About introduction of amendments to Orders of the Ministry of Economic Development of the Russian Federation of May 30, 2014 No. 326 and of September 19, 2018 No. 504

For the purpose of enhancement of functioning of national accreditation system I order:

1. Approve the enclosed changes which are made to the order of the Ministry of Economic Development of the Russian Federation of May 30, 2014 No. 326 "About approval of accreditation criterions, the list of the documents confirming compliance of the applicant, accredited person to accreditation criterions and the list of documents in the field of standardization which observance of requirements by the applicants accredited by persons provides their compliance to accreditation criterions" (it is registered by the Ministry of Justice of the Russian Federation on July 30, 2014, registration No. 33362) with the changes made by orders of the Ministry of Economic Development of the Russian Federation of September 7, 2016 No. 570 (registration No. 45753) is registered by the Ministry of Justice of the Russian Federation on February 22, 2017, of March 17, 2017 No. 114 (registration No. 46360) is registered by the Ministry of Justice of the Russian Federation on April 13, 2017, of May 4, 2018 No. 238 (it is registered by the Ministry of Justice of the Russian Federation on September 5, 2018, registration No. 52085) and the order of the Ministry of Economic Development of the Russian Federation of September 19, 2018 No. 504 "About introduction of amendments to the order of the Ministry of Economic Development of the Russian Federation of February 21, 2012 No. 76 "About approval of the Order of registration of declarations of conformity and the Procedure for forming and maintaining the unified register of the registered declarations of conformity, the provisions containing in the specified register of data" (registration No. 52849) is registered by the Ministry of Justice of the Russian Federation on December 3, 2018.

2. Accreditation experts according to the subitem "b" of Item 4.1 of part 3 of article 11 of the Federal Law of December 23, 2013 No. 412-FZ "About accreditation in national accreditation system" (The Russian Federation Code, 2013, No. 52, Art. 6977; 2018, No. 31, the Art. 4851), the order of the Ministry of Economic Development of the Russian Federation of May 23, 2014 No. 284 "About approval of forms and lists of the data which are in the expert opinion, the act of exit examination, the appraisal certificate" (it is registered by the Ministry of Justice of the Russian Federation on July 17, 2014, registration No. 33134) with the changes made by the order of the Ministry of Economic Development of the Russian Federation of November 29, 2016 No. 764 (registration No. 45676) is registered by the Ministry of Justice of the Russian Federation on February 16, 2017, provide the information about the employees of certification body participating in performance of works on confirmation of conformity according to the subitem "g" of Item of 2 changes approved by this order for inclusion of information about employees of certification body in the register of accredited persons.

3. Determine that for the legal entities and individual entrepreneurs having the operating accreditation in national accreditation system, provisions of Item of 2 changes approved by this order become effective after ninety days from the date of official publication of this order.

To the legal entities and individual entrepreneurs having the operating accreditation in national accreditation system as certification body, after thirty days from the date of official publication and in time, not exceeding ninety days from the date of official publication of this order to provide to Federal Accreditation Service by means of federal state information system in the field of accreditation of the information about employees of certification body (surname, name and middle name (the last - in the presence), the insurance number of the individual ledger account), participating in performance of works on confirmation of conformity, working according to the employment contract as a part of one certification body, for ensuring their entering by Federal Accreditation Service into the register of accredited persons.

If the legal entity or the individual entrepreneur as employees of certification body specify persons who, according to the register, perform activities for the employment contract with other accredited person, the legal entity or the individual entrepreneur has the right to send to Federal Accreditation Service notarized copies of the documents testimonial of the termination of employment relationships of specified persons on principle place of employment with other accredited person and about availability of employment relationships on principle place of employment with the legal entity or the individual entrepreneur and if copies of documents on the termination of employment relationships with other accredited person cannot be provided owing to evasion from their issue to the worker - the notarized statement of the worker for the termination of the corresponding relations with indication of the actual time of the termination and the reasons for which necessary documents at the worker are absent. In case of availability of discrepancies between data from the documents submitted notarized copies confirming availability of employment relationships of the worker and the corresponding data of the register of accredited persons data from notarized copies of documents are considered as valid.

4. On the state services about accreditation registered in Federal Accreditation Service about day of entry into force of this order assessment of conformity of applicants to accreditation criterions is performed on compliance to the accreditation criterions operating for the first day of carrying out exit assessment of conformity of the applicant to accreditation criterions.

5. To legal entities and individual entrepreneurs, decisions on whose accreditation are made after entry into force of this order, but assessment of conformity of which was carried out on compliance to the accreditation criterions operating about day of entry into force of this order, in time, not exceeding thirty days from the date of their accreditation to provide to Federal Accreditation Service by means of federal state information system in the field of accreditation of the information about employees of certification body (surname, name and middle name (the last - in the presence), the insurance number of the individual ledger account), participating in performance of works on confirmation of conformity, working according to the employment contract as a part of one certification body, for ensuring their entering by Federal Accreditation Service into the register of accredited persons.

6. This order becomes effective after thirty days from the date of its official publication.

Appendix

to the Order of the Ministry of Economic Development of the Russian Federation of November 2, 2018 No. 603

Changes which are made to Orders of the Ministry of Economic Development of the Russian Federation of May 30, 2014 No. 326 and of September 19, 2018 No. 504

1. In Item 2 of the order of the Ministry of Economic Development of the Russian Federation of September 19, 2018 No. 504 "About introduction of amendments to the order of the Ministry of Economic Development of the Russian Federation of February 21, 2012 No. 76 "About approval of the Order of registration of declarations of conformity and the Procedure for forming and maintaining the unified register of the registered declarations of conformity, the provisions containing in the specified register of data" (it is registered by the Ministry of Justice of the Russian Federation on December 3, 2018, 52849) the words "after 6 months after day of its official publication" shall be replaced with words registration No. "since February 15, 2019".

a) to state the paragraph of the sixth of Item 9 in the following edition:

"Availability in staff of certification body of the workers on all activities corresponding to area of accreditation working according to the employment contract as a part of one certification body, data on which join in the register of accredited persons. At least three workers shall work in certification body in the state on principle place of employment. Attraction to works on confirmation of conformity of the workers of the legal entity or the individual entrepreneur conforming to requirements of this Item of the accreditation criterions working as a part of other certification bodies of such legal entity or individual entrepreneur on condition of their accreditation on implementation of certification of different objects (products, services, systems of management, personnel) is allowed.";

b) third the subitem "v" of Item 15 to state the paragraph in the following edition:

"the documents confirming availability at employees of certification body of work experience on confirmation of conformity in the field of the accreditation specified in the statement for accreditation or in the register of accredited persons;";

c) add Item 31.10 with the subitem "l" of the following content:

"k) rules of quality management of results of measurements, including rules of planning and the analysis of results of quality control of measurements (concerning bodies of inspectorate in the field of ensuring sanitary and epidemiologic wellbeing of the population);";

d) to state appendix No. 1 to the specified criteria in the following edition:
