About approval of standards of disclosure of information by subjects of the wholesale and retail markets of electrical energy

1. Approve the enclosed standards of disclosure of information by subjects wholesale and the retail markets of electrical energy.

2. Determine that Federal Antimonopoly Service and its territorial authorities, executive bodies of subjects of the Russian Federation in the field of state regulation of rates within the powers exercise the state control (supervision) regarding observance of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy.

3. Determine that the procedure and terms of consideration by Federal Antimonopoly Service, its territorial authorities of statements for contest of refusal in provision of information provided by standards of disclosure of information by subjects wholesale and the retail markets of electrical energy, and also procedure for storage by these subjects of the specified information affirm Federal Antimonopoly Service.

Standards of disclosure of information by subjects wholesale and retail markets of electrical energy

I. General provisions

Disclosure of information hereunder is understood as ensuring access to it of the unrestricted group of people irrespective of the purpose of receipt of such information, and in the cases established by the this document - provision to interested persons on their information requests by the subjects of the markets of electrical energy who are owners of such information.

2. Subjects of the markets of electrical energy shall open information according to this document.

3. Subjects of the markets of electrical energy information reveals by it:

a) publications in printing editions in which according to the Federal Laws and the laws of subjects of the Russian Federation official materials of public authorities are published (further - official printing publications);

b) publications in electronic mass media;

c) provisions by the written request of interested persons on condition of compensation of the expenses connected with provision of information by them;

d) the directions to Trading System Administrator of the wholesale market of the electric power according to Item 51 of this document;

e) publications on the official sites of subjects of the markets of electrical energy or other official site in it is information - telecommunication network "Internet" (further - Internet network), determined by the Government of the Russian Federation, for the purpose of ensuring access to information on regulated activities of subjects of natural monopolies;

e) directions to executive bodies.

4. Subjects of the markets of electrical energy can publish in official printing publications of the information about structure and nature of disclosed information with reference to the website address where information is placed in full.

Subjects of the markets of electrical energy send data on the place of publication of information to the public authorities exercising the state control (supervision) regarding observance of standards of disclosure of the relevant information, in time, not exceeding 10 days from the date of its publication. The subjects of natural monopolies which are subjects of the markets of electrical energy send information to Federal Antimonopoly Service.

5. The actual information reveals upon termination of the accounting period.

Forecast information reveals prior to the beginning of the accounting period.

The accounting period for separate types of information is determined according to this document and if for any types of information the accounting period is not determined, - depending on nature of information, but no more than one calendar year.

6. Any changes of the opened information (except for information which accounting period of disclosure are hour or days and information provided by written requests of consumers (interested persons) are subject to publication by subjects of the markets of electrical energy from acceptance date of the relevant decision during the next period of time:

a) in official printing publications within 30 calendar days;

b) in electronic mass media, on the official sites of subjects of the markets of electrical energy or other official site in Internet network determined by the Government of the Russian Federation for the purpose of ensuring access to information on regulated activities of subjects of natural monopolies, within 5 working days.

7. Subjects of the markets of electrical energy shall store the opened information according to the procedure, established by federal antimonopoly authority.

8. Subjects of the markets of electrical energy record information requests, and also store copies of refusals in provision of information within 3 years.

9. The refusal in provision of information can be appealed in the procedure established by the legislation of the Russian Federation in Federal Antimonopoly Service, its territorial authorities, executive bodies of subjects of the Russian Federation in the field of state regulation of rates (within powers of the specified bodies) and (or) in court.

10. Subjects of the markets of electrical energy bear responsibility for completeness and reliability of disclosed information in accordance with the legislation of the Russian Federation.

11. For the signature subjects of the markets of electrical energy of information which according to this document reveals in the form of the electronic documents signed by the strengthened qualified digital signature use the strengthened qualified digital signature of person having the right to act on behalf of the subject of the markets of electrical energy without power of attorney, or his representative who is acting on the basis of the power of attorney, according to the Rules of use of the strengthened qualified digital signature in case of the request for receipt of the state and municipal services approved by the order of the Government of the Russian Federation of August 25, 2012 No. 852 "About approval of Rules of use of the strengthened qualified digital signature in case of the request for receipt of the state and municipal services and about modification of Rules of development and approval of administrative regulations of provision of the state services".

