About introduction of amendments to some acts of the Government of the Russian Federation regarding determination of features of legal regulation of the relations on functioning of objects of microgeneration

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation regarding determination of features of legal regulation of the relations on functioning of objects of microgeneration.

2. Determine that forms of purchase and sale agreements of the electrical energy made on the objects of microgeneration provided by the paragraph the fourth the subitem 8 of Item of 7 changes approved by this resolution are placed the guaranteeing suppliers in the centers of internal consumer service (buyers) and on the official sites on the Internet within a month from the date of entry into force of this resolution.

Changes which are made to acts of the Government of the Russian Federation regarding determination of features of legal regulation of the relations on functioning of objects of microgeneration

1. In Item 52 of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy approved by the order of the Government of the Russian Federation of January 21, 2004 No. 24 "About approval of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy" (The Russian Federation Code, 2004, No. 4, Art. 282; 2019, No. 6, Art. 527):

Paragraph one of the subitem "a" to state 1) in the following edition:

"a) about purchasing amounts of electrical energy (capacity) in the retail market of the electric power, except for purchases of electrical energy by the guaranteeing supplier from owners and other legal owners of objects of microgeneration, with indication of:";

To add 2) with the subitem "v" of the following content:

"c) about amounts and weighted average price of purchase in the retail market of electrical energy (capacity) developed on objects of microgeneration.".

2. 1) Item 1 after words "facilities for production of electrical energy," to add with the words "including objects of microgeneration";

To add 2) with Item 2 (3) the following content:

"2(3). Technological accession of objects of microgeneration is performed to objects of electric grid economy with tension level to 1000 Century.

Technological accession of objects of microgeneration to power networks of the network organization is performed not earlier than technological connection of power receiving devices of the consumer of electrical energy which possesses on the property right or on other legal cause such objects of microgeneration, or along with technological connection of power receiving devices of the consumer of electrical energy.

Technological accession of objects of microgeneration with use of the utility power systems intended for servicing more than one room in the building, including which are part of common property of the apartment house is not allowed.";

Item 3 to add 3) with the paragraph of the following content:

"Irrespective of availability or lack of technical capability of technological accession for date of the address of the applicant the network organization shall sign the contract with persons specified in Items 13 (2) and 13(4) these rules, addressed to the network organization with the request for technological accession of the objects of microgeneration belonging to them on the property right or on other basis provided by the law and also to execute concerning objects of microgeneration of such persons of action for technological accession provided that the power receiving devices of the consumer of electrical energy belonging to the applicant are technologically attached to objects of electric grid economy of the network organization with tension level to 1000 V.";

4) in Item 7:

in the subitem "g" of the word "specified in Items 12 (1), 13 and 14" shall be replaced with words "specified in Items 12 (1), 13, 13(2) - 13(5) and 14";

in the subitem "d":

in paragraph one of the word "in Items 12 (1) and 14" shall be replaced with words "in Items 12 (1), 13(2) - 13(5) and 14", shall be replaced with words words of "(power receiving devices)" "(power receiving devices, objects of microgeneration)";

in the paragraph the second:

shall be replaced with words the words "in Items 12 (1) and 14" "in Items 12 (1), 13(2) - 13(5) and 14";

after the words "for consumption by power receiving devices" to add with the words "and for issue by objects of microgeneration";

in paragraph three:

after the words "and actual acceptance" to add with words "(issues by objects of microgeneration)";

shall be replaced with words words of "(power receiving devices)" "(power receiving devices, objects of microgeneration)";

5) in Item 7 (the words "in Items 12 (1) and 14" shall be replaced with words 1) "in Items 12 (1), 13(2) - 13(5) and 14";

To add 6) with Item 8 (6) the following content:

"8(6). In case of technological accession of objects of microgeneration the application for technological accession is submitted to the network organization to which objects of electric grid economy the power receiving devices of the consumer of electrical energy belonging to the applicant are technologically attached. In case of simultaneous technological accession of objects of microgeneration and power receiving devices of the consumer of electrical energy which possesses on the property right or on other legal cause such objects of microgeneration the application for technological accession is submitted to the network organization determined according to Item 8 of these rules taking into account features, stipulated in Item 8(5) these rules.";

To add 7) with Items 13 (2) - 13(7) following contents:

