I ORDER:
1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of April 14, 2023 No. 147 "About approval of Regulations of personal acceptance of physical persons and representatives of legal entities by officials of the Department of Energy of the Republic of Kazakhstan" the following change:
To be reworded as follows regulations of personal acceptance of physical persons and representatives of legal entities by officials of the Department of Energy of the Republic of Kazakhstan according to appendix to this order.
2. To department of administrative work of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation:
1) to bring this order to the attention of structural divisions, departments, territorial authorities and the subordinated organizations of the Department of Energy of the Republic of Kazakhstan;
2) within five calendar days from the date of adoption of this order to send it to the copy in electronic form in the Kazakh and Russian languages to the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) to place this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication.
3. To impose control of execution of this order on the Chief of staff of the Department of Energy of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These Regulations of personal acceptance of physical persons and representatives of legal entities by officials of the Department of Energy of the Republic of Kazakhstan (further – Regulations) regulate procedure for personal acceptance of physical persons and representatives of legal entities by officials of the Department of Energy of the Republic of Kazakhstan (further – the Ministry).
2. Personal acceptance of physical persons and representatives of legal entities is performed in the centers of reception of citizens by the following officials:
1) Minister and vice-ministers;
2) chief of staff.
3. In the centers of reception of citizens acceptance physical and representatives of legal entities on the questions entering competence of the Ministry, according to the procedure, the established regulations of the Ministry is performed.
4. Making an appointment is kept by the employees responsible for the organization of acceptance in the center of reception of citizens, daily in the working days in working hours with lunch break, based on the electronic document from the "elektronnoye pravitelstvo" web portal or the information analytical system "Electronic Addresses", addresses in paper format including arriving purposely or in the oral form stated to this employee of the center of reception of citizens.
5. The address with request for personal acceptance in which the question essence is not stated is left without consideration with the message on it to the applicant.
6. The refusal in acceptance of the address is not allowed.
If the address with request for personal acceptance does not conform to requirements, stipulated in Clause 63 Administrative procedural Procedure Codes of the Republic of Kazakhstan (further – the Code), about it, the employee of the structural division which is directly considering this address specifies to the applicant and reasonable time – for its reduction in compliance with requirements of the Code is established 2 working days.
The address with request for personal acceptance which is at the scheduled time not brought into accord with requirements of the Code is subject to return.
7. Acceptance in the centers of reception of citizens by persons specified in Item 2 of these Regulations is carried out at least once a month according to the schedule approved by the Chief of staff of the Government of the Republic of Kazakhstan in form according to appendix to Regulations.
The minister carries out personal reception of citizens also within holding meetings with the population according to the Presidential decree of the Republic of Kazakhstan of April 7, 2022 No. 863 "About holding meetings of heads of the central executive bodies with the population" where he responsible for the organization and preparation of the protocol, and also control of execution of the instructions given on acceptance performs Strategic development department of the Ministry.
8. Schedules of acceptance with indication of surname, name and middle name (in case of its availability) the official, days of acceptance are hung out in premises of the Ministry in the state and Russian languages, in places, available to general review, and also posted on the official site of the Ministry.
9. Acceptance of foreigners and stateless persons is carried out according to requirements for providing the mode of privacy in the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan governing the relations in the field of protection of the state secrets.
10. Making an appointment is not performed:
1) on the questions which are not entering competence of the Ministry;
2) when there is administrative determination, the official on administrative case concerning the participant of ministerial procedure about the same subject and of the same bases which are specified in the address;
3) when there is court resolution which took legal effect taken out concerning the same person about the same subject and of the same bases;
4) if the administrative authority, the official returns the address;
5) if the administrative authority, the official accepts withdrawal of the address from the applicant.
11. In cases of impossibility of carrying out acceptance because of temporary disability, official journey and to other reasons the accepting person notifies the employee responsible for reception of citizens in the center of reception of citizens not later than 2 (two) working days or in day of carrying out personal acceptance.
12. In day of acceptance in the centers of reception of citizens the legal consultants, psychologists and social workers (is possible involvement of volunteers only for days of acceptance) helping to issue (in case of need) additional applications and other related documents can be attracted.
