I ORDER:

1. Bring in the order of the Minister of Education and Science of the Republic of Kazakhstan of January 27, 2016 No. 83 "About the approval of Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan at No. 13317, it is published in the Information system of law of Ad_let on March 11, 2016) the following changes:

Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences, approved by the specified order to state in edition according to appendix to this order.

2. To provide to department of preschool and secondary education of the Ministry of Education and Science of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Karinova Sh. T.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences

Section 1. General provisions

1. These rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences (further - Rules) are developed according to Item 7 of Article 139 of the Labor code of the Republic of Kazakhstan of November 23, 2015, the Law of the Republic of Kazakhstan of July 27, 2007 "About education" (further - the Law).

2. In these rules the following main terms and determinations are applied:

1) the republican commission on consideration of appeals (further - the republican appeal commission) - the commission created by authorized body in the field of education which makes the decision according to matters of argument in case of disagreement of pedagogical workers and persons equated to them with results of national qualification testing;

2) qualification category - the level of professional competence of pedagogical workers and persons equated to them conforming to the qualification requirements determined by these rules;

3) qualification testing - the procedure directed to determination of level of professional competence of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of preschool education and training, educational programs of technical and professional, postsecondary, additional education, for the tests developed by authorized body in the field of education;

4) the next certification - periodically performed procedure for assignment (confirmation) of qualification category of pedagogical workers and persons equated to them after each five years;

5) complex analytical generalization of results of activities - system, consecutive and objective studying of professional competence of pedagogical workers and persons equated to them on the basis of the following indicators: quality of knowledge, skills, achievements of studying (pupils), quality of teaching (education and training) and professional achievements for the certification period;

6) pedagogical workers and persons equated to them are persons holding the positions specified in the list of positions of pedagogical workers and persons equated to them, No. 77 approved by the order of the Government of the Republic of Kazakhstan of January 30, 2008 "About approval of Standard states of employees of the state organizations of education and the list of positions of pedagogical workers and persons equated to them";

7) advanced training of pedagogical workers and persons equated to them - the training allowing to acquire new, and also to support, expand, deepen and enhance earlier acquired professional knowledge, abilities, skills and competences for improvement of quality of teaching and training according to the procedure, the determined authorized body in the field of education;

8) CEFR (Common European Frameworkof Reference, the all-European competences of foreign language skills) (Kommon Europian Freymvork Of Referens) - the international standard used for the description of level of knowledge of language;

9) national qualification testing - the procedure directed to determination of level of professional competence of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of primary, main secondary and general secondary education and training programs of vocational education for the tests developed by the organization determined by authorized body in the field of education.

3. For carrying out certification of pedagogical workers and persons equated to them certifying commissions of appropriate levels are created: in the organizations of education, departments of formation of areas (cities), departments of education of areas, Nour-Sultan's cities, Almaty and Shymkent, in authorized body in the field of education (for the republican subordinated organizations), in authorized bodies of the corresponding industry.

4. Highly skilled teachers of appropriate level of education (preschool education and training, primary, main secondary and general secondary education, technical and professional, postaverage, additional, special), methodologists of educational and methodical offices, the centers, organizations of advanced training, representatives of public and non-governmental organizations, labor unions, production enterprises and organizations, scientific and pedagogical councils and National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken (further - NPP RK Atameken) (for technical and professional, postsecondary education), specialists of governing bodies of education are part of certifying commission.

5. The certifying commission consists of the odd number of members. The chairman, the vice-chairman of certifying commission are elected from among members of the commission. The secretary is not member of certifying commission.

6. The structure of certifying commission affirms the order of the head of the organization of education, departments of formation of areas (cities), departments of education of areas, the cities Nour-Sultan, Almaty and Shymkent, as authorized body in the field of education (for the republican subordinated organizations), in authorized bodies of the corresponding industry.

7. Certification of pedagogical workers and persons of the organizations of formation of industry state bodies equated to them is performed by certifying commissions of the organizations of education and industry state bodies.

8. In the absence of qualified specialists in industry bodies the head of the organization of education addresses with the petition for certification of pedagogical workers and persons equated to them to governing body of education.

9. Meetings of certifying commission are followed audio-or video. Audio-videos are stored in archive at least 3 years.

10. Certification of the pedagogical workers and persons equated to them holding positions in the organizations of education and realizing general education training programs of preschool education and training educational programs of technical and professional, postsecondary, additional education is subdivided on next or early.

11. Certified undergo the next certification according to the subitem 6) of Item 3 of article 51 of the Law at least once in five years.

12. 13. Certified for the next certification for assignment (confirmation) of qualification categories submit the application to certifying commission of appropriate level of the organization of education, departments of formation of areas (cities), departments of education, state bodies in form according to appendix 1 to these rules.

The organization of education represents payroll of the qualification categories certified on the next certification on assignment (confirmation) to departments of formation of areas (cities), departments of education of areas, Nour-Sultan's cities, Almaty and Shymkent, the republican subordinated organizations - to the relevant state body.

15. For carrying out complex analytical generalization of results of activities of the qualification categories certified on the next certification on assignment (confirmation) the order of the head of the organization of education, departments of formation of areas (cities), department of education of areas, the cities Nour-Sultan, Almaty and Shymkent, state body annually creates advisory council:

on the second qualification category - the advisory council organized at the level of the organization of education in structure: methodologists of methodical offices, heads of methodical associations, highly-skilled pedagogical employees of the area (city), representatives of NPP RK Atameken, public organizations, labor unions, employers;

on the first qualification category - the advisory council organized at the level of the area (city) in structure: methodologists of methodical offices, heads of methodical associations, highly-skilled pedagogical employees of the area (city), representatives of institutes of advanced training, NPP RK Atameken, public organizations, labor unions, employers;

on the highest qualification category - the advisory council organized at the level of area in structure: methodologists of methodical offices or centers and highly-skilled pedagogical employees of the organizations of formation of area, organizations of advanced training, representatives of NPPRK of Atameken, public organizations, labor unions, employers.

16. For certification of the qualification categories certified on the next certification on assignment (confirmation) the following documents are submitted for consideration of advisory council:

1) the statement on certification (according to appendix 1 to these rules);

2) copies of the documents necessary for obligatory representation by all certified pedagogical workers:

identity document;

the diploma about education;

the document confirming labor activity of the worker;

certificate of qualification category;
