About introduction of amendments to the joint order of the Minister of investments and development of the Republic of Kazakhstan of December 15, 2015 No. 1206 and the Minister of national economy of the Republic of Kazakhstan of December 28, 2015 No. 814 "About approval of criteria for evaluation of risk degree and checking sheets in the field of industrial safety"
WE ORDER:
1. Bring in the joint order of the Minister of investments and development of the Republic of Kazakhstan of December 15, 2015 No. 1206 and the Minister of national economy of the Republic of Kazakhstan of December 28, 2015 No. 814 "About approval of criteria for evaluation of risk degree and checking sheets in the field of industrial safety" (it is registered in the Register of state registration of regulatory legal acts at No. 12687, it is published in information system of law of Ad_let on January 28, 2016) the following changes:
in the criteria for evaluation of risk degree in the field of industrial safety approved by the specified joint order:
state Item 1 in the following edition:
"1. These criteria for evaluation of risk degree applied to special procedure for conducting checks in the field of industrial safety (further - criteria), are developed according to Item 2 of Article 141, Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 and Rules of forming by the state bodies of system of risks assessment and form of checking sheets approved by the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 (it is registered in the Register of state registration of regulatory legal acts at No. 17371).";
state Items 7 and 8 in the following edition:
"7. To not carried to high risk the following checked subjects (objects) belong:
1) objects in which production and conversion of popular minerals without carrying out drilling-and-blasting works are conducted;
2) objects in which exploration works without carrying out drilling-and-blasting works are conducted;
3) the objects operating gas stations with total amount of storage of oil products to 200 tons;
4) objects which operate the dangerous technical devices (having signs, stipulated in Item 2 articles 71 of the Law), which did not fulfill the normative service life established by manufacturing plant;
5) the organizations certified on the work right in the field of industrial safety and which are carrying out works on hazardous production facilities;
6) the rescue services servicing hazardous production facilities.
8. Unscheduled inspections are applied to the checked subjects (objects) carried to high risk special procedure for conducting checks based on semi-annual schedules.
Concerning the checked subjects (objects) which are not carried to high risk unscheduled inspections are carried out.";
state Item 11 in the following edition:
"11. Subjective criteria are developed based on requirements of checking sheets in the field of industrial safety which non-compliance according to criteria for evaluation of risk degree correspond to certain extent of violation. Concerning each requirement from checking sheets extent of violation - rough, considerable and insignificant is determined.
The criteria for evaluation of risk degree applied to special procedure for conducting checks in the field of industrial safety are given to checking leaf to these criteria.";
14, of 15, of 16, 17 and 18 to state Items in the following edition:
"14. In case of measure definition of violations of requirements of industrial safety of considerable degree the coefficient of 0,7 is applied and this indicator is calculated by the following formula:
SRZ = (SP2 x 100/SP1) x 0,7
where:
SRZ - indicator of considerable violations of requirements of industrial safety;
SP1 - the required number of considerable violations of requirements of industrial safety;
SP2 - the number of the revealed considerable violations of requirements of industrial safety.
15. In case of measure definition of violations of requirements of industrial safety of insignificant degree the coefficient of 0,3 is applied and this indicator is calculated by the following formula:
SRN = (SP2 x 100/SP1) x 0,3
where:
SRN - indicator of insignificant violations of requirements of industrial safety;
SP1 - the required number of insignificant violations of requirements of industrial safety;
SP2 - the number of the revealed insignificant violations of requirements of industrial safety.
16. The general exponent of risk (SP) is calculated on scale from 0 to 100 and is determined by summing of indicators by the following formula:
SP = SRZ + SRN
where:
SP - general exponent of risk;
SRZ - indicator of considerable violations of requirements of industrial safety;
SRN - indicator of insignificant violations of requirements of industrial safety.
17. On general exponent of risk the checked subject (object) of high risk:
1) it is exempted from special procedure for conducting checks based on semi-annual schedules for term, stipulated in Item 9 these criteria - in case of exponent of risk from 0 to 60;
2) it is not exempted from special procedure for conducting checks based on semi-annual schedules - in case of exponent of risk from 61 to 100 inclusive.
18. The checked subject (object) exempted from the following special procedure for conducting checks with violations of requirements of industrial safety the received risk exponent to 60 points, after terms of elimination of violations is checked in unplanned procedure for the purpose of control of execution of the instruction about elimination of the revealed violations. If the revealed violations of requirements of industrial safety are not eliminated the checked subject (object) is not exempted from following by the review frequency planned according to the stipulated in Item 9 presents Criterion in special procedure.";

to be reworded as follows the checking leaf in the field of the state supervision in the field of industrial safety concerning the hazardous production facilities performing carrying out oil operations at the sea approved by the specified joint order according to appendix 26 to this joint order.
2. To provide to committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this joint order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this joint order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;
4) within ten working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.
3. To impose control of execution of this joint order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This joint order becomes effective after ten calendar days after day of its first official publication.
