RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About approval of the Procedure for maintaining the State land cadastre

According to part three of article 5 of the Law of Ukraine "About the State land cadastre" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for maintaining the State land cadastre (further - the Procedure) which is applied.

2. Determine that:

1) in case before entry into force of this resolution:

documentation on land management and technical documentation according to lands, which is the basis for entering of data into the State land cadastre, developed, but not approved by the decision of public authority or local government body, entering of data into the State land cadastre is performed according to Procedure;

cadastral numbers to the parcels of land based on the corresponding statements of customers of documentation on land management or persons authorized by them are not determined, such cadastral numbers are assigned to the parcels of land according to Procedure;

are registered in the procedure for the statement of the physical persons or legal entities for provision of services connected with maintaining the state register of lands established by the legislation, but such services are not provided, they are presented according to Procedure. At the same time, if the payment for provision of services is brought in full, the additional fee for provision of services is not levied;

2)  No. 205 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 21.03.2016

3) on the date of entry into force of this resolution cartographic basis of the State land cadastre are the orthophotomaps created within agreement performance about the loan ("Issue of the State Acts on the Property Right to the Earth in the Rural Zone and Development of System of the Inventory" project) between Ukraine and the International Bank for Reconstruction and Development of the October 17 in 2003 ratified by the Law of Ukraine of June 15, 2004 No. 1776-IV, and other cartographic materials made by request of the central executive body concerning land resources or received by it from the central executive body concerning land and cartographic activities of the state company "State Kartografo-geodetic Fund of Ukraine" and other subjects of information exchange;

4) before creation of index cadastral maps (plans) according to Procedure for assignment of cadastral numbers to the parcels of land and maintaining the cadastral map (plan) index cadastral maps (plans) created within the agreement performance specified in subitem 3 of this Item, and in case of their absence - others (framed by territorial authorities of the central executive body concerning land resources) index cadastral maps (plans) in which at the time of entry into force of this resolution the first eight digits of numbers of cadastral zones correspond to codes of objects of the first - the third level of classification according to the Qualifier of objects of the administrative-territorial device of Ukraine of 01497, Group are used and the ninth and tenth digits are zero.

3. Recognize invalid acts of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. To provide to the Ministry of Agricultural Policy and Food together with the State agency of land resources in six-months time adoption of necessary regulatory legal acts and to bring own regulatory legal acts into accord with this resolution.

5. This resolution becomes effective at the same time with entry into force of the Law of Ukraine "About the State land cadastre", except Item 4, becoming effective from the date of its publication.

Procedure for maintaining the State land cadastre

General part

1. This Procedure determines the procedure and requirements concerning maintaining the State land cadastre.

2. Terms which are used in this Procedure have such value:

1) the address about entering of data (changes in them) into the State land cadastre - such statements and messages electronically:

the statement for introduction of data (changes in them) in the State land cadastre;

the statement for withdrawal of the statement for introduction of data (changes in them) in the State land cadastre;

statement for the state land registration;

the paragraph the fifth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 09.10.2020 No. 948

the statement for introduction of data (changes in them) in the State land cadastre about borders of part of the parcel of land to which the rights of the sublease, the servitude extend;

message on detection of technical mistake by physical person or legal entity;

the statement for correction of the technical mistakes made when maintaining the State land cadastre;

the statement for entering of the corrected data into the State land cadastre;

the address concerning use of the corresponding data - such statements in electronic or paper form;

the message on detection by physical person or legal entity of the mistake made in the data of the State land cadastre entered in it from other inventories and information systems according to the procedure of information exchange;

the statement for providing data from the State land cadastre;

the paragraph the twelfth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 09.10.2020 No. 948;

statement for providing access to the State land cadastre;

statement for providing data of the State land cadastre;

2) the subject of providing administrative service in the field of the State land cadastre - the state cadastral registrar, the administrator of the center of providing administrative services, the authorized officer of executive body of village, settlement, city councils;

3) the Public cadastral map - part of the software of the State land cadastre by means of which providing access to data of the State land cadastre and publication in the form of the open data determined by the Law of Ukraine "About the State land cadastre" the data is performed.

