About introduction of amendments to some orders of the Ministry of national economy of the Republic of Kazakhstan

According to Item 2 of article 50 of the Law of the Republic of Kazakhstan of April 6, 2016 "About legal acts" I ORDER:

1. Approve the enclosed list of some orders of the Ministry of national economy of the Republic of Kazakhstan to which changes are made.

2. To provide to committee on cases of construction and housing and communal services of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

1. In the order of the Minister of national economy of the Republic of Kazakhstan of November 27, 2014 No. 114 "About approval of Rules of certification of the experts who are carrying out expert works and engineering services in the field of architectural, town-planning and construction activities" (it is registered in the Register of state registration of regulatory legal acts for No. 10058, it is published on February 2, 2015 in information system of law of Ad_let):

in Rules of certification of the experts who are carrying out expert works and engineering services in the field of architectural, town-planning and construction activities, approved by the specified order:

"1) in local authorized body:

the statement in form according to appendix 1 to these rules;

the identity document - for identification of the identity of the applicant;

the copy of the diploma about higher education (in the presence of academic degree and academic status - the copy of the relevant documents);

In case of lack of the service record for the reasonable reasons, the applicant represents one of the following documents confirming labor activity:

the archive reference containing data on labor activity of the worker;

"9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:

1) to the service provider:

the statement in form according to appendix 3 to this standard of the state service;

the identity document - for identification of the identity of uslugopoluchatel;

the copy of the diploma about higher education (in the presence of academic degree and academic status - the copy of the relevant documents);

copy of the service record.

In case of lack of the service record for the reasonable reasons, the uslugopoluchatel represents one of the following documents confirming labor activity:

the employment contract with mark of the employer about date and the basis of its termination;

the statements from acts of the employer confirming origin and the termination of employment relationships on the basis of the conclusion and the termination of the employment contract;

the application in electronic form signed by the EDS of uslugopoluchatel in form according to appendix 3 to this standard;

the electronic copy of the diploma about higher education (in case of availability of academic degree and academic status, the electronic copy of the supporting document);

electronic copy of the service record.

In case of lack of the service record for the reasonable reasons, the uslugopoluchatel represents one of the following documents confirming labor activity:

the electronic copy the employment contract with mark of the employer about date and the basis of its termination;

the electronic copy of the statement from acts of the employer, the confirming origin and the termination of employment relationships on the basis of the conclusion and the termination of the employment contract;

the electronic copy of the archive reference containing data on labor activity of the worker.

Uslugopoluchatel agrees to use of the data which are the secret protected by the law, containing in information systems.

In case of documents acceptance through the service provider the receipt on acceptance of the relevant documents is issued to uslugopoluchatel.

In case of the address through the portal to uslugopoluchatel the status about acceptance of request for rendering the state service with indication of date and time of receipt of result of the state service goes to "personal account".

Reclamation from uslugopoluchatel of documents which can be received from information systems is not allowed.";

3. In the order of the Minister of national economy of the Republic of Kazakhstan of November 23, 2015 No. 709 "About approval of Rules and allowing requirements for accreditation of the organizations performing engineering services in technical supervision and expert works on technical inspection of reliability and stability of buildings and constructions on technically and technologically difficult objects of the first and second levels of responsibility" (it is registered in the Register of state registration of regulatory legal acts for No. 12535, it is published on December 31, 2015 in information system of law of Ad_let):

in Rules and allowing requirements for accreditation of the organizations performing engineering services in technical supervision and expert works on technical inspection of reliability and stability of buildings and constructions on technically and technologically difficult objects of the first and second levels of responsibility approved by the specified order:

4) of item 4 to state the subitem in the following edition:

"4) registration, registration and issue of the certificate on accreditation, or the direction of the motivated answer about refusal.";

state Items 5 and 6 in the following edition:

"5. The bases for motivated refusal in accreditation, are the following violations and discrepancies:

1) establishment of unauthenticity of the documents submitted by the applicant for accreditation passing, and (or) these (data) containing in them;

2) discrepancy of the applicant and (or) the provided materials, objects, supplied and the information necessary for accreditation passing, to requirements, the established these rules and allowing requirements.

2) form of data, for the passing of accreditation by the organization performing engineering services in technical supervision on technically and technologically difficult objects of the first and second levels of responsibility according to appendix 2 to these rules and allowing requirements;

3) the copy of the certificate of personnel service of the regular list of the certified experts.";

"13. Accreditation of the applicant is carried out by authorized body and is confirmed by the certificate on accreditation according to appendix 3 to these rules and allowing requirements.";

"15. The accredited organizations join in the register of the accredited organizations performing engineering services in technical supervision on technically and technologically difficult objects of the first and second levels of responsibility for form according to appendix 4 to these rules and allowing requirements which contains set of information on details of the legal entity, date of issue and certificate number about accreditations, level of responsibility, about availability in staff of specialists, and also data on the measures of the responsibility established by the laws of the Republic of Kazakhstan taken concerning this legal entity.
