About modification of the solution of NKRSI of 05.04.2016 No. 180 "About approval of the Procedure for provision by operators, providers of telecommunications of the reporting and information and recognition by NKRS which voided decisions of 04.11.2008 No. 1189 and of 25.12.2008 No. 1283"

1. Bring in Item 1 of the decision of the National commission performing state regulation in the field of communication and informatization, of April 5, 2016 No. 180 "About approval of the Procedure for provision by operators, providers of telecommunications of the reporting and information and recognition by NKRS which voided solutions of 04.11.2008 No. 1189 and of 25.12.2008 No. 1283", the change registered in the Ministry of Justice of Ukraine on May 18, 2016 for No. 739/28869,, way of his statement in the following edition:

"1. Approve enclosed:

Procedure for provision by operators, providers of telecommunications of the reporting and information;

reporting No. 1-T form "Sphere of telecommunications" and Instruction for its filling.".

2. Approve Changes in the Procedure for provision by operators, providers of telecommunications of the reporting and information approved by the decision of the National commission performing state regulation in the field of communication and informatization, of April 5, 2016 No. 180, registered in the Ministry of Justice of Ukraine on May 18, 2016 for No. 739/28869, which are applied.

3. Approve reporting No. 1-T form "The sphere of telecommunications" and the Instruction for its filling which are applied.

4. In accordance with the established procedure to provide to department of the economic analysis this decision on state registration to the Ministry of Justice of Ukraine.

5. This decision becomes effective from the date of its official publication.

Changes in the Procedure for provision by operators, providers of telecommunications of the reporting and information

1. In the Section I:

Item 2 to state 1) in the following edition:

"2. This Procedure establishes the procedure of provision of NKRSI by operators, providers of telecommunications of the reporting and information including containing financial and economic indicators of their activities necessary for accomplishment of NKRSI of the powers, in particular, for determination of certain markets of telecommunication services and carrying out their analysis, monitoring of rates (for services, rates for which are regulated by NKRSI), preparation of analytical materials on condition and development of industry of communication, consideration of addresses of consumers, the analysis of results of the state supervision, etc. in amounts, forms and the terms determined by this Procedure.";

Item 5 to state 2) in the following edition:

"5. All operators, providers of telecommunications having the right to implementation of activities in the field of telecommunications according to article 42 of the Law of Ukraine "About telecommunications" gratuitously submit to NKRSI quarter, semi-annual and annual accounts in state language in amounts, forms and the terms determined by this Procedure (the reporting moves only according to the performed type of activity).

If operators, providers of telecommunications, data on which contain in the register of operators, providers of telecommunications, actually do not perform activities in the field of telecommunications according to the type(s) of telecommunication services specified in such register, they shall report NKRSI about it the letter electronically on the NKRSI official website in the Section "Reporting of Operators, Providers of Telecommunications" by means of the corresponding software with imposing of the qualified digital signature according to requirements of the legislation in the field of electronic confidential services in time established for submission of the reporting.";

Item 6 to state 3) in the following edition:

"6. The request is provided in writing signed by the Chairman of NKRSI or person authorized by it and contains exhausting (except requests according to addresses of consumers of services and citizens which are not consumers of services) requirements concerning amounts and terms of provision of information. The request does not may contain the requirement of provision of information provided to filling in the quarter, semi-annual and annual accounts provided according to Item 5 of this Procedure.