Other terms are used in the value given in the Land code of Ukraine, the Laws of Ukraine "About the State land cadastre", "About land management", "About assessment of lands", "About land and cartographic activities", "About the state registration of the corporeal rights to real estate and their encumbrances", other laws and regulatory legal acts of town-planning documentation adopted according to them.

3. The state land registry is kept on electronic and papers.

Documents in paper form which are created during maintaining the State land cadastre of the statement from the State land cadastre about subject of the State land registry, the references containing summarized information on lands (territory), vykopirovka from cartographic basis of the State land cadastre, the cadastral map (plan), cadastral plans of the parcels of land and other documents are created by printout of their electronic (digital) form by means of the software of the State land cadastre.

During creation identical according to documentary information and details of documents in electronic and paper form each of documents is the original and has identical legal force.

In case of identification of discrepancies between data on electronic and papers data on papers have priority.

Documents electronically which are created in pursuance of requirements of this Procedure shall conform to requirements of the legislation in the field of electronic document management and electronic confidential services.

4. Maintaining the State land cadastre is performed by Gosgeokadastr and his territorial authorities.

Holder of the State land cadastre is Gosgeokadastr.

Functions of the administrator of the State land cadastre are performed by the state company determined by Gosgeokadastr in coordination with Minagropolitiki relating to the sphere of management of Gosgeokadastr.

5. Gosgeokadastr's list and his territorial authorities includes the state cadastral registrars performing entering of data into the State land cadastre and providing such data within the powers determined by the Law of Ukraine "About the State land cadastre" and this Procedure.

The state cadastral registrar has access to all data of the State land cadastre, independently makes the decision on introduction of data in it, providing such data, and also refusal in introduction or providing data.

The state cadastral registrar has the certificate of the State cadastral registrar and own seal which forms and the description are determined by Minagropolitiki.

Intervention of any bodies, official and officials, citizens or their associations in activities of the State cadastral registrar is forbidden, except the cases established By the law Ukraine "About the State land cadastre".

The baking plate is understood by intervention in activities of the State cadastral registrar directly not stipulated by the legislation action of any bodies, official and officials, citizens or their associations which concerns implementation by the State cadastral registrar of the powers determined by the Law of Ukraine "About the State land cadastre" and this Procedure.

5-1. Administrators of the centers of providing administrative services according to the procedure, established By the law Ukraine "About administrative services", and authorized officers of executive bodies of village, settlement, city councils which successfully passed training according to the Procedure for holding training in the field of land relations approved by the resolution of the Cabinet of Ministers of Ukraine of March 21, 2016 No. 205, provide the information from the State land cadastre according to the powers determined by the Law of Ukraine "About the State land cadastre" and this Procedure within the territory of the corresponding administrative and territorial unit.

6. And the state cadastral registrars of its territorial authorities (including such which perform the activities at the district (city) level Kiev and Sevastopol in) treat powers of the state cadastral registrars of Gosgeokadastr:

1) entering into the State land cadastre:

geodetic, cartographic basis and the information about them (changes to them), index cadastral maps (plans) of the corresponding administrative and territorial units (changes to them), the index cadastral map of cadastral zone outside administrative and territorial units (in it) and data on cadastral zoning of lands within the territory of Ukraine (changes to them);

data (changes to them) or providing refusal in their introduction is relative:

- frontier, lands in borders, the territories of administrative and territorial units (The Autonomous Republic of Crimea, areas, of Kiev and Sevastopol, areas, the cities, settlements, villages, areas in the cities), the territories of territorial communities;

- restrictions in use of lands;

- the parcels of land (their part) located within the area, the city republican (Autonomous Republic of Crimea) or regional value, areas in Kiev and Sevastopol and also the cities, settlements, villages located in their limits;

- other subjects of the State land registry located outside administrative and territorial units;

