About remote identification of users of services of telecommunication and activation of services of telecommunication

Based on part one of Item 11 of Rules of rendering the services of telecommunication approved by the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055, of subitem 6.1 of Item 6 of the Regulations on the Ministry of Communications and Informatization of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of March 17, 2004 No. 302, the Ministry of Communications and Informatization of the Republic of Belarus DECIDES:

1. Determine that:

1.1. in case of the conclusion of the service provision agreement of telecommunication without personal presence of other party by the operator of telecommunication, the service provider of telecommunication carries out remote identification of such party - the physical person which reached age of 18 years and having the identity document provided by part one of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of June 3, 2008 No. 294 "About documentation of the population of the Republic of Belarus" (further - the user);

1.2. for carrying out remote user identification by the operator of telecommunication, the service provider of telecommunication it is provided:

production photo and (or) the video record with legible display of face of the user and the document proving his identity which allows to differentiate: for the identity documents made in book format - the color image of the owner, the specimen signature, data on the owner; for biometric identity documents (further - the biometric document), - data of personalisation;

provision by the user to the operator of telecommunication, the service provider of telecommunication of text information on details of the identity document made in book format (identification number, document type, series (in the presence) and number, date of issue, the name of the issued body), and the video record with browsing of pages of such document;

data read-out from integral chip of the biometric document of the user (the facsimile (digital photograph) of the owner, identification number, document type, document number, number, month, year of issue of the document, code of the state body which issued the document);

use within the procedure of remote user identification of the software and hardware and technologies allowing to prevent wrongful acts, including to find application of means of simulation of appearance of the user;

comparison of the biometric model created based on face of the user with the biometric model created based on the color image of the user containing in the identity document made in format of the book, or created based on the facsimile (digital photograph) of the user received from integral chip of the biometric document, determination of degree of their similarity taking into account telecommunication established by the operator, the service provider of telecommunication of threshold degree of similarity of biometric models;

check of validity of the identity document of the user, by means of receipt of electronic services of nation-wide automated information system. At the same time confirmation of information about the subscriber according to subitem 3.5 of Item 3 of the Presidential decree of the Republic of Belarus of March 15, 2016 No. 98 "About enhancement of transmission order of messages of telecommunication" is allowed;

1.3. when carrying out remote identification:

collection and other processing of data shall be performed by the operator of telecommunication, the service provider of telecommunication with observance of requirements of the legislation on information, informatization and information protection, including legislations on personal data;

collected by the operator of telecommunication, the service provider of telecommunication of the data shall contain mark about their obtaining in the course of remote identification;

1.4. the operator of telecommunication, the service provider of telecommunication provide storage of the data collected when carrying out remote identification (including photo and video content, data on the identity document, the IP address of the device by means of which identification was carried out), within at least 6 months if other is not established by the legislation;

1.5. by results of making of the actions provided by subitem 1.2 of this Item, remote user identification proves to be true (is not confirmed) by the authorized employee (representative) of operator of telecommunication, the service provider of telecommunication;

1.6. activation of services of telecommunication is performed by the operator of telecommunication, the service provider of telecommunication only in case of confirmation of remote user identification and the conclusion of the service provision agreement of telecommunication with it. At the same time activation of service of the international roaming is performed by the operator of telecommunication, the service provider of telecommunication only in case of personal presence of the subscriber;

1.7. the operator of telecommunication, the service provider of telecommunication determines procedure for holding procedure of remote identification of users taking into account this resolution.

2. This resolution becomes effective after its official publication.
