About collection of charges for the omission of heavyweight and large-size vehicles on highways public
For the purpose of compensation of damage caused by the road transport transporting heavy and bulky cargoes on highways based on the laws of the Kyrgyz Republic "About highways" and "About Road fund" and provisions of the Agreement on masses and dimensions of the vehicles performing interstate transportations across highways of the State Parties of the Commonwealth of Independent States, the Government of the Kyrgyz Republic decides:
1. Approve enclosed:
- Procedure for collection and distribution of charges for the omission of heavyweight and large-size vehicles on highways public;
- The amount of charges for the omission of heavyweight and large-size vehicles on highways public.
2. Bring the collections specified the Procedure and distributions of charges for the omission of heavyweight and large-size vehicles on the highway public and the Amount of charges for the omission of heavyweight large-size vehicles on highways public for consideration in Jogorku Kenesh of the Kyrgyz Republic.
3. Appoint the Minister of Transport and Communications of the Kyrgyz Republic the official representative of the Government of the Kyrgyz Republic to consideration of the Procedure for collection and distribution of charges for the omission of heavyweight and large-size vehicles on the highway public and the Amount of charges for the omission of heavyweight large-size vehicles on highways public by Jogorku Kenesh of the Kyrgyz Republic.
4. To impose control over the implementation of this resolution on department of construction, development of transport and communications of the Office of the Prime Minister of the Kyrgyz Republic.