2) registration implementation:

statements for introduction of data (changes in them) in the State land cadastre;

statements for withdrawal of statements for introduction of data (changes in them) in the State land cadastre;

statements for the state land registration;

statements for introduction of data (changes in them) in the State land cadastre about borders of part of the parcel of land to which the rights of the sublease, the servitude extend;

messages on detection of technical mistake by physical person or legal entity;

statements for correction of the technical mistakes made when maintaining the State land cadastre;

statements for entering of the corrected data into the State land cadastre;

messages on detection by physical person or legal entity of the mistake made in the data of the State land cadastre entered in it from other inventories and information systems according to the procedure of information exchange;

statements for providing data from the State land cadastre;

the paragraph the twelfth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 09.10.2020 No. 948;

3) implementation of the state land registration, restrictions in their use, cancellations of such registration;

4) forming of land books on the parcels of land, entering of records into them, ensuring their storage;

5) assignment of cadastral numbers to the parcels of land;

6) conducting check of compliance of the submitted documents to Requirements of the laws and the regulatory legal acts adopted according to them, documentation on land management and town-planning documentation;

7) generalization of data on quantity and quality of lands in frontier, the territories of administrative and territorial units (The Autonomous Republic of Crimea, areas, of Kiev and Sevastopol, areas, the cities, settlements, villages, areas in the cities), the territories of territorial communities by means of the software of the State land cadastre;

8) providing data from the State land cadastre concerning the objects specified in the subitem of 1 this Item, and refusal in their provision, statements from the State land cadastre about any parcel of land in frontier;

9) error correction in the State land cadastre, allowed in data on the objects specified in the subitem of 1 this Item;

10) promulgation by means of the software of the State land cadastre on the official site of Gosgeokadastr of data on the objects specified in the subitem of 1 this Item;

11) provision and receipt of information on subjects of the State land registry according to the procedure of information exchange with other inventories and information systems;

12) holding training of administrators of the centers of providing administrative services of authorized officers of executive bodies of village, settlement, city councils and providing to them of the certificate of results of training;

13) No. 509 Is excluded according to the Resolution of the Cabinet of Ministers of 12.07.2017.

9-1. Treat powers of administrators of the centers of providing administrative services of authorized officers of executive bodies of village, settlement, city councils:

1) implementation of registration of addresses about entering of data (changes in them) into the State land cadastre and the addresses concerning use of the corresponding data;

2) conducting check submitted the addresses and documents to them to requirements of the legislation;

3) providing data from the State land cadastre on the earth and the parcels of land (their part) located within the area, the city republican (Autonomous Republic of Crimea) or regional value, and refusal in their provision, statements from the State land cadastre about any parcel of land in frontier;

4) promulgation by means of the software of the State land cadastre on the official site of Gosgeokadastr of date and number of registration of addresses about entering of data (changes in them) into the State land cadastre and the addresses concerning use of the corresponding data, their summary and information on results of consideration.

Data of the State land cadastre

Types of data of the State land cadastre and requirement to them

10. Data of the State land cadastre are all data which are subject to entering into it according to this Procedure and according to the procedure of information exchange with other inventories and information systems and also the data received as a result of their processing, systematization and generalization.

11. Data of the State land cadastre are subdivided into data about:

1) to geodetic and cartographic basis of the State land cadastre;

2) cadastral zoning of lands within the territory of Ukraine;

3) subjects of the State land registry.

12. Data of the State land cadastre are official and are considered objective and reliable if other is not proved by court.

13. Data of the State land cadastre are subject to display in documents of the State land cadastre.

14. Data on subjects of the State land registry are entered in it according to Items 66-137 of this Procedure.

Data on value of the area of the object of the State land cadastre are entered in it with an accuracy of four significant figures after comma.

15. Documentation on land management and assessment of lands which is the basis for introduction of data (changes in them) in the State land cadastre moves to the State cadastral registrar which performs introduction of such data electronically according to requirements of the Law of Ukraine "About land management" and in electronic form according to requirements of the Law of Ukraine "About the State land cadastre.

Requirements to content, structure and engineering characteristics of the electronic document, are determined in appendix 1.

Data on geodetic and cartographic basis of the State land cadastre and cadastral zoning of lands within the territory of Ukraine.

