About modification of some orders of the Government

Based on part (3) articles XII of the Law No. 63/2019 on modification of some legal acts (The official monitor of the Republic of Moldova, 2019, Art. No. 223-229, 277) DECIDES: the Government

1. Approve changes which are made to some orders of the Government (are applied).

2. Within 5 days from the effective date this resolution:

1) to the ministries to provide to the State office for review and registration the staff list;

2) to provide to the State office filling and registration of the staff list of territorial bureaus of the State office.

3. The state office, in connection with liquidation of the state positions of the secretary general of the Government, the general state secretary, state secretary, chief and deputy chief of territorial bureau of the State office and creation of responsible state positions of the secretary general of the Government, the state secretary, chief and deputy chief of territorial bureau of the State office and the state position of the secretary general of the ministry:

1) to develop the orders/orders of the Government on providing the procedure of the notification and dismissal of persons holding these positions according to regulations of article 63 of the Law No. 158/2008 on the state position and the status of the government employee;

2) to give help of tender committee in the organization of tenders on substitution of the state positions of the secretary general of the ministry;

3) to give help in development of orders of the Government about appointment in the conditions of the law to responsible state positions of the secretary general of the Government, the state secretary, chief and deputy chief of territorial bureau of the State office, and also about appointment to the state position of the secretary general of the ministry.

4. This resolution becomes effective from the date of publication.

Changes which are made to some orders of the Government

1. In the Order of the Government No. 201/2009 about enforcement of provisions of the Law No. 158/2008 on the state position and the status of the government employee (The official monitor of the Republic of Moldova, 2009, Art. No. 55-56, 249) to make the following changes:

1) in appendix No. 1:

in Item 5 "the tender committees provided" to replace the text with the text "the tender committee provided";

to add Item 18 after the words "tender CV" with the text

", written testing";

in Item 18-1 after words of "experience and reputation" to add with the text" which is performed on system from 1 to 10 points, separately by each member of tender committee. The arithmetic average value of the points given by members of the commission is considered final assessment in tender CV. The candidates who received final assessment below 7,5 in tender CV are disposed from tender.";

the subitem b) Item 20 after words "practical" to add tasks with the words "for the highest leading state positions and";

add Item 29 with the following offer: "In case of tender on substitution of the highest leading state position the candidates who received for written testing final assessment below 7,5 are disposed from tender.";

to exclude from Item 31 of the word "or from date of tender CV";

in Item 38 the offer second to state in the following edition: "In case of tender on substitution of the highest leading state position arithmetic average value of the final estimates received in tender CV, written testing and interview is considered final assessment in tender.";

from Item 40 the offer second to exclude;

in Item 44 to state paragraph two in the following edition:

"In case of tender on substitution of the highest leading state position the tender committee suggests the Government to appoint to position of the candidate who underwent tender with the highest final assessment. If several candidates gathered identical final assessment, preference is given to the candidate who was highly appreciated most on interview.";

in subitems c) and d) Item 50 of the word "written testing or tender CV and interview" in any case shall be replaced with words "tender CV, written testing and interview" in the corresponding case;

2) of Item 54 to state the subitem in the following edition:

"2) tender committee on substitution of the highest leading state positions - the deputy secretary general of the Government, the secretary general of the ministry, the deputy manager of administrative authority, consisting of 7 members, representatives of civil society and specialists with outstanding activities and experience in the field of public management appointed by the Government, one of which is delegated by the head of state body for which substitution of position competition will be organized.";

in Item 58 of the word "tender committees" shall be replaced with words "tender committee";

in Item 60 to state paragraph two in the following edition:

"As the member of the tender committee specified in the subitem 2) of Item 54, there cannot be nominated person which is appointed or elected to responsible state position, except for the secretary general of the Government";

2) the subitem c) Item 13 of appendix No. 5 to state in the following edition:

"c) deputy secretary general of the Government, secretary general of the ministry, deputy manager of administrative authority;".

2. Item 9 of the Regulations on the organization and functioning of the State office approved by the Order of the Government No. 657/2009 (Official monitor of the Republic of Moldova, 2009, No. 162, Art. 724), to state in the following edition:

"9. The secretary general of the Government holds responsible state position and is appointed to position and dismissed by the Government, being directly under supervision of the Prime Minister. Deputy Secretaries general of the Government have the status of government employees – upper managers both are appointed to position and dismissed by the Government".
