According to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of August 24, 2016 No. 275 "About measures for transition to the international classification system of types of economic activity" the State committee according to the statistics and the Ministry of Labour of the Republic of Uzbekistan POSTANOVLYAYUT:

1. Approve Regulations on procedure for determination of annual average number of workers of subjects of entrepreneurship, according to appendix.

2. This resolution becomes effective after three months from the date of its official publication.

Regulations on procedure for determination of annual average number of workers of subjects of entrepreneurship

Chapter 1. General provisions

1. Type definition of subjects of entrepreneurship is performed by determination of main type of their activities (the greatest in annual volume of turnover) and the annual average number of workers of the subject of entrepreneurship and their comparison to the criteria established in Classification of the organizations relating to small business entities, the Republic of Uzbekistan approved by the resolution of the Cabinet of Ministers of August 24, 2016 No. 275.

2. The annual average number of workers of subjects of entrepreneurship joins all workers with whom the subject of entrepreneurship signs employment contracts (contracts), and also the workers working under agreements of civil nature (except for the individual entrepreneurs performing works, rendering services in agreements of civil nature).

3. In case of determination of annual average number of workers of the subject of entrepreneurship the number of the workers working in the unitary enterprises, representations and branches (is also considered in case of their availability).

4. The annual average number of workers of the subject of entrepreneurship is determined by separate calculation and summing:

a) the annual average number of the workers having service records;

b) annual average number of external part-time employees;

c) the annual average number of the workers working under agreements of civil nature.

5. The number of workers for output or festive (non-working) days is accepted the equal number of workers to the working day preceding these days.

6. In case of calculation of annual average number of workers of the subject of entrepreneurship, the received value of annual average number should be rounded to the whole units towards increase.

Chapter 2. Determination of annual average number of the workers having service records at the subject of entrepreneurship

7. The annual average number of the workers having service records at the subject of entrepreneurship is determined by summing of average monthly number of these workers for all months of accounting year and division of the received amount on 12 by the following formula:

W = (Wm1 + Wm2 + … + Wm 12)/12,

where:

W - the annual average number of the workers having service records;

Wm 1, Wm 2,... - the average monthly number of the workers having service records for January, February and subsequent month of year respectively.

8. For the subjects of entrepreneurship working incomplete year (for example, created within year, having seasonal nature of work, etc.), the annual average number of the workers having service records is determined by summing of average monthly number of these workers for all months of implementation of activities of the subject of entrepreneurship and division of the received amount on 12.

9. The average monthly number of the workers having service records is estimated by summing of number of these workers for each calendar day of month under report, i.e. from the 1st on the 30th or the 31st (for February - on the 28th or the 29th), including output and festive (non-working) days, and divisions of the received amount on number of calendar days of month under report, on the following formula:

Wm = (Wd1 + Wd2 + … + Wdn) / n,

where:

Wm - the average monthly number of the workers having service records;

Wd 1, Wd 2,... - the number of the workers having service records for the first, second and subsequent dates respectively;

10. Chapter 3. Determination of annual average number of the external part-time employees and workers working under agreements of civil nature

11. The annual average number of external part-time employees is estimated by summing of average monthly number of these workers for all months of accounting year and division of the received amount on 12 on the following formula:

EW = (EWm1 + EWm2 + … + EWm 12)/12,

where:

EW - the annual average number of external part-time employees;

EWm 1, EWm 2,... - the average monthly number of external part-time employees for January, February and the next months of year respectively.

12. The average monthly number of external part-time employees is estimated in proportion to duration of the working hours specified in the employment contract on formula:

EWm = (EWt1 + EWt2 + … + EWti) / tn,

where:

EWm - the average monthly number of external part-time employees;