The strengthened qualified digital signature specified in paragraph one of this Item is performed in format of the separated digital signature. The name of the file containing the strengthened qualified digital signature contains name of the signed file of the electronic document.

If the files of electronic documents specified hereunder are signed with use of the strengthened qualified digital signature of the representative of the subject of the markets of electrical energy which is acting on the basis of the power of attorney, then the relevant power of attorney made electronically is attached to signed files of electronic documents.

12. Subjects of the markets of electrical energy open the following information:

a) annual financial (accounting) accounts, and also audit opinion (if audit inspection was in accordance with the legislation of the Russian Federation performed);

b) structure and amount of production costs and sales of goods, works and services;

c) in case of application of income method of the invested capital in case of state regulation of rates concerning subjects of the markets of electrical energy:

the operating and uncontrollable expenses included in necessary gross revenue, the rate of return of the invested capital established by federal executive body in the field of state regulation of rates and executive bodies of subjects of the Russian Federation in the field of state regulation of rates (with indication of the act of approval of rate of return on the invested capital), the actual level of profitability of the invested capital used when implementing regulated activities and reasons for the reasons of its variation from the level of profitability of the invested capital established by federal executive body in the field of state regulation of rates and executive bodies of subjects of the Russian Federation in the field of state regulation of rates;

the report on movement of assets including book value of assets for the beginning of year, book value of assets on the end of the year and also information on asset retirement within year;

the report on input of assets within year, including due to revaluation, upgrade, reconstruction, construction and acquisition of the new equipment;

d) the offer on measure of prices (rates), long-term parameters of regulation (in case of application of income method of the invested capital or method of long-term indexation of necessary gross revenue) which are subject to regulation according to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry".

13. The subjects of natural monopolies which are subjects of the markets of electrical energy open information specified in subitems "b" (regarding regulated types of activity) and "in" Item 12, the subitem "an" of Item 45 and Item 52 of this document, in the forms approved by the federal executive body authorized by the Government of the Russian Federation.

14. Subjects of the markets of electrical energy, except for subjects of natural monopolies, open information specified in subitems "b" - "d" Item 35, Item 38, Item 40, subitems "b" and "g" of Item 43, the subitem "b" of Item 45, subitems "g" and "d" of Item 49 and subitems "l" and "m" of Item 55 of this document, in the forms approved by the federal executive body authorized by the Government of the Russian Federation.

15. Subjects of the markets of electrical energy which investing programs affirm federal executive body and (or) executive bodies of subjects of the Russian Federation open information specified in the subitem "an" of Item 12 of this document on the official site in Internet network determined by the Government of the Russian Federation for disclosure of information on investing programs of the specified subjects of the markets of electrical energy, annually no later than April 1.

Subjects of the markets of electrical energy except for specified in paragraph one of this Item of subjects of the markets of electrical energy open information specified in the subitem "an" of Item 12 of this document, in electronic mass media on the official sites of subjects of the markets of electrical energy or other official site in Internet network determined by the Government of the Russian Federation and (or) in the official printing publication annually, no later than June 1.

16. Information specified in the subitem "b" of Item 12 of this document is subject to disclosure:

a) the territorial network organizations and the organization for management of single national (all-Russian) power network (further - the network organizations) on the official sites of the network organizations or other official site in Internet network determined by the Government of the Russian Federation and (or) in printing mass media annually, till April 1;

b) the system operator of electric utility systems of Russia (further - the subject of supervisory control) on the official site or other official site in Internet network determined by the Government of the Russian Federation and (or) in the official printing publication annually, no later than June 1;

c) other subjects of the markets of electrical energy in electronic mass media and (or) in the official printing publication annually, no later than June 1.

17. Information specified in the subitem "g" of Item 12 of this document is subject to disclosure on the official sites of the regulated organizations or other official site in Internet network determined by the Government of the Russian Federation and (or) in the periodic printing edition in which regulatory legal acts of executive body in the field of regulation of rates, within 3 working days after submission to regulating authority of the offer on price fixation (rates) and (or) their limits containing such information are published.

18. Subjects of the markets of electrical energy open information specified in the subitem "g" of Item 12 of this document on form according to appendix No. 1.

