About measures for enhancement of payment system by legal entities of expenses on advertizing on foreign social networks by means of corporate bank cards in foreign currency

For the purpose of ensuring execution of the resolution of the President of the Republic of Uzbekistan of August 22, 2022 No. PP-357 "About measures for raising on the new level of the sphere of information and communication technologies in 2022-2023", and also enhancement of payment system by legal entities of expenses on advertizing on foreign social networks by means of corporate bank cards in foreign currency and reflections of these expenses in tax and other statements the DECIDES: Cabinet of Ministers

1. Take into consideration that Item 11 of "Road map" on further enhancement of the sphere of information and communication technologies in 2022-2023 approved by the resolution of the President of the Republic of Uzbekistan of August 22, 2022 No. PP-357, provides enhancement of payment system by legal entities of expenses on advertizing on foreign social networks by means of corporate international currency cards and reflection of these expenses in tax and other statements.

2. Agree with offers of the Ministry of digital technologies, the Ministry of Economics and finance, the Ministries of investments, the industry and trade and the Central bank of the Republic of Uzbekistan about permission since July 1, 2023 to legal entities to make payments on expenses on advertizing on foreign social networks and Internet resources by means of corporate bank cards in foreign currency in the amount of, not exceeding 5 000 (five thousand) US dollars for calendar month, and entering of data on such payments into the Single electronic information system of the foreign trade transactions (further - EEISVO).

3. To the ministry of investments, industry and trade and the Ministry of digital technologies of the Republic of Uzbekistan together with the interested ministries and departments till July 1, 2023 to make corresponding changes to EEISVO, proceeding from requirements of this resolution.

At the same time to provide possibility of entering into EEISVO through the Single portal of interactive state services of the Republic of Uzbekistan of expense data of legal entities on advertizing on foreign social networks and Internet resources.

4. Make changes and additions to the Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 14, 2020 No. 283, according to appendix.

5. To the ministry of digital technologies, the Ministry of investments, industry and trade of the Republic of Uzbekistan together with the interested ministries and departments in two-month time to bring the regulatory legal acts adopted by them into accord with this resolution.

6. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan Hodzhayev Zh. A. and minister of digital technologies of the Republic of Uzbekistan Shermatov Sh. H.

Changes and additions made to the Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 14, 2020 No. 283

1. In Item 2:

a) third after the words "contract of realization" to add the paragraph with the words "agreement on advertizing";

b) the tenth to state the paragraph in the following edition:

"business entities are the residents of the Republic of Uzbekistan which signed contracts (invoices) and/or agreements specified in this Item of the Provision";

c) add with the paragraph of the following content:

"the agreement on advertizing - the agreement signed on the basis of the public offer without the conclusion of the contract within the foreign trade transactions for advertizing on foreign social networks and Internet resources with implementation of payments by means of corporate bank cards in foreign currency".

2. Add Item 16 with paragraphs of the following content:

"Within the foreign trade transactions business entities can perform fee on advertizing on foreign social networks and Internet resources by means of corporate bank cards in foreign currency in the amount of, not exceeding 5 000 (five thousand) US dollars for calendar month. At the same time data on payments are entered in EEISVO.

When entering data into EEISVO data on the name of foreign social network, Internet resource and the state in which they are registered the name of the foreign organization rendering promotion services, date and payment amount, number, date and document amount, confirming rendering services shall be specified.

At the same time in case of non-presentation of documents by the foreign organization for the rendered services, the last date is considered date of rendering service".

3. To add Item 17 paragraph two after the word "goods" with words "(works, services)".

4. To state Item 3 of appendix No. 1 (Procedure for assignment of identification numbers to contracts in foreign trade and invoices) in the following edition:
