About change of the Presidential decree of the Republic of Belarus

For the purpose of increase in overall performance of the organizations of agro-industrial complex I decide:

1. Bring in the Presidential decree of the Republic of Belarus of October 16, 2018 No. 407 "About support of the organizations of agro-industrial complex" the following changes:

in paragraphs one and the second Item 1 of the word "appendix" and "appendix" to replace respectively with the words "appendices 1 and 2" and "appendices 1 and 2";

in Item 2:

in subitem 2.1:

paragraphs two and the fifth to state in the following edition:

"during the period of provision of delay (payment by installments) and term of charge of percent concerning debt on the main amount of debt on the credits (except for the overdue debt formed after provision of delay (payment by installments);";

"based on the list of the organizations approved according to subitem 5.1 of Item 5 of this Decree, or the list of the organizations having obligations on the credits on which decisions of banks and Development bank on provision of delay (payment by installments) of debt on principal debt according to part one of subitem 2.6 of Item 2 of the Presidential decree of the Republic of Belarus of July 17, 2014 No. 348 (appendix 2) are made;";

in paragraph six "appendix" shall be replaced with words the word "appendix 1";

add the subitem with part of the following content:

"On the loans granted to JSC ASB Belarusbank of JSC Minskoblagroservice according to the credit agreements specified in appendix 2, compensation of losses of JSC ASB Belarusbank it is performed in the amount of the refunding rate of National Bank which developed (taking into account its change) in the accounting period;";

state subitem 2.2 in the following edition:

"2.2. in cases of change of the name of the borrower and (or) his reorganization, alienation on paid or non-paid basis of the company as property complex (its part) and modification of credit agreements regarding change of the name of the borrower, its form of business compensation of losses of banks and Development bank on the credits is performed according to paragraphs the fourth or sixth parts one of subitem 2.1 of this Item;";

in subitem 2.3:

to state paragraph two of part six in the following edition:

"the requirements established in part two of Item 3 of the Presidential decree of the Republic of Belarus of June 30, 2008 No. 359 "About some questions of provision of guarantees for the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus" and Item 6 of the Regulations on procedure for provision of guarantees for the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus approved by this Decree;";

in word part eight "purchases, voluntary conveyance of the companies as property complexes" shall be replaced with words "alienations on paid or non-paid basis of the company as property complex (its part)";

to add subitem 2.5 after part one with part of the following content:

"In case of the termination of the procedure of bankruptcy proceedings compensation of losses of banks and Development bank at the expense of means republican and (or) local budgets is resumed from the date of renewal of charge of interests on credit by bank and Development bank in sizes and on the conditions provided by acts of the legislation according to which such compensation was provided prior to the procedure of bankruptcy proceedings.";

to state subitem 5.2 of Item 5 in the following edition:

"5.2. in cases of change of the name of the borrower and (or) his reorganization, alienation on paid or non-paid basis of the company as property complex (its part) to adjust the list specified in subitem 5.1 of this Item.

At the same time in case of repeated provision of delay (payment by installments) of return (repayment) of debt on the main amount of debt on the credit specified in appendix 2, this credit (the borrower concerning this credit) is subject to exception of the list of the organizations approved according to subitem 5.1 of this Item;";

to add signature stamp of appendix to the Decree after the word "Appendix" with figure "1";

add the Decree with appendix 2 it (is applied).

2. Offset losses of JSC ASB Belarusbank from provision to the organizations of the credits which repayment periods are changed in connection with provision of delay according to subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of July 17, 2014 to No. 348 "About measures for increase in overall performance of the organizations of agro-industrial complex", during the period of provision of delay according to the list (appendix).

At the same time compensation of losses is performed:

on the credits issued within the Presidential decree of the Republic of Belarus of January 24, 2011 to No. 35 "About the Republican program of equipment by the modern machinery and equipment of the organizations of agro-industrial complex, construction, repair, upgrade of production facilities of these organizations for 2011-2015";

within the means provided in the republican budget on other questions in the field of agricultural industry;

regarding the percent added on the main amount of debt on the credit without overdue debt.
