1. Bring in the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of April 6, 2020 No. 187 "About approval of Rules of rendering the state service "Registration of Declarations of Industrial Safety of Hazardous Production Facility" (it is registered in the Register of state registration of regulatory legal acts for No. 20338), the following changes:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them; 2) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to requirements, the established Law of the Republic of Kazakhstan "About civil protection", the approved order of the Minister of investments and development of the Republic of Kazakhstan of December 30, 2014 No. 341 "About approval of the Rules determining criteria of reference of hazardous production facilities to declared, and Rules of development of the declaration of industrial safety of hazardous production facility" (it is registered in the Register of state registration No. regulatory legal acts 10257) and the order of the Minister of Emergency Situations of the Republic of Kazakhstan of May 26, 2021 No. 240 "About approval of criteria of reference of hazardous production facilities to declared" (it is registered in the Register of state registration No. regulatory legal acts 22883); 3) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of this state service which took legal effect.

Bring in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of April 16, 2020 No. 208 "About approval of Rules of rendering the state service "Issue of Permissions to Use of the Technologies, Technical Devices, Materials Applied on Hazardous Production Facilities, Dangerous Technical Devices" (it is registered in the Register of state registration of regulatory legal acts for No. 20435), the following changes:

Permission to use of the technologies used on hazardous production facilities, dangerous technical devices or the motivated answer about refusal in rendering the state service in form according to appendix 4 to Rules of rendering the state service "Issue of Permissions to Use of the Technologies Applied on Hazardous Production Facilities, Dangerous Technical Devices" (further – Rules). The result of rendering the state service goes and kept in "personal account" of the uslugopoluchatel certified by the electronic and digital signature (further – the EDS) the head of the service provider or replacement his face.

3. To provide to committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan to provide to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan data on execution of action, according to subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

to the Standard of the state service "Issue of Permissions to Use of the Technologies Applied on Hazardous Production Facilities, Dangerous Technical Devices"

Contents of expert opinions on compliance of the technologies applied on hazardous production facilities, dangerous technical devices

1. The expert opinion on compliance of technologies, dangerous technical devices, to requirements of industrial safety shall contain:

1) name of the expert opinion;

2) the prolog including the basis for conducting examination, data on the expert organization, the information about the specialists who were carrying out expertize of industrial safety, the copy of the protocol of examination of specialists in questions of industrial safety, certificate availability on the right of expertize of industrial safety;

3) the list of objects of examination to which action of the expert opinion extends;

4) data on the organization;

5) examination purpose;

6) depending on object of examination of the data on the documents considered in the course of examination (project, design, operational, repair), the technologies used on hazardous production facilities, dangerous technical devices with indication of year of release, the manufacturer and the country of the manufacturer, brand, model, type, serial (identification) number or the other information necessary for identification;

7) data on the used oborudovaniye in case of expertize of industrial safety;

8) short characteristic and purpose of object of examination;

9) results of the carried-out expertize;

10) final part with valid conclusions, recommendations about technical solutions and actions;

11) the appendices containing list of the regulating legal, technical and methodical documentation used in case of examination, acts of the carried-out testing;

12) data on probability of impact of harmful and dangerous production factors on production personnel, the population, the environment, extent of their striking impact in use, in case of accidents, incidents;

13) data on compliance of the data obtained as a result of examination to the regulations operating in the Republic of Kazakhstan.

2. The expert opinion on compliance of technologies to requirements of industrial safety in addition shall contain:

1) data on the harmful dangerous production factors arising when implementing engineering procedure on this technology, their extreme values;

2) data on limiting compliance of values of harmful and dangerous production factors to the normative values operating in the Republic of Kazakhstan;

3) data on the technical measures providing bringing values of harmful and dangerous production factors to admissible parameters, level of their reliability.

3. The expert opinion on compliance of dangerous technical devices to requirements of industrial safety in addition shall contain:

1) data on extreme parameters of all harmful and dangerous factors arising during the operation of the dangerous technical device;

2) data on the constructive decisions providing bringing values of harmful and dangerous production factors to admissible parameters, level of their reliability.

4. The expert opinion is effective within one year from the date of expertize of industrial safety.

The expert opinion is signed by the head of the expert organization, certified by seal of the expert organization, stitched with indication of the number of the sewed pages.