II. Standard of disclosure of information by the network organization

19. The network organization in addition to information, stipulated in Item the 12th this document, opens information:

a) about the prices (rates) for goods, works and services of subjects of natural monopolies to which state regulation is applied (further - regulated goods, works and services), including information on rates for services in transfer of electrical energy and the amount of payment for technology accession to power networks on current period of regulation, with indication of source of official publication of the decision of regulating authority on establishment of rates;

b) about the expenses connected with implementation of technology accession, which are not included in payment for technology accession (and subject to accounting (considered) in rates for services in transfer of electrical energy), with indication of source of official publication of the decision of the regulating authority on establishment of rates containing information on the size of such expenses;

c) about construction expenses of the objects of electric grid economy put into operation for the purposes of technology accession and realization of other actions of investing program, on preparation and issue of specifications by the network organization and their approval of the subject of supervisory control, on check of accomplishment by the network organization by the applicant of specifications according to the Section IX of Rules of technology connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons, to power networks, approved by the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technology connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" (further - Rules of technology accession);

d) about the main consumer characteristics of regulated goods, works and services of subjects of natural monopolies and their compliance to the state and other approved quality standards, including information:

about balance of electrical energy and capacity, including about supply of electricity in network and supply of electricity from network of the network company on the levels of tension used for pricing, to consumers of electrical energy and the territorial network organizations attached to networks of the network organization about amount of the transferred electric power according to service provision agreements on transmission of electricity to consumers of the network organization by levels of tension used for pricing and also about losses of the electric power in networks of the network organization in absolute and relative expression for tension levels used for the purposes of pricing;

about costs for payment of losses, including about costs of the network organization for purchase of losses in own networks, about the level of normative losses of the electric power on current period with indication of source of publication of the decision on establishment of level of normative losses, about the list of actions for decrease in the amount of losses in networks, and also about terms of their execution and financing sources, about purchase of electrical energy by the network organizations for compensation of losses in networks and its cost, and also about the amount of the actual losses paid by buyers when implementing calculations for electrical energy for tension levels;

about the list of zones of activities of the network organization with disaggregation for settlements and districts of the cities determined according to borders of balance sheet accessory of the electric grid economy which is in property of the network organization or on other legal cause;

about technical condition of networks, including about aggregated data about emergency shutdowns in month on borders of the territorial zones of organization activity caused by accidents or unplanned shutdowns of objects of electric grid economy with indication of date of emergency shutdown of objects of electric grid economy and their inclusion in work, the reasons of accidents (following the results of investigation in accordance with the established procedure) and actions for their elimination;

about amount of the electrical energy undersupplied as a result of emergency shutdowns;

about availability of amount of the transformer capacity, free for technology joining of consumers, with indication of the current amount of free capacity on the centers of food of 35 kV and above;

about availability of amount of the transformer capacity, free for technology joining of consumers, on substations and distribution points below 35 kV with differentiation on all levels of tension;

about input in repair and conclusion from repair of power grid objects with indication of terms (summary information);

e) about availability (about absence) technical capability of access to regulated goods, works and services of subjects of natural monopolies and about registration and the course of implementation of requests for technology accession to power networks, including information containing aggregated data on subjects of the Russian Federation about the submitted applications for technology accession to power networks and the signed agreements on implementation of technology accession to power networks with indication of quantity:

the submitted applications and the amount of capacity necessary for their satisfaction;

the signed agreements on implementation of technology accession to power networks containing data on amount of the attached capacity, on terms and payment under each agreement; the cancelled requests for technology accession; the executed accessions and the attached capacity;

e) about the size of the reserved maximum capacity determined according to the Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services approved by the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technology connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" with distribution by tension levels;

g) about results of control measurements of electric parameters of operating modes of the equipment of objects of electric grid economy, that is measurements of potokoraspredeleniye, loadings and levels of tension;

h) about conditions on which delivery of regulated goods, works and services by subjects of natural monopolies, and (or) conditions of agreements on implementation of technology accession to power networks with indication of standard forms of service provision agreements on transfer of electrical energy, standard agreements about implementation of technology accession to power networks and source of official publication of the regulatory legal act regulating conditions of these agreements is performed;

i) about procedure for accomplishment of the technology, technical and other actions connected with technology accession to power networks including the list of the actions necessary for implementation of technology accession to power networks, and procedure for accomplishment of these actions with indication of references to regulatory legal acts;