13. When carrying out acceptance the responsibles of the Ministry who are directly considering the address of the applicant provides participation of representatives of other interested bodies if the brought-up question concerns their competence.
14. The responsible of structural division of the Ministry who is directly considering the address of the applicant after sending request for participation in acceptance of representatives of other interested bodies, informs the applicant within 2 (two) working days on sending an inquiry and if necessary prolongation of consideration of the address about making an appointment.
15. Information on the refusal facts in participation of other interested bodies in joint acceptance within 2 (two) working days after receipt of refusal goes to Government office of the Republic of Kazakhstan.
16. Acceptance is performed in the state and Russian languages at the request of the applicant.
17. Results of acceptance are recorded by the employee responsible for reception of citizens in the center of reception of citizens with reflection of the decision made during acceptance according to the address or orders, with indication of specific terms of their execution.
18. The information directorate and communications lights reception of citizens in mass media with observance of requirements about personal data protection and the data constituting the state secrets or other secret protected by the law.
19. All arrived addresses about making an appointment are registered the employee responsible for the organization of acceptance in the centers of reception of citizens in the information analytical system "Electronic Addresses" in day of their receipt.
20. The employee responsible for the organization of acceptance in the centers of reception of citizens, with participation of the responsible structural divisions of the Ministry which are directly considering the address of the applicant, the centers of reception of citizens in 5 (five) working days prior to acceptance after collection and the analysis of materials prepares reference information addressed to the Minister with the offer on setting a date of acceptance or refusal.
21. The employee responsible for the organization of acceptance in the centers of reception of citizens distributes lists in the approved schedule of acceptance according to the procedure of priority.
22. In time no later than 15 (fifteen) working days from the moment of registration of the address the responsible of structural division of the Ministry who is directly considering the address of the applicant and the employee responsible for the organization of acceptance in the centers of reception of citizens sends the answer to the applicant with indication of date and time of acceptance.
23. In case of the difficult question design requiring bigger study, the responsible of structural division of the Ministry who is directly considering the address sends the applicant the letter on prolongation of term of consideration of the address no more than for 30 (thirty) calendar days from the moment of registration of the address.
The term of consideration of the address can be extended by the motivated decision of the Minister, vice-ministers and the Chief of staff for reasonable time, but no more than up to two months in view of need of establishment of the actual circumstances important for the correct consideration of the address on what the applicant is informed within 3 (three) working days from the date of prolongation of term.
24. Requirements of the employee responsible for the organization of acceptance in the centers of reception of citizens about provision of the materials necessary for the organization of acceptance by the Minister, vice-ministers and the Chief of staff, the analysis and generalization of practice of carrying out acceptance, are obligatory for execution of the Ministry by structural divisions.
25. Before decision making about refusal in acceptance, not later than 3 (three) working days the responsible of structural division of the Ministry who is directly considering the address sends to the applicant the draft of the provisional solution about refusal for holding procedure of hearing.
In case of refusal in acceptance the procedure of hearing can be performed by the methods provided by part one of article 73 of the Code.
26. The organization and procedure for holding procedure of hearing are performed taking into account requirements of Articles 66, 73 and 74 Codes.
27. Control of the legal orders prepared following the results of acceptances is performed by the employee responsible for reception of citizens in the center of reception of citizens.
28. The basis for removal from control of the address which arrived from acceptance is the final motivated answer to the applicant.
29. The addresses submitted the applicant when carrying out acceptance are registered in the information analytical system "Electronic Addresses" with putting down of the mark "from personal acceptance".
30. It is not allowed to charge consideration of the address from acceptance to the worker to whom it was entrusted earlier.
31. The employee responsible for the organization of acceptance in the centers of reception of citizens, on regular basis shall perform monitoring of level of satisfaction of applicants, conduct by means of telephone communication selective survey of the applicants who got advice and refused record on personal acceptance.
32. The employee responsible for the organization of acceptance in the centers of reception of citizens on regular basis (at least once a quarter) informs Government office of the Republic of Kazakhstan on results of work on reception of citizens.
