About modification and amendments in the order of the acting minister of power industry of the Republic of Kazakhstan of May 28, 2015 No. 378 "About approval of regulations of the state services in the field of use of atomic energy"

I ORDER:

1. Bring in the order of the acting minister of power industry of the Republic of Kazakhstan of May 28, 2015 No. 378 "About approval of regulations of the state services in the field of use of atomic energy" (it is registered in the Register of state registration of regulatory legal acts No. 11450, it is published on July 14, 2015 in information system of law of Ad_let) the following changes and amendments:

in Item 1:

12) to state the subitem in the following edition:

"12) regulations of the state service "Accreditation of the Organizations Performing Examination of Nuclear, Radiation and Nuclear Physical Safety" according to appendix 12 to this order;";

14) to state the subitem in the following edition:

"14) regulations of the state service "Approval of Techniques of the Calculations Relating to Ensuring Nuclear, Radiation and Nuclear Physical Safety, Provided by the Expert Organization" according to appendix 14 to this order.";

in the regulations of the state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle" approved by the specified order:

to state part one of Item 3 in the following edition:

"3. Result of rendering the state service - the license and (or) appendix to the license, the renewed license and (or) appendix to the license for performance of works, the subjects to use of atomic energy connected with stages of lifecycle, the granted application on withdrawal of uslugopoluchatel, the decision on suspension or renewal of action of the license and (or) appendix to the license or the motivated answer for refusal in rendering the state service, in cases and on the bases, stipulated in Item 10 Standards.";

the second the subitem 4) of Item 5 to state part in the following edition:

"The most allowed time for implementation of this procedure - 15 (fifteen) working days;";

the second the subitem 4) of Item 6 to state part in the following edition:

"8-1. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of receipt of the statement on suspension or renewal of action of the license and (or) appendix to the license:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement is registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

The most allowed time for implementation of this procedure - 1 (one) hour;

3) management of licensing prepares the decision on allowance of the application on suspension or renewal of action of the license and (or) appendix to the license.

The most allowed time for implementation of this procedure - 2 (two) working days;

4) the decision on allowance of the application on suspension or renewal of action of the license and (or) appendix to the license is signed by the head of the service provider or his deputy.

The most allowed time for implementation of this procedure - 2 (two) hours.

8-2. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of receipt of the statement on renewal of action of the license and (or) appendix to the license in case of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement is registered the next working afternoon.

The most allowed time for implementation of this procedure - 2 (two) hours;

4) management of nuclear and radiation safety performs check of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license and transfers the conclusion about elimination or not elimination of violations to the control of licensing.

The most allowed time for implementation of this procedure - 7 (seven) working days;

5) management of licensing prepares the decision on result of rendering the state service. In case of elimination of violations, management of licensing prepares the decision on renewal of action of the license and (or) appendix to the license, and in case of not elimination of violations - the decision on refusal in renewal of action of the license and (or) appendix to the license. The decision is approved by the chiefs of the department of licensing and management of nuclear and radiation safety and affirms the head of the service provider or his deputy. Management of licensing after receipt of the approved decision resumes action of the license and (or) appendix to the license or draws up the motivated answer about refusal in rendering the state service.

The most allowed time for implementation of this procedure - 2 (two) working days.";

in Item 13:

4) to state the subitem in the following edition:

"4) the management of nuclear and radiation safety carries out the analysis of the arrived documents on compliance of uslugopoluchatel to the requirements necessary in case of licensing and (or) appendices to the license and renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation within 15 (fifteen) working days.

In case of renewal of the license and (or) appendix to the license in the cases specified in item 4 of the Standard, except for renewals of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation compliance of uslugopoluchatel to qualification requirements is not checked.

Management of nuclear and radiation safety performs elimination of the violations which were the basis for suspension of the license and (or) appendix to the license within 7 (seven) working days;";

5) to add the subitem with paragraphs the fifth and sixth the following content:

"in case of suspension or renewal of action of the license and (or) appendix to the license within 2 (two) working days;

in case of renewal of action of the license and (or) appendix to the license in case of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license within 2 (two) working days;";

to be reworded as follows appendix 1 to the specified regulations of the state service according to appendix 1 to this order;

in the regulations of the state service "Licensing for Implementation of Activities for the Address Nuclear Materials" approved by the specified order:

to state part one of Item 3 in the following edition:

"3. Result of rendering the state service - the license and (or) appendix to the license, the renewed license and (or) appendix to license for activities according to the address nuclear materials, the granted application on withdrawal of uslugopoluchatel, the decision on suspension or renewal of action of the license and (or) appendix to the license or the motivated answer for refusal in rendering the state service, in cases and on the bases, stipulated in Item 10 Standards.";

the second the subitem 4) of Item 5 to state part in the following edition:

"The most allowed time for implementation of this procedure - 15 (fifteen) working days;";