15-1. The data of the State land registry, documents created when maintaining the State land cadastre for the purpose of confirmation of their origin, integrity and reliability remain raspredelitelno (by creation, storage and protection of their backup copy) at:

the administrator of the State land cadastre within administration of the State land cadastre according to requirements of this Procedure;

The state geoinventory based on the agreements signed with the administrator of the State land cadastre on work and rendering the services connected with administration of the State land cadastre;

The national center of reservation of the state information resources according to requirements of the Procedure for functioning of the National center of the reservation of the state information resources approved by the resolution of the Cabinet of Ministers of Ukraine of February 8, 2021 No. 94 "About implementation of the pilot project on functioning of the National center of reservation of the state information resources" (The Official Bulletin of Ukraine, 2021, No. 14, the Art. 578).

The list of state bodies, the state companies, public institutions determined in paragraphs the second - the fourth this Item, can be in case of need added by modification of this Procedure.

16. Are brought in the State land cadastre geodetic and cartographic basis of the State land cadastre and information about her, specified in Items 89 and 90 of this Procedure.

17. Geodetic basis of the State land cadastre are coordinates of Items of the state geodetic network in single state system of coordinates.

For transformation (transformation) to single state system of coordinates of archive data on the subjects of the State land registry created in other systems of coordinates in the State land cadastre additional data on coordinates of Items of the state geodetic network in the corresponding systems of coordinates can be entered.

18. Cartographic basis of the State land cadastre are cards (plans) which are constituted in form and scale according to state standards, regulations and rules, technical regulations, made to order Gosgeokadastra or received by it from subjects of information exchange and suitable for maintaining the State land cadastre.

19. Data on geodetic and cartographic basis are subject to obligatory transfer to Gosgeokadastr according to its written address by the central executive bodies to which powers realization of state policy concerning topografogeodezichesky and cartographic activities, the state company "State Kartografo-geodetic Fund of Ukraine" and other subjects of information exchange belongs.

20. Data on cadastral zoning of lands within the territory of Ukraine include:

1) numbers of cadastral zones and quarters;

2) the description of borders of cadastral zones and quarters (coordinate of points of turn of borders of cadastral zones and quarters in single state system of coordinates);

3) area of cadastral zones and quarters;

4) the bases for establishment of borders of cadastral zones and quarters (electronic copies of documents based on which such borders are established (the relevant orders of Gosgeokadastr and his territorial authorities, documents based on which the frontier, the relevant orders of Gosgeokadastr on entering into the State land cadastre of data (changes in them) on frontier, documentation on land management concerning establishment of borders of administrative and territorial units and the decision of authorized bodies on its approval is established).

Data on subjects of the State land registry and their cadastral identification

21. In the State land cadastre the following data on frontier are entered:

1) graphical representation of the line of frontier:

the rotary points of border which are consistently connected by lines;

coordinates of border markers and rotary points;

frontier extent (in general and stray patch);

2) full name of adjacent foreign states according to the State register of place names;

3) accounting numbers of the line of frontier according to appendix 2 and Item 28 of this Procedure;

4) information on documents based on which the frontier is established (in general and/or stray patch):

the name, date and number of the decision on approval of the document, the name of body which accepted it;

electronic copies of documents based on which the frontier is established;

5) data on demarcation (to redemarkation, delimitation) borders:

quantity of means of demarcation (redemarkation, delimitation) frontier (in general and stray patch);

installation date of each means of demarcation (redemarkation, delimitation) frontier;

coordinates of means of demarcation (redemarkation, delimitation) frontier;

information on documents based on which demarcation is carried out (redemarkation delimitation) frontier (in general and/or stray patch), including the name, date and number of the decision on demarcation (redemarkation, delimitation) borders, the name of body which accepted it;

electronic copies of documents based on which demarcation (redemarkation, delimitation) frontier is carried out.

