According to the subitem 2) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve:

1) regulations of the state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle" according to appendix 1 to this order;

2) regulations of the state service "Licensing for Implementation of Activities for the Address Nuclear Materials" according to appendix 2 to this order;

3) regulations of the state service "Licensing for Implementation of Activities for the Treatment of the Radioactive Materials, Devices and Installations Containing Radioactive Materials" according to appendix 3 to this order;

4) regulations of the state service "Licensing for the Handling of the Devices and Installations Generating Ionizing Radiation" according to appendix 4 to this order;

5) regulations of the state service "Licensing for Implementation of Activities for Provision of Services in the field of Use of Atomic Energy" according to appendix 5 to this order;

6) regulations of the state service "Licensing for Activities for the Treatment of Radioactive Waste" according to appendix 6 to this order;

7) regulations of the state service "Licensing for Transportation, including Transit, Nuclear Materials, Radioactive Materials, Radio Isotope Sources of Ionizing Radiation, Radioactive Waste within the Territory of the Republic of Kazakhstan" according to appendix 7 to this order;

8) regulations of the state service "Licensing for Activities in the Territories of the Former Test Nuclear Test Sites and Other Territories Contaminated as a result of the Carried-out Nuclear Testing" according to appendix 8 to this order;

9) regulations of the state service "Licensing for Physical Protection of Nuclear Installations and Nuclear Materials" according to appendix 9 to this order;

10) regulations of the state service "Licensing for Implementation of Activities for Special Training of the Personnel Responsible for Ensuring Nuclear and Radiation Safety" according to appendix 10 to this order;

11) regulations of the state service "Certification of the Personnel Occupied on Subjects to Use of Atomic Energy" according to appendix 11 to this order;

12) regulations of the state service "Accreditation of the Organizations Performing Examination of Nuclear, Radiation and Nuclear Physical Safety" according to appendix 12 to this order;

13) regulations of the state service "Approval of Designs of Transport Packaging Sets, and also Distribution of Action of Certificates Permissions on Them Approved by Authorized Bodies of Other Countries in the territory of the Republic of Kazakhstan" according to appendix 13 to this order;

14) regulations of the state service "Approval of Techniques of the Calculations Relating to Ensuring Nuclear, Radiation and Nuclear Physical Safety, Provided by the Expert Organization" according to appendix 14 to this order.

2. Declare invalid the order of the Deputy prime minister of the Republic Kazakhstan Minister of the industry and new technologies of the Republic of Kazakhstan of April 25, 2014 No. 133 "About approval of regulations of the state services in the field of use of atomic energy" (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 9475, published in information system of law of Ad_let on June 23, 2014).

3. To provide to committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within 10 working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Regulations of the state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle"

Chapter 1. General provisions

1. The state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle" appears Committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan (further - the service provider) through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal) according to the Standard of the state service "Licensing for Performance of Works, the Subjects to Use of Atomic Energy Connected with Stages of Lifecycle" approved by the order of the Minister of Energy of the Republic of Kazakhstan of April 22, 2015 No. 299 (registered in the Register of state registration of regulatory legal acts for No. 11222) (further - the Standard).

2. Form of rendering the state service - electronic.

3. Result of rendering the state service - the license and (or) appendix to the license, the renewed license and (or) appendix to the license for performance of works, the subjects to use of atomic energy connected with stages of lifecycle, the granted application on withdrawal of uslugopoluchatel, the decision on suspension or renewal of action of the license and (or) appendix to the license or the motivated answer for refusal in rendering the state service, in cases and on the bases, stipulated in Item 10 Standards.

Form of provision of result of rendering the state service: electronic.

Chapter 2. The description of operations procedure of structural divisions (workers) of the service provider in the course of rendering the state service

4. The basis for the procedure (action) for rendering the state service is the electronic request of uslugopoluchatel with application of documents according to Item 9 of the Standard.

5. Contents of each procedure (action) which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of licensing and (or) appendix to the license:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement are registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

The most allowed time for implementation of this procedure - 1 (one) hour;

3) management of licensing checks completeness and effective period of the documents submitted on receipt of the license and (or) appendix to the license. In case of factual determination of incompleteness of the submitted documents and (or) the expiration of their action gives motivated refusal in further review of the statement. In case of representation of complete document package and lack of documents with the expired effective period sends them with appendix of the conclusion about primary check to management of nuclear and radiation safety.

