About modification and amendments in orders of the chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of September 20, 2016 No. 1 "About approval of Rules, programs and the organization of testing of the citizens arriving on law-enforcement service" and of February 21, 2017 No. 40 "About some questions of occupation of managerial state position"

I ORDER:

1. Bring in the order of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of September 20, 2016 No. 1 "About approval of Rules, programs and the organization of testing of the citizens for the first time arriving on law-enforcement service" (it is registered in the Register of state registration of regulatory legal acts for No. 14317) the following changes:

in Rules, programs and the organization of testing of the citizens for the first time arriving on law-enforcement service approved by the above-named order:

"2. Testing is held in the presence of the operator of testing who is the worker of the legal entity with whom according to the legislation of the Republic of Kazakhstan on public procurements the service provision agreement on technical supply of test procedures of administrative government employees, candidates for occupation of the managerial state positions and citizens arriving on law-enforcement service is signed (further – the operator).";

"3. Technical supply of test procedures, forming of the database of test tasks and their updating is performed by the legal entity with whom according to the legislation of the Republic of Kazakhstan on public procurements the service provision agreement on technical supply of test procedures of administrative government employees, candidates for occupation of the managerial state positions and citizens arriving on law-enforcement service is signed (further – the service provider).";

"4. The service provider holds testing of candidates in process of the address of citizens.";

"13. Time of conducting testing is determined by the service provider.";

"32-3. Test tasks, and also video and audio recordings of process of testing of the candidate are provided in the appeal commission by the service provider at the request of authorized body for public service (further – authorized body).

"33. The decision of the appeal commission is made by a majority vote from total number of members of the commission. In case of equality of votes, the voice of the chairman is decisive. The second copy of the minutes of the appeal commission is transferred to the service provider and stored within one year.

The decision of the appeal commission is competent in the presence of 2/3 (two thirds) members from total number.

The appeal commission consists at least of five members, including the chairman.";

2. Bring in the order of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of February 21, 2017 No. 40 "About some questions of occupation of managerial state position" (it is registered in the Register of state registration of regulatory legal acts for No. 14939) the following changes and amendments:

"3-1) Provisional Rules of selection and carrying out tender on occupation of managerial state position of the case "B" in the integrated information system, according to appendix 2-3 to this order.";

add with appendices 2-2, 2-3 according to appendices 4, 5 to this order.

3. To provide to department of selection on public service of the Agency of the Republic of Kazakhstan for public service in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan for public service.

4. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service supervising questions of public service.

5. This order becomes effective from the date of its first official publication and extends to the legal relationship which arose since January 1, 2024.
