About modification of the Procedure for maintaining the State land cadastre

The Cabinet of Ministers of Ukraine decides:

Bring in the Procedure for maintaining the State land cadastre approved by the resolution of the Cabinet of Ministers of Ukraine of October 17, 2012 No. 1051 (The Official Bulletin of Ukraine, 2012, No. 89, Art. 3598; 2013, No. 80, Art. 2975; 2014, No. 97, Art. 2786; 2015, No. 46, Art. 1472, No. 54, Art. 1742, No. 79, Art. 2650; 2016, No. 2, the Art. 102, No. 25, the Art. 992, No. 71, the Art. 2386), changes which are applied.

Changes which are made to the Procedure for maintaining the State land cadastre

1. State Item 6 in the following edition:

"6. Treat powers of the state cadastral registrars of Gosgeokadastr and his territorial authorities:

1) entering into the State land cadastre:

geodetic, cartographic basis and the information about them (changes to them), index cadastral maps (plans) of the corresponding administrative and territorial units (changes to them), the index cadastral map of cadastral zone outside administrative and territorial units (in it) and data on cadastral zoning of lands within the territory of Ukraine (changes to them);

data (changes to them) or provision of refusal in their introduction is relative:

- lands within frontier, the territory of administrative and territorial units (The Autonomous Republic of Crimea, areas, of Kiev and Sevastopol, areas, the cities, settlements, villages, areas in the cities);

- restrictions in use of lands;

- the parcels of land (their part) located within the area, the city republican (Autonomous Republic of Crimea) or regional value, areas in Kiev and Sevastopol and also the cities, settlements, villages located in their limits;

- other subjects of the State land registry located outside administrative and territorial units;

2) registration implementation:

statements for introduction of data (changes to them) in the State land cadastre;

statements for withdrawal of statements for introduction of data (changes to them) in the State land cadastre;

statements for provision of data from the State land cadastre;

messages on detection of the mistakes made when maintaining the State land cadastre;

statements for correction of the technical mistakes made when maintaining the State land cadastre;

statements for entering of the corrected data into the State land cadastre;

statements electronically for receipt of data from the State land cadastre on the parcel of land;

3) implementation of state registration of the parcels of land, restrictions in their use, cancellations of such registration;

4) forming of land books on the parcels of land, entering of records into them, ensuring their storage;

5) assignment of cadastral numbers to the parcels of land;

6) conducting check of compliance of the submitted documents to Requirements of the legislation;

7) generalization of data on quantity and quality of lands within frontier, the territories of administrative and territorial units (The Autonomous Republic of Crimea, areas, of Kiev and Sevastopol, areas, the cities, settlements, villages, areas in the cities) by means of the software of the State land cadastre;

8) provision of data from the State land cadastre concerning the objects specified in the subitem of 1 this Item, and refusal in their provision, statements from the State land cadastre about any parcel of land within frontier;

9) error correction in the State land cadastre, allowed in data on the objects specified in the subitem of 1 this Item;

10) promulgation by means of the software of the State land cadastre on the official site of Gosgeokadastr of data on the objects specified in the subitem of 1 this Item;

11) provision and receipt of information on subjects of the State land registry according to the procedure of information exchange with other inventories and information systems;

12) holding training of administrators of the centers of provision of administrative services of authorized officers of executive bodies, local government bodies and provision by it of the certificate of results of training;

13) transfer to bodies of state registration of the rights to real estate of data on the parcels of land.

Distribution of powers of the state cadastral registrars of Gosgeokadastr and his territorial authorities is performed by Gosgeokadastr.".

2. Exclude Items 7 and 8.

3. In paragraph four of Item 28 of the word of "The state qualifier" to replace with the word of "Qualifier".

4. In appendices to the Procedure:

1) in the MunicipalUnitNormativValuation element - data on normative money value of the parcels of land of settlements according to appendix 46 to these Requirements;

2) in the AgriculturalNormativValuation element - data on normative money value of the parcels of land of agricultural purpose;

3) in the NonAgriculturalNormativValuation element - data on normative money value of the parcels of land of nonagricultural appointment (except the parcels of land of settlements). Normative money value of lands of settlements

69-11. MunicipalUnitNormativValuation given in appendix 46 to these Requirements including elements which contain data on normative money value of the parcels of land of settlements in which are specified:

1) in the Externals element - data according to appendix 11 to these Requirements;

2) in the AreaNP element this about the area of the estimative territory of the settlement which normative money value of the parcels of land is carried out;

3) in the ValuationYear element - given about year of accomplishment of normative money value of the parcels of land;

4) in the DescriptionOfTerritory element - data on the settlement which normative money value of the parcels of land is carried out, namely:

in the Region element - data on the name of the area (Autonomous Republic of Crimea) within which the settlement which normative money value of the parcels of land is carried out is located;

in the District element - data on the name of the area within which the settlement which normative money value of the parcels of land is carried out is located;

in the Rada element - data on the name of council within which the settlement which normative money value of the parcels of land is carried out is located;

in the Status element - data on type of the settlement which normative money value of the parcels of land is carried out, namely:

- the Settlement element demonstrates that the settlement is the settlement;

- the Village element demonstrates that the settlement is the village;

- the UrbanTypeSettlement element demonstrates that the settlement is the settlement of city type;

- the City element demonstrates that the settlement is the city;

in the MunicipalUnitName element - data on the name of the settlement which normative money value of lands is carried out;

in the "Code of the Qualifier of Objects of the Administrative-territorial Device of Ukraine" element (KOATUU) - data on code of the settlement which normative money value of the parcels of land is carried out, according to the Qualifier of objects of the administrative-territorial device of Ukraine by group of companies 014-97;

in the Population element - data on population of the settlement which normative money value of the parcels of land is carried out;

5) in the Regional Coefficient (Km 1) element (Km 1) - data on the regional coefficient characterizing dependence of investment income on location of the settlement in nation-wide, regional and local production systems and resettlements namely:

in the Value of Coefficient Km1 element (Km1Z) - data on value of coefficient Km1;