22. In the State land cadastre such data on lands in frontier as data on lands within the territories of administrative and territorial units (The Autonomous Republic of Crimea, areas, of Kiev and Sevastopol, areas, the cities, settlements, villages, areas in the cities) and beyond their limits are entered (in the part characterizing such lands taking into account their location):

1) the name of administrative and territorial unit according to the State register of place names;

1-1) data of the State address register;

2) description of borders of administrative and territorial unit:

graphical representation of borders of administrative and territorial unit with coordinates of their rotary points, the text description and length (in general and stray patch);

quantity and coordinates of land marks which in nature (on the area) fix administrative and territorial unit borders (in general and stray patch);

3) acreage within the administrative and territorial unit territory;

4) complete names of adjacent administrative and territorial units according to the State register of place names;

5) information on documents based on which are established borders of administrative and territorial units (are changed):

the name, date and number of the decision on approval of documentation on establishment (change) of borders of administrative and territorial units, the name of the body which accepted it;

electronic copies of documents based on which are established (are changed) borders of administrative and territorial units;

6) data on categories of lands within administrative and territorial unit:

the name, code (number) of category of lands (in general and on separate contours) according to appendices 2 and 3 and Item 28 of this Procedure;

borders of lands of each category on separate contours with coordinates of their rotary points and length;

the acreage of each category (in general and on separate contours);

information on documents based on which the category of lands is established (the name, date and number of the decision on approval of documentation on land management according to which reference of lands to the corresponding category is performed, the name of body, it accepted), electronic copies of such documents;

6-1) data on array of lands of agricultural purpose:

the name, code (number) of array according to appendix 2 and Item 28 of this Procedure;

the description of the borders and grounds which are part of array namely:

array borders with coordinates of their rotary points and length, the text description of structure of grounds;

contours of the grounds which are part of array with coordinates of their rotary points and length;

area of array;

information on the parcels of land which are part of array;

information on documents based on which data on array are entered in the State land cadastre (the name, date and number of the decision on approval of documentation on land management, the name of body which accepted it), electronic copies of such documents;

6-2) data on borders of the territories on which the parcels of land necessary for placement of objects concerning which according to the law compulsory acquisition of the parcels of land based on social necessity can be performed are located:

the name, code (number) of territorial zone according to appendix 2 and Item 28 of this Procedure;

data on objects which are supposed to be placed in the territory;

description of borders;

area;

information on documents based on which data on borders of the territory are entered in the State land cadastre;

6-3) data on borders of functional zones:

the name, code (number) of type of functional zone according to appendix 2 and Item 28 of this Procedure;

description of borders;

area;

information on documents based on which data on borders of functional zones are entered in the State land cadastre;

7) data on administrative and territorial unit grounds:

the name, code (number) of ground (in general and on separate contours) according to appendices 2 and 4 and Item 28 of this Procedure;

contours of grounds with coordinates of their rotary points and length;

the area of each ground (in general and on separate contours);

information on documents based on which grounds are determined (the name, date and number of the decision on approval of the corresponding documentation on land management, the name of body, it accepted), electronic copies of such documents;

information on quality characteristics of grounds (in general and on separate contours), namely: marks of heights in the Baltic system of heights, relief horizontals, areas of the steepness of slopes, relief objects (ravines, steep slopes, rocks, breaks, shifts and so forth), the relief section height, corners of the steepness of slopes; belonging to areas of certain soils, their agroproduction groups (subgroups) according to appendix 5; content of humus; results of agrochemical inspections; availability of negative signs (salted, marshiness, erodibility, shifts, collapses, karst formations, floodings, skeletnost, impurity radioactive, chemical or biological materials, degradirovannost, low-performance and so forth), and also about documents based on which quality characteristics of grounds are determined (the name date and number of the decision on approval of the corresponding documentation, the name of body, it accepted (in case such documentation affirms), electronic copies of such documents;

8) data on normative money value of lands within the administrative and territorial unit territory:

distribution of lands on economical and planning zones and estimative units (areas), namely: code of estimative economical and planning zone according to appendix 2, number of economical and planning zone and estimative unit (area); borders of economical and planning zones and estimative units (areas) with coordinates of their rotary points; area of economical and planning zones and estimative units (areas); value of zone coefficients;

value of normative money value of lands within administrative and territorial unit (average cost of one sq.m of lands of the settlement, the unit area of lands outside the settlement);

information on local factors and zones of their action (name of local factors; borders of action areas of local factors (by types) with coordinates of their rotary points; value of coefficient of local factor within zone of its action);

information on areas of agroproduction groups of soils according to subitem 7 of this Item;

information on site class determination of soils according to subitem 9 of this Item;

information on documents based on which the normative money value of lands within the administrative and territorial unit territory (the name, date and number of the decision on approval of technical documentation on normative money value of lands, the name of the body which accepted it, date of normative money value of lands and commissioning of the specified decision), electronic copies of such documents is established.