The most allowed time for implementation of this procedure - 2 (two) working days;

4) management of nuclear and radiation safety performs the analysis of compliance of uslugopoluchatel to the requirements necessary for licensing and (or) appendix to the license, and transfers the conclusion about compliance or discrepancy to the control of licensing.

The most allowed time for implementation of this procedure - 15 (fifteen) working days;

5) management of licensing prepares the decision on result of rendering the state service. In case of compliance of uslugopoluchatel to the requirements necessary for licensing and (or) appendix to the license, management of licensing prepares the decision on licensing and (or) appendices to the license, and in case of discrepancy of uslugopoluchatel to the requirements necessary for licensing and (or) appendix to the license - the decision on refusal in licensing and (or) appendices to the license. The decision is approved by the chiefs of the department of licensing and management of nuclear and radiation safety and affirms the head of the service provider or his deputy. Management of licensing after receipt of the approved decision draws up the license and (or) appendix to the license or the motivated answer about refusal in rendering the state service.

The most allowed time for implementation of this procedure - 2 (two) working days;

6) the drawn-up license and (or) appendix to the license or the motivated answer about refusal in rendering the state service is signed by the head of the service provider or his deputy.

The most allowed time for implementation of this procedure - 2 (two) hours.

6. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement are registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

In case of compliance of uslugopoluchatel to the requirements necessary for renewal of the license and (or) appendix to the license, management of licensing prepares the decision on renewal of the license and (or) appendix to the license, and in case of discrepancy of uslugopoluchatel to the requirements necessary for renewal of the license and (or) appendix to the license - the decision on refusal in renewal of the license and (or) appendix to the license. The decision is approved by the chiefs of the department of licensing and management of nuclear and radiation safety and affirms the head of the service provider or his deputy. Management of licensing after receipt of the approved decision draws up the license and (or) appendix to the license or the motivated answer about refusal in rendering the state service.

Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in the cases of renewal of the license and (or) appendix to the license specified in item 4 of the Standard, except for renewals of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement are registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

8. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of receipt of the statement on response:

1) the statement which arrived through the portal from uslugopoluchatel is registered in day of revenues to receipt of the state service by the employee of office of the service provider and is submitted the head of the service provider or his deputy.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

The most allowed time for implementation of this procedure - 1 (one) hour;

3) management of licensing prepares the decision on allowance of the application on response.

The most allowed time for implementation of this procedure - 1 (one) working day;

4) the decision on allowance of the application on response is signed by the head of the service provider or his deputy.

The most allowed time for implementation of this procedure - 2 (two) hours.

8-1. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of receipt of the statement on suspension or renewal of action of the license and (or) appendix to the license:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement is registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

4) the decision on allowance of the application on suspension or renewal of action of the license and (or) appendix to the license is signed by the head of the service provider or his deputy.

The most allowed time for implementation of this procedure - 2 (two) hours.

8-2. Contents of each procedure which is part of process of rendering the state service, duration of its accomplishment, and the sequence of their accomplishment, including stages of passing of all procedures (actions) by each structural division in case of receipt of the statement on renewal of action of the license and (or) appendix to the license in case of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license:

1) the statement on the receipt of the state service which arrived through the portal from uslugopoluchatel Monday through Friday from 9-00 till 18-30 o'clock is registered the employee of office of the service provider receipt date and is submitted the head of the service provider or his deputy. In case of receipt of the statement not in working hours, days off and holidays according to the labor law, the statement is registered the next working afternoon.

The most allowed time for implementation of this procedure - 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution to management of licensing.

The most allowed time for implementation of this procedure - 1 (one) hour;

3) management of licensing sends to management of nuclear and radiation safety the documents submitted for renewal of the license and (or) appendix to the license in case of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license.

The most allowed time for implementation of this procedure - 2 (two) hours;

4) management of nuclear and radiation safety performs check of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license and transfers the conclusion about elimination or not elimination of violations to the control of licensing.

The most allowed time for implementation of this procedure - 7 (seven) working days;

5) management of licensing prepares the decision on result of rendering the state service. In case of elimination of violations, management of licensing prepares the decision on renewal of action of the license and (or) appendix to the license, and in case of not elimination of violations - the decision on refusal in renewal of action of the license and (or) appendix to the license. The decision is approved by the chiefs of the department of licensing and management of nuclear and radiation safety and affirms the head of the service provider or his deputy. Management of licensing after receipt of the approved decision resumes action of the license and (or) appendix to the license or draws up the motivated answer about refusal in rendering the state service.