"13(2). In the request directed by the applicant - by the legal entity or the individual entrepreneur for the purpose of technological accession of objects of microgeneration to objects of electric grid economy with tension level to 1000 V, shall be specified:

a) the data provided by subitems "an" - "in" and "and" Item 9 of these rules;

b) the name of the guaranteeing supplier with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) developed on objects of microgeneration, in the retail market;

c) the name of the subject of the retail market with which the applicant signs the agreement providing sale of electrical energy (capacity) in the retail market (the agreement of power supply or purchase and sale (delivery) of electrical energy (capacity), concerning the power receiving devices of the applicant which are earlier attached in this point of accession, number and date of the specified agreement;

d) the maximum capacity of the power receiving devices of the applicant which are earlier attached in this point of accession;

e) required maximum capacity of the attached objects of microgeneration of the applicant, quantity, capacity of generators and their passport technical characteristics.

13(3). In the request directed by the applicant - by the legal entity or the individual entrepreneur for the purpose of simultaneous technological accession to objects of electric grid economy with tension level to 1000 V of power receiving devices which maximum capacity makes up to 150 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession) which electric utility service is provided on one source, and objects of microgeneration, shall be specified:

a) the data provided by subitems "an" - "in" and "and" - "l" of Item 9 of these rules;

b) the name of the guaranteeing supplier with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) developed on objects of microgeneration, in the retail market;

c) required maximum capacity of the power receiving devices of the applicant attached in this point of accession which electric utility service is provided on one source, not exceeding taking into account the maximum capacity of the power receiving devices of the applicant of 150 kW which are earlier attached in this point of accession;

d) nature (schedule) of loading (type of productive activity of business entity);

e) required maximum capacity of the attached objects of microgeneration of the applicant, quantity, capacity of generators and their passport technical characteristics.

13(4). In the request directed by the applicant - by physical person for the purpose of technological accession of object of microgeneration to objects of electric grid economy with tension level to 1000 V, shall be specified:

a) surname, name and applicant's middle name, series, number and date of issue of the passport or other identity document in accordance with the legislation of the Russian Federation;

b) residential address of the applicant;

c) the data provided by subitems "b", "i" and "l" of Item 9 of these rules;

d) the name of the guaranteeing supplier with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) developed on objects of microgeneration, in the retail market;

e) the maximum capacity of the power receiving devices of the applicant which are earlier attached in this point of accession which are used for the domestic and other needs which are not connected with implementation of business activity;

e) required maximum capacity of the attached objects of microgeneration of the applicant, quantity, capacity of generators and their passport technical characteristics.

13(5). In the request directed by the applicant - physical person for the purpose of simultaneous technological accession to objects of electric grid economy with tension level to 1000 V of power receiving devices which maximum capacity makes up to 150 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession) which are used for the domestic and other needs which are not connected with implementation of business activity and which electric utility service is provided on one source, and objects of microgeneration, shall be specified:

a) surname, name and applicant's middle name, series, number and date of issue of the passport or other identity document in accordance with the legislation of the Russian Federation;

b) residential address of the applicant;

c) the data provided by subitems "b", "i" and "l" of Item 9 of these rules;

d) the name of the guaranteeing supplier with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) developed on objects of microgeneration, in the retail market;

e) required maximum capacity of the power receiving devices of the applicant attached in this point of accession which electric utility service is provided on one source, not exceeding taking into account the maximum capacity of the power receiving devices of the applicant of 150 kW which are earlier attached in this point of accession;

e) required maximum capacity of the attached objects of microgeneration of the applicant, quantity, capacity of generators and their passport technical characteristics.

13(6). In the request directed by the applicant - by the legal entity or the individual entrepreneur for the purpose of simultaneous technological accession to objects of electric grid economy with tension level to 1000 V of power receiving devices which maximum capacity makes over 150 kW (taking into account the power receiving devices which are earlier attached in this point of accession) and objects of microgeneration, shall be specified:

a) the data provided by subitems "an" - "in" and "and" - "l" of Item 9 of these rules;

b) required maximum capacity of the attached power receiving devices of the applicant;

c) nature (schedule) of loading (type of activity of business entity);

d) the name of the guaranteeing supplier with which the applicant intends to sign the agreement providing sale of electrical energy (capacity) developed on objects of microgeneration, in the retail market;

e) required maximum capacity of the attached objects of microgeneration of the applicant, quantity, capacity of generators and their passport technical characteristics.

