About modification and amendments in the resolution of Council of Ministers of the Republic of Belarus of February 8, 2016 No. 103

For the purpose of optimization of crediting of state programs and actions by banks and the open joint stock company "Development Bank of the Republic of Belarus" Council of Ministers of the Republic of Belarus DECIDES:

1. Bring in the resolution of Council of Ministers of the Republic of Belarus of February 8, 2016 No. 103 "About crediting of state programs and actions in 2016" (The national legal Internet portal of the Republic of Belarus, 12.02. 2016, 5/41678; 23:07. 2016, 5/42376; 26.08. 2016, 5/42523; 10:09. 2016, 5/42585; 19:11. 2016, 5/42923) following changes and amendments:

1.1. "*" to the paragraph of Item 1 to state the interlinear note to the second in the following edition:

* For the purposes of this resolution directive crediting is understood as the crediting performed:

"Development Bank of the Republic of Belarus" open joint stock company, except for the loans granted by the called society at the expense of the funds raised within international treaties, and also resources provided by international financial institutions of the export loans granted to the organizations which are not residents of the Republic of Belarus including foreign banks and to the leasing organizations which are residents of the Republic of Belarus on the terms of the Presidential decree of the Republic of Belarus of August 25, 2006 No. 534 "About assistance to commodity export development (works, services)" (The national register of legal acts of the Republic of Belarus, 2006, No. 143, 1/7870), financings of activities of subjects of small and medium entrepreneurship in which authorized funds the share of the Republic of Belarus or its administrative and territorial units does not exceed 25 percent, according to the resolution of Council of Ministers of the Republic of Belarus of March 11, 2016 No. 195 "About financing of activities of subjects of small and medium entrepreneurship by "Development Bank of the Republic of Belarus" open joint stock company in 2016" (The national legal Internet portal of the Republic of Belarus, 15.03. 2016, 5/41802), the loans granted for projects implementation of public-private partnership;

banks of the Republic of Belarus under condition:

compensations from means republican and (or) local budgets of losses of banks from loan granting on favorable terms;

compensations (payment) to legal entities from means republican and (or) local budgets of interest for using bank loans or their part;

purpose-oriented crediting at the expense of temporarily available funds of the republican budget, and also means of state non-budgetary funds placed in bank deposit (deposit);

provisions of guarantees for the Government of the Republic of Belarus, local executive and administrative organs on the credits issued by banks of the Republic of Belarus according to regulatory legal acts;

determinations by the decision of the President of the Republic of Belarus and (or) the Government of the Republic of Belarus of the specific borrower, except for the loans granted by banks at the expense of the funds raised within international treaties, and also resources provided by international financial institutions.";

1.2. state Item 2 in the following edition:

"2. To "Development Bank of the Republic of Belarus" open joint stock company in 2016 to perform directive crediting according to funding plan by the "Development Bank of the Republic of Belarus" open joint stock company of state programs and actions in 2016 approved by this resolution (further - funding plan), according to the procedure and on the conditions established in regulatory legal acts in the presence of resources, having provided in local regulatory legal acts the procedure of decision making about crediting of new investment projects *, including on construction of molochnotovarny farms, on the basis of competitive selection.";

1.3. the paragraph one of Item 3 after the word Belvneshekonombank to add with the word", Paritetbank;

"6. Determine that:

6.1. crediting in the amounts exceeding limits, and of the directions of directive crediting which are not provided by this resolution is performed without rendering the state support if other is not established by legal acts;

6.2. provision of delays (payments by installments) of return (repayment) of the amounts of principal debt on the loans granted by banks, "Development Bank of the Republic of Belarus" open joint stock company within directive crediting is performed without compensation (payment) of interest for using bank loans (compensation of losses of banks) on outstanding amount on the credits which terms of return were prolonged, except as specified provisions of delays (payments by installments) within the current calendar year and also if other does not follow from decisions of the President of the Republic of Belarus;

6.3. compensation (payment) of part of interest for using bank loans (compensation of losses of banks) is made within the means provided in the republican budget on these purposes in 2016 and performed on condition of provision along with requests for money transfer by banks, "Development Bank of the Republic of Belarus" open joint stock company - in the Ministry of Finance, other receivers of budgetary funds - in territorial authorities of the Ministry of Finance of the letter of the crediting bank, confirmatory that since December 5, 2016 on the credits delays (payments by installments) of return (repayment) of the amounts of principal debt, and on the loans granted according to this resolution - also confirmatory were not granted that such crediting is performed within the limits of directive crediting approved by this resolution for the answering purpose.";

1.5. to be reworded as follows the general directions and limits of directive crediting of state programs and actions in 2016 approved by this resolution (are applied);