The basis for providing data from the State land cadastre on normative money value of the parcel of land of agricultural purpose (except the parcels of land located in borders of settlements) are the data on normative money value introduced in the State land cadastre in accordance with the established procedure.

The paragraph the ninth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 23.12.2021 No. 1417

9) data on site class determination of soils of administrative and territorial unit:

distribution of soils of administrative and territorial unit on site class points, namely: borders of soils with identical points of site class with coordinates of their rotary points, the area of soils with identical points of site class, value of point of site class on each area of soils;

GPA of site class of soils of administrative and territorial unit;

information on documents based on which site class determination of soils of administrative and territorial unit (the name, date and number of the decision on approval of technical documentation on site class determination of soils, the name of the body which accepted it date of site class determination of soils), electronic copies of such documents is carried out.

22-1. In the State land cadastre the following data on lands in borders of the territory of territorial community are entered:

1) name of territorial community;

2) description of borders of the territory of territorial community:

graphical representation of borders of the territory of territorial community with coordinates of rotary points, the text description and length (in general and stray patch);

quantity and coordinates of land marks by which in nature (on the area) it is fixed limits of the territory of territorial community (in general and stray patch);

acreage within the territory of territorial community;

3) name of adjacent territorial communities;

4) information on materials based on which borders of the territory of territorial community are established:

the name, date and number of the decision on approval of documentation on land management concerning establishment of borders of the territories of territorial communities, the name of body which accepted it;

scans copies/photocopies of documents based on which borders of the territory of territorial community are established.

23. In the State land cadastre such data on restriction in use of lands are entered:

1) the name and code, accounting number of restriction (in general and on separate contours) according to appendices 2 and 6 and Items 28 and 30-1 of this Procedure;

2) restriction contours with coordinates of their rotary points and length;

3) the area of restriction (in general and on separate contours);

4) the list of the prohibited types of activity and obligations concerning making of certain actions with reference to regulatory legal acts according to which restriction, restriction effective period is set;

5) the description of rezhimoobrazuyushchy object (in case of its availability):

name;

contours of borders of rezhimoobrazuyushchy object with coordinates of rotary points and length;

the area (in general and on separate contours);

the characteristics causing restriction establishment;

6) information on documents based on which restrictions are set (the name, date and number of the decision on approval of documentation on land management according to which restriction, the name of the body which accepted it, date from which restriction is valid is set), electronic copies of such documents.

Before entering into the State land cadastre of data on the description of borders and restrictions in use of lands with coordinates of rotary points of such borders of the territory of monuments of cultural heritage, zones of protection of objects of cultural world heritage, buffer zones, historical areas of the inhabited places, the protected archaeological territories, historical and cultural reserves and the historical and cultural reserved territories, the State land cadastre joins the following data on the specified restrictions in use of lands:

type;

restriction content;

the description of rezhimoobrazuyushchy object - the contours, names and characteristics causing establishment of restrictions;

distance from contour of rezhimoobrazuyushchy object to which restriction in use of lands extends;

information on documents based on which restrictions in use of lands are set.

Technology and software of the State land cadastre shall provide the automated delimitation of restrictions in use of lands in the amount and cases provided by the paragraph the sixteenth this Item, by determination of distance from contour of rezhimoobrazuyushchy object without the need for work for land management by determination of coordinates of rotary points of the specified borders.

24. In the State land cadastre such data on the parcels of land are entered:

1) cadastral number according to Item 30 of this Procedure;

2) location, including data of the State address register (in the presence);

3) the description of borders with indication of the adjacent parcels of land, their owners, users of the adjacent parcels of land of the state-owned or utility property;

4) area;

5) measures of lines for perimeter;