1. This Procedure extends to all users highways and artificial constructions on them, provides collection of charges for the omission of heavyweight and large-size vehicles on highways public and determines their appointment and use.
If the international treaties which became effective in the procedure established by the law provide other rules by what those which are kept in this Order then provisions of international treaties are applied.
2. The admissible masses, axial loading and dimensions of vehicles for the omission on highways public and Rules of the omission of heavyweight and large-size vehicles but to highways public are established:
- according to international treaties on masses and dimensions of the vehicles passed on highways of the international value when implementing international carriages;
- The Ministry of Transport and Communications of the Kyrgyz Republic in coordination with the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic.
The vehicle which sizes with load or without load on height, width and length exceed admissible values is considered large-size.
The vehicle which has complete weight or axial loading with load or without load is exceeded by admissible values, it is considered heavyweight.
3. Journey of heavyweight and large-size vehicles with particular and non divisible load on highways public is allowed only in the presence of the special permission issued and controlled by bodies of the State automobile inspectorate of the Ministry of Internal Affairs of the Kyrgyz Republic approved with road authorities of the Ministry of Transport and Communications of the Kyrgyz Republic. Vehicles can move only along route and on the conditions specified in special permission.
4. For the omission of heavyweight and large-size vehicles on highways public charges are levied from their owners.
For the omission of heavyweight and large-size vehicles on highways public join in charges:
- charges for excess of general actual mass of the vehicle over allowed;
- charges for excess of the actual axial loadings over the allowed road designs;
- charges for exceeding of dimensions of vehicles.
The means arriving from collection of the specified charges have special purpose, are enlisted in the income of Road fund of the Kyrgyz Republic and used according to the Law of the Kyrgyz Republic "About Road fund".
The means which are not used and not spent within year arriving from charges for the omission of heavyweight and large-size vehicles on highways public keep the purpose, and cannot be in the years ahead used on other purposes.
5. The amount of collectable charges for the omission of heavyweight and large-size vehicles is determined by highways public by the Ministry of Transport and Communications of the Kyrgyz Republic, is subject to approval of state body of the Kyrgyz Republic on the antimonopoly policy and affirms the Government of the Kyrgyz Republic.
6. Ministry of Transport and Communications of the Kyrgyz Republic:
- provides completeness of receipt of funds on charges for the omission of heavyweight and large-size vehicles on highways public;
- publishes in mass media of the data on enforcement of the Procedure for collection of charges for the omission of heavyweight and large-size vehicles on highways public with indication of the amount of charges, the regulation according to which collection of charges is determined;
- develops and approves Regulations on Items of weight and dimensional control on highways public;
- organizes Items of weight and dimensional control on highways public;
- in coordination with the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic determines and approves the List of Items of weight and dimensional control on highways public.
7. The Ministry of Foreign Affairs of the Kyrgyz Republic in accordance with the established procedure informs the corresponding foreign states on enforcement of the Procedure for collection of charges for the omission of heavyweight and large-size vehicles on highways public, with indication of the amount of charges.
The amount of collectable charges for the omission of heavyweight and large-size vehicles on highways public annually is subject to refining, proceeding from the corresponding costs for carrying out extra works on repair and content of highways and road engineering constructions.
8. Movement of heavyweight and large-size vehicles with particular and non divisible load on highways public is allowed only on the special permission issued by bodies the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic in coordination with road authorities of the Ministry of Transport and Communications of the Kyrgyz Republic in the presence of the corresponding approvals of traffic route. The copy of permission remains in the Ministry of Transport and Communications of the Kyrgyz Republic.
Permission is issued on one transportation. In transit the same loads along the established route permissions to certain consignment or to the term determined by bodies the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic in coordination with road authorities of the Ministry of Transport and Communications of the Kyrgyz Republic can be issued.
9. The list of highways on which the omission of heavyweight and large-size vehicles with particular and non divisible load is allowed is established by the Ministry of Transport and Communications of the Kyrgyz Republic in coordination with the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic.
10. For receipt of special permission in road authorities no later than five days prior to transportations the carrier represents: the written request with indication of registration plate of the vehicle, surname of the driver and person responsible for transportation. In the request the route, expected time and date of journey is also specified. the minimum radius of turn of the vehicle with load, quantity of axes, wheels and the scheme of their relative positioning, determination of loading on axes, total actual weight, vehicle dimensions with load, the expected speed of movement, brand and model of the vehicle.
11. The omission of heavyweight and large-size vehicles with particular and non divisible load is issued for hours with the smallest traffic load, and in settlements - only during daylight hours. As the exception, in night-time on roads in settlements the omission is allowed on condition of allocation of special maintenance by the car of cover or patrol cars of the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic according to the legislation of the Kyrgyz Republic.
The omission in hours "peak" is not allowed, and also in other time of day when taking into account road conditions and traffic load transportation creates the increased danger and considerable difficulties in movement of vehicles.
12. Need and type of maintenance, admissible speeds of movement of heavyweight and large-size vehicles with particular and non divisible load are established by the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic depending on dimensions, weight, features of the transported load and road conditions in case of approval of traffic route and special permission.
13. For control and for the purpose of identification of unauthorized journey of heavyweight and large-size vehicles and collection of charges, Items of weight and dimensional control are organized.
Control on Items of weight and dimensional control is exercised using the equipment (stationary or portable posts).
14. The equipment for measurement of weight and dimensions of vehicles is established in Items of weight and dimensional control according to Rules of the omission of heavyweight and large-size vehicles on highways public.
The main technological transactions of control of heavyweight and large-size vehicles are:
- vehicle stop for 15-20 m to the equipment;
- check and studying of travel documents for determination of exceeding of admissible weight and dimensional parameters of the vehicle;
- check of compliance of weight and dimensional parameters and actual route of the vehicle to weight and dimensional parameters and route;
- decision making about the direction of the vehicle on weighing and temporary withdrawal at the driver of the main travel document;
- weighing of the vehicle with issue of the receipt of weighing and determination of the place of the temporary parking of the vehicle in case of discrepancy of weight and dimensional parameters;
- calculation of the amount and collection of charges for the omission of the vehicle;
- registration of the relevant data in register, control and collection of charges for the omission of heavyweight and oversized vehicles;
- ensuring issue of the receipt on payment of charges and return of the withdrawn documents;
- ensuring timely departure of the vehicle from the place of the temporary parking.
15. Collection of charges for the omission of heavyweight and large-size vehicles on highways public is made from their owners by cash in national currency - som.
16. Control of observance of requirements of this Procedure is imposed on road authorities of the Ministry of Transport and Communications of the Kyrgyz Republic and the State automobile inspection of the Ministry of Internal Affairs of the Kyrgyz Republic.
17. Ensuring storage and transportation of money is performed according to the operating procedure for conducting cash transactions in the Kyrgyz Republic approved by National Bank of the Kyrgyz Republic.
18. The money raised for change is subject to transfer in the income of Road fund of the Kyrgyz Republic.
19. In the absence of cash registers or conditions for providing continuity of their work collection of charges is performed with use of the cash receipt order. Receipt cash orders are subject to strict accounting according to the legislation of the Kyrgyz Republic.
20. The vehicles which are not used for commercial and other purposes from the main activities are exempted from collection of charges for the omission of heavyweight and large-size vehicles on highways public:
- the transporting loads of the humanitarian assistance according to the relevant documents;
- the transporting military loads;
- the transporting loads intended for natural disaster response.
21. Owners of heavyweight and large-size vehicles bear responsibility according to the legislation of the Kyrgyz Republic for violation of requirements of this Procedure.
22. Control of completeness of receipts of the specified charges is made according to the legislation of the Kyrgyz Republic.

The amount of charges for excess of lump of the vehicle over allowed is determined by multiplication of rates by table 1 for haulage distance along route.

The amount of charges for exceeding of the actual axial loadings (OF) over allowed (ODES) when driving heavyweight and large-size vehicles through highways public it is determined by multiplication of rates by the table 2, depending on OF/odes, on haulage distance along route.

Charges for excess of dimensions of the vehicle and load over the allowed weight, are established in the amount of 0, the 15th US dollar for 1 km of journey.
The amount of payment for consideration of the application, approval and issue of special permission to the omission of heavyweight and large-size vehicles of particular and non divisible load is determined by highways public at the rate of 11 US dollars on each 100 km.
(*) In case of change of the amount of the specified charges towards increase or lowering, the State Parties of the Commonwealth of Independent States make corresponding changes.
