Academy.

7. The structure and the staff list of Academy affirm the Minister of Internal Affairs of the Republic of Kazakhstan (further - the Minister).

Chapter 2. Legal position of Academy

10. The academy according to the legislation of the Republic of Kazakhstan has banner, separate balance, seal with the image of the State Emblem of the Republic of Kazakhstan and stamps with the name, forms of the established sample, symbolics, accounts in bodies of treasury and banks, can acquire on its own behalf the property and non-property rights, perform duties, to be claimant and the defendant in court.

11. The academy cannot create legal entities, and also act as the founder (participant) of other legal entity. The academy has the right to create branches and representations in coordination with the Ministry of Internal Affairs.

12. The academy answers for the obligations, the money which is at its disposal, in case of their insufficiency, subsidiary responsibility according to its obligations is born by the Republic of Kazakhstan.

13. The academy enters the civil relations from own name according to the procedure, stipulated by the legislation the Republic of Kazakhstan.

Chapter 3. Subject and purposes of activities of Academy

15. Object of activity of Academy are:

1) training for law-enforcement bodies according to educational programs of the higher and postgraduate education. The list of implementable educational programs is determined by the Ministry of Internal Affairs according to the state licenses granted by authorized body in the field of science and the higher education;

2) initial professional training for persons for the first time arriving on service in law-enforcement bodies;

3) advanced training and retraining of personnel for law-enforcement bodies, other law enforcement and special bodies of the Republic of Kazakhstan, and also for foreign countries according to educational programs of additional education.

4) implementation of scientific activities for urgent problems of enhancement of law-enforcement activities;

5) carrying out and providing necessary actions in case of emergency situations and in the conditions of wartime according to the legislation of the Republic of Kazakhstan.

16. Purposes of activities of Academy:

1) creation of necessary conditions for receipt of the quality education directed to forming, development and professional formation of the personality on the basis of national and universal values, achievements of science and practice;

2) ensuring requirement of law-enforcement bodies for highly qualified personnel;

3) satisfaction of need of staff of law-enforcement bodies for intellectual and professional development;

4) development by scientific methods of new solutions of problematic issues of law enforcement and law and order.

17. For achievement of the purposes the Academy performs the following types of activity:

1) rendering educational services to the employees and persons for the first time arriving on service in law-enforcement bodies;

2) organization and carrying out scientific research. Scientific and methodical ensuring activities of law-enforcement bodies;

3) participation in rule-making activities;

4) provision of paid services which list is determined by the Ministry of Internal Affairs, according to the procedure, stipulated by the legislation the Republic of Kazakhstan;

5) participation in tenders of the scientific, scientific and technical projects and programs financed from the government budget and other sources which are not prohibited by the legislation of the Republic of Kazakhstan;

6) cooperation and interaction with state bodies, the scientific, educational, specialized organizations and organizations when implementing research, educational and educational and methodical activities;

7) development and implementation of international cooperation in the scientific and educational sphere, including training of foreign staff;

8) implementation of publishing and typographical activities;

The transaction made by Academy in contradiction with the activities purposes, definitely limited laws of the Republic of Kazakhstan or constituent documents or with violation of authorized competence of the chief of Academy, can be acknowledged invalid in the claim: The Ministry of Internal Affairs, authorized body in the field of science and the higher education, authorized body on state-owned property of either local executive body, or the prosecutor.

Chapter 4. Management of Academy

20. General management by Academy is exercised by the Ministry of Internal Affairs (authorized body).

21. The authorized body in the procedure established by the legislation of the Republic of Kazakhstan performs the following functions:

1) is assigned to Academy by property;

2) exercises control of safety of property of Academy;

3) is approved by funding plan of Academy;

4) is approved by the Charter of Academy, introduction in it of changes and amendments;

5) approves structure and the staff list of Academy within the established number of staff;

6) determines the rights, obligations and responsibility of the chief of Academy, the basis of release it from post;

7) on representation of the chief of Academy appoints to position and dismisses his deputies;

8) approves the annual financial reporting;

The written consent gives 9) to authorized body on state-owned property on withdrawal or redistribution of the property transferred to Academy or acquired by it as a result of own economic activity;

10) participates in development of separate Sections of the state obligatory standards of appropriate levels of educational activities of Academy;

11) participates in development of separate Sections of the qualification requirements imposed to educational activities of Academy, and the list of the documents confirming compliance to them;

Develops 12) and approves rules of activities of Academy;

Develops 13) and approves rules of the organization and implementation of educational process, educational and methodical and scientific and methodical activities in Academy;

Develops 14) and approves rules of the organization of educational process for distance training in Academy;

Develops 15) and approves rules of carrying out the current control of progress, intermediate and final assessment of students in Academy;

Develops 16) and approves rules of the organization of works on preparation, examination, approbation, the edition and carrying out monitoring of educational editions and educational and methodical complexes, except for the organizations of secondary education;