13(7). Applicants from among specified in Items 13 (3) and 13(5) these rules for the purpose of technological accession on the second or third category of reliability of power receiving devices which maximum capacity makes over 15 and to 150 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession), in case of desire to use interest-free payment by installments of payment for technological accession specify it in the request directed by them.";

8) in Item 15:

word in paragraph eleven "persons specified in Items 13 and 14 of these rules" shall be replaced with words "persons specified in Items 13, of 13(2) - 13(5) and 14 these rules";

in the paragraph the twenty second shall be replaced with words the words "the applicant within 10 working days" "the applicant (except for the applicants specified in Items 13 (2) and 13(4) these rules) within 10 working days";

9) in Item 16:

in the subitem "b":

the fourth after the words "for applicants" to add the paragraph with words "(including specified in Items 13 (3), 13(5) and 13 (6) these rules)";

in paragraph eight of the word "in Items 12 (1), 14 and 34" shall be replaced with words "in Items 12 (1), 13(3), 13(5), 14 and 34";

after the paragraph of the tenth to add with the paragraph of the following content:

"1 month (if in the request more long term) - for the applicants specified in Items 13 is not specified (2) and 13(4) these rules which power receiving devices are earlier attached in this point of accession to objects of electric grid economy of the network organization;";

in paragraph three of the subitem "v":

after the words "constitutes 550 rubles" to add with words "(1100 rubles - for the applicants specified in Items 13 (3) and 13(5) these rules)";

after the words "exceeds 550 rubles" to add with words "(1100 rubles - for the applicants specified in Items 13 (3) and 13(5) these rules)";

10) Item 16 in paragraph five (1):

shall be replaced with words the words "in Items 12 (1) and 14" "in Items 12 (1), 13(2) - 13(5) and 14";

add with words ", and also to the subject of the retail market specified in the subitem "b" of Items 13 (2) and 13(3), the subitem "g" of Items 13 (4) and 13(5) these rules";

11) Item 16 in paragraph one (the words "in Item 12 (1)" shall be replaced with words 2) "in Items 12 (1), 13(3) and 13 (5)";

12) in Item 16 (the words "in Items 12 (1) and 14" shall be replaced with words 3) "in Items 12 (1), 13(2) - 13(5) and 14";

Item 17 to state 13) in the following edition:

"17. The payment for technological connection of power receiving devices the maximum capacity which is not exceeding 15 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession), is established proceeding from the cost of actions for technological accession in the amount of no more than 550 rubles when joining the applicant owning the objects referred to the third category of reliability (on one source of electric utility service) provided that the distance from borders of the site of the applicant to objects of electric grid economy at the level of tension to 20 kV inclusive of class of tension of the network organization necessary for the applicant to which the application is submitted makes no more than 300 meters in the cities and settlements of city type and no more than 500 meters in the rural zone.

Concerning the applicants specified in Items 13 (2) and 13(4) these rules, payment for technological accession of objects of microgeneration are established proceeding from the cost of actions for technological accession in the amount of no more than 550 rubles.

Concerning the applicants specified in Items 13 (3) and 13(5) these rules owning the power receiving devices the maximum capacity which is not exceeding 15 kW inclusive (taking into account the power receiving devices which are earlier attached in this point of accession) referred to the third category of reliability (on one source of electric utility service), the amount of payment for technological accession is established proceeding from the amount of cost of actions for technological connection of power receiving devices and cost of actions for technological accession of objects of microgeneration and cannot exceed 1100 rubles provided that the distance from borders of the site of the applicant to objects of electric grid economy at the level of tension to 1000 V inclusive of class of tension of the network organization necessary for the applicant to which the application is submitted makes no more than 300 meters in the cities and settlements of city type and no more than 500 meters in the rural zone.

Concerning the applicants who addressed for the purpose of technological accession of facilities for production of electrical energy of nuclear power plants or hydroelectric power stations (including pumped storage power plants) to objects of electric grid economy, the corresponding criteria of reference to single national (all-Russian) power network, payment by installments of introduction of payment for technological accession for the period equal to 10 years estimated from the date of signing by the parties of the act of implementation of technological accession is provided in the agreement (at the request of such applicants).
