1. Approve the enclosed Rules and requirements of entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state, and their operation in the territory of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules and requirements of entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state, and their operation in the territory of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules and requirements of entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state, and their operation in the territory of the Republic of Kazakhstan (further - Rules and requirements) are developed according to Item 2 of article 9-1 of the Law of the Republic of Kazakhstan "About road transport" and determine procedure and requirements of entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state, and their operation in the territory of the Republic of Kazakhstan.

2. In these rules and requirements the following concepts are used:

1) system of electronic passports of vehicles (passports of the chassis of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further - system of electronic passports) - the structured complex which is turning on the computing and communication equipment, the software, linguistic means, information resources, system personnel and interacting by the rules of participants and users established in this system, and also realizing information technology of accomplishment of the established functions of this system;

2) the vehicle - unit of railway vehicles of the road transport including buses, minibuses, automobile and cargo vehicles, trolleybuses, automobile trailers, semitrailer trucks to truck tractors and also the specialized cars (intended for transportation of certain types of loads) and the special equipment vehicles (intended for accomplishment of different mainly not transport works);

3) the certificate on state registration of the vehicle - the document confirming the admission of the vehicle to participation in traffic of system;

4) the state registration registration plate of the vehicle - the product which is property of the state and containing the individual alphanumeric designation appropriated to the motorized vehicle and made according to requirements of the national standard. This concept extends to registration plates "Transit";

5) the vehicle which is in international movement on the territory of the Republic of Kazakhstan - the vehicle operated by the foreigner or the stateless person which do not have the residence permit in the Republic of Kazakhstan, and at the same time corresponding to the following conditions:

belongs to the physical person or legal entity having the permanent residence or the location out of the Republic of Kazakhstan;

it is not registered in the Republic of Kazakhstan;

it is temporarily imported into the Republic of Kazakhstan;

6) Frontier of the Republic of Kazakhstan (further - Frontier) - the line and the vertical plane passing on it, the determining limits of the territory of the Republic of Kazakhstan (sushi, waters, subsoil, airspace) and space limit of action of the state sovereignty of the Republic of Kazakhstan;

7) obligatory technical inspection - periodic process of diagnosing of technical condition of vehicles and trail cars to them on compliance to the requirements established by the legislation of the Republic of Kazakhstan;

8) the check point through Frontier (further - the check point) - the territory (water area) within the railway, automobile station or the station, sea or river port, the international airport or airfield, and also other site of the area which is specially allocated in close proximity to Frontier with the corresponding infrastructure on which the omission of persons, vehicles, loads and goods is performed.

Chapter 2. Procedure and requirements of entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state

3. Entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state is performed through check points according to the Law of the Republic of Kazakhstan "About Frontier of the Republic of Kazakhstan" and in the presence:

1) certificates on state registration of the vehicle;

2) service provision agreements about transportation of the vehicle on the territory of the Republic of Kazakhstan containing the information about the owner of the vehicle, identification signs of the vehicle, data on delivery location and conditions of acceptance of such vehicle (in case of import of vehicles with use of services in transportation of vehicles);

3) data from system of electronic passports of vehicles (passports of the chassis of vehicles) and electronic passports of self-propelled machines and other types of the equipment about identification signs of the vehicles registered in state members of the Eurasian Economic Union, and their registration accounting.

Requirements of the subitem 3) of this Item are not applied before completion of processes of integration of systems of electronic passports of vehicles (passports of the chassis of vehicles) and electronic passports of self-propelled machines and other types of the equipment of state members of the Eurasian Economic Union.

4. Verification of the documents provided in Item 3 of these rules and requirements is performed at check points by bodies of state revenues of the Republic of Kazakhstan and the Border service of Committee of homeland security of the Republic of Kazakhstan (further - the Border service).

5. Persons intending to perform entrance (import) to the territory of the Republic of Kazakhstan of the vehicles registered in competent authority of other state when crossing Frontier upon the demand of representatives of bodies of state revenues of the Republic of Kazakhstan and the Border service provide the documents provided in Item 3 of these rules and requirements.