9. Result of the procedure (action) for rendering the state service (licensing and (or) appendices to the license and renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation) which forms the basis for accomplishment of the following procedure (action):

1) the registered statement with the entering number and date;

2) the written instructions and transfer of the statement in management of licensing;

3) check of completeness of documents and term of their action: motivated refusal in further review of the statement or transfer with appendix of the conclusion about primary check;

4) carrying out the analysis and preparation of the conclusion about compliance or discrepancy of uslugopoluchatel to the requirements necessary for licensing and (or) appendices to the license and renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation;

5) preparation of the decision on result of rendering the state service;

6) signing by the head of the service provider or his deputy of the decision on rendering the state service.

10. Result of the procedure (action) for rendering the state service (renewal of the license and (or) appendix to the license in the cases specified in item 4 of the Standard, except for renewals of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation) which forms the basis for accomplishment of the following procedure (action):

1) the registered statement with the entering number and date;

2) the written instructions and transfer of the statement in management of licensing;

3) check of completeness of documents and term of their action: motivated refusal in further review of the statement or consideration of the application;

4) preparation of the decision on result of rendering the state service;

5) signing by the head of the service provider or his deputy of the decision on result of rendering the state service.

11. Result of the procedure (action) for rendering the state service (the statement on response) which forms the basis for accomplishment of the following procedure (action):

1) the registered statement with the entering number and date;

2) the written instructions and transfer of the statement in management of licensing;

3) preparation of the decision on result of rendering the state service;

4) signing by the head of the service provider or his deputy of the decision on result of rendering the state service.

Chapter 3. The description of order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service

12. The list of structural divisions (workers) of the service provider who participate in process of rendering the state service:

1) office of the service provider;

2) head of the service provider or his deputy;

3) management of licensing;

4) management of nuclear and radiation safety.

13. The description of the sequence of procedures (actions) between structural divisions (workers) with indication of duration of each procedure (action):

1) the employee of office of the service provider performs registration of the arrived documents with assignment of sequence registration number and date within 15 (fifteen) minutes;

2) the head of the service provider or his deputy imposes the resolution and transfers the statement and documents to management of licensing within 1 (one) hour;

3) management of licensing checks completeness and effective period of the submitted documents within 2 (two) working days;

4) the management of nuclear and radiation safety carries out the analysis of the arrived documents on compliance of uslugopoluchatel to the requirements necessary in case of licensing and (or) appendices to the license and renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation within 15 (fifteen) working days.

In case of renewal of the license and (or) appendix to the license in the cases specified in item 4 of the Standard, except for renewals of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation compliance of uslugopoluchatel to qualification requirements is not checked.

Management of nuclear and radiation safety performs elimination of the violations which were the basis for suspension of the license and (or) appendix to the license within 7 (seven) working days;

5) management of licensing prepares the decision on result of rendering the state service:

when licensing and (or) appendices to the license, renewal of the license and (or) appendix to the license by reorganization of legal person licensee in forms of allocation and separation within 2 (two) working days;

in case of allowance of the application on response within 1 (one) working day;

in case of renewal of the license and (or) appendix to the license in the cases specified in item 4 of the Standard, except for renewals of the license and (or) appendix to the license in cases of reorganization of legal person licensee in forms of allocation and separation within 4 (four) hours;

in case of suspension or renewal of action of the license and (or) appendix to the license within 2 (two) working days;

in case of renewal of action of the license and (or) appendix to the license in case of elimination of the violations which were the basis for suspension of the license and (or) appendix to the license within 2 (two) working days;

6) the head of the service provider or his deputy signs the decision on result of rendering the state service within 2 (two) hours.

The detailed description of the sequence of procedures (actions), interactions of structural divisions (workers) of the service provider in the course of rendering the state service is reflected in the reference book of business processes of rendering the state service according to appendix 1 to these regulations.

Chapter 4. The description of order of interaction with The Government for Citizens State corporation and (or) other service providers, and also procedure for use of information systems in the course of rendering the state service

14. These regulations do not provide interaction with The Government for Citizens State corporation and (or) other service providers in the course of rendering the state service.

15. The description of procedure for the address and the sequence of procedures (actions) of uslugopoluchatel when rendering the state service through the portal:

the uslugopoluchatel performs registration on the portal by means of the registration certificate of the electronic and digital signature (further - the EDS) which is stored in the Internet browser of the computer of uslugopoluchatel (it is performed for the unregistered uslugopoluchatel on the portal);

process 1 - authorization on the portal for receipt of the state service;