Develops 17) and approves Regulations of Admission to training in Academy;

18) determines terms of the beginning and completion of academic year in Academy;

Develops 19) and approves rules of the organization and passing of professional practice and training studying in Academy;

Develops 20) and approves translation rules and recoveries in Academy;

Develops 21) and approves qualification characteristics of positions of the faculty of Academy;

Develops 22) and approves rules of substitution of positions of the faculty and scientists of Academy;

Develops 23) and approves requirements to information systems and Internet resources of Academy;

24) approves lists of specialties and qualifications, the educational programs realized in Academy;

25) determines forms and technologies of education in Academy;

Develops 26) and approves rules of the organization of educational process using educational technologies in Academy;

27) performs other powers according to this Charter and other legislation of the Republic of Kazakhstan.

22. The chief of Academy is appointed to position and dismissed by the Minister according to the procedure, established by the legislation of the Republic of Kazakhstan.

23. The chief of Academy will organize and directs work of Academy, directly submits to the Minister and bears the personal responsibility for accomplishment of the tasks assigned to Academy and implementation of the functions by it.

24. The chief of Academy acts on the principles of one-man management and independently resolves issues of activities of Academy according to its competence determined by the legislation of the Republic of Kazakhstan and this Charter.

25. The chief of Academy in the procedure established by the legislation:

1) directs activities of Academy, determines obligations and circle of powers of the deputies, assistants and other leading employees of Academy;

2) within the competence issues orders and instructs, Academies, obligatory for all employees, control of their execution will organize;

3) approves the regulations on structural divisions of Academy obligatory for execution of regulations in Academies, job descriptions of the deputies and assistants, other acts;

4) is approved by procedure for the organization of work of the Academic Council of Academy, the procedure for the organization of other bodies of joint management of Academy directs its activities, and also;

5) without power of attorney acts on behalf of Academy, represents its interests in state bodies, other organizations according to the legislation of the Republic of Kazakhstan, this Charter;

6) signs on behalf of Academy agreements, agreements and contracts according to the legislation of the Republic of Kazakhstan;

7) issues powers of attorney to employees and employees of Academy on implementation of necessary separate competences, has rights of the first signature of financial records;

8) approves procedure and plans of Academy for business trips, training, training of employees in the Kazakhstan and foreign training centers and to other types of advanced training of employees;

9) opens control accounts of nalichnost and the account in banks according to the legislation of the Republic of Kazakhstan;

10) appoints to position, employs, moves on service, transfers to other work, relieves of the post and dismisses from service (work) of employees and workers in accordance with the established procedure and within the competence;

11) makes offers on position assignment or dismissal of the deputies, other heads of structural divisions of Academy on the nomenclature of the Ministry of Internal Affairs of the Republic of Kazakhstan;

12) makes to the Minister suggestions for improvement of educational, research and financial and economic activities and to material logistics strengthening;

13) gives the first and next special ranks of the ordinary and younger commanding structure, and also the next special ranks of the average commanding structure to the police captain inclusive, and also appropriates (confirms) to employees qualification ranks;

14) applies measures of encouragement and imposes authority punishments on employees, workers and students of Academy within the competence;

15) provides to employees (workers) safe working conditions in the procedure established by the legislation of the Republic of Kazakhstan;

16) will be organized by interaction of Academy with structural divisions of the Ministry of Internal Affairs, public authorities of the Republic of Kazakhstan, organizations and the organizations;

17) provides the organization of works on safety of the state, official secret and the mode of privacy in Academy, to holding necessary mobilization actions, civil defense;

18) will organize work on anti-corruption among staff and bears the personal responsibility for it;

19) performs other functions assigned to it by the legislation of the Republic of Kazakhstan, regulatory legal acts of the Ministry of Internal Affairs of the Republic of Kazakhstan;

21) exercises control of effective use and safety of the property transferred to it by the state and property acquired during activities of Academy;

26. Management of separate activities of Academy is performed by deputies (assistants) the chief of Academy who are appointed to position and are dismissed in accordance with the established procedure and bear responsibility for efficiency and quality of the organization of work on the supervised activities.

27. In absence period of the chief of Academy of its right and obligation the deputy appointed in accordance with the established procedure performs.

28. The supreme collegiate organ of management of Academy is the Academic council created by the order of the chief of Academy. The structure and procedure for the organization of activities of the Academic council are determined by the legislation of the Republic of Kazakhstan, orders of the Minister and chief of Academy.

29. Are within the competence of the Academic council:

1) determination of the concept of development of Academy, consideration of topical issues of teaching and educational, research, publishing activities of Academy;

2) discussion of offers on modification and amendments in the Charter of Academy;

3) development of offers on structure of Academy, to creation, reorganization and liquidation of educational and scientific divisions;
