About introduction of amendments to the Resolution of the Cabinet of Ministers of Ukraine of May 12, 2007 No. 705 and recognition voided some resolutions of the Cabinet of Ministers of Ukraine
The Cabinet of Ministers of Ukraine decides:
1. Bring in the resolution of the Cabinet of Ministers of Ukraine of May 12, 2007 No. 705 "About some questions of implementation of the Law of Ukraine "About quarantine of plants" (The Official Bulletin of Ukraine, 2007, No. 37, Art. 459; 2009, No. 72, Art. 2487; 2010, No. 16, Art. 755; 2011, No. 61, Art. 2439; 2015, No. 12, the Art. 316) changes which are applied.
2. Agree with the offer of the Ministry of Agricultural Policy and Food on application of unused forms of the quarantine, phytosanitary and phytosanitary certificates on re-export made in accordance with the established procedure within nine months from the date of entry into force of this resolution.
3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

1. In the resolution:
1) in the prolog of figure "4, 16, 26 and 37" to replace with figures "16, 26, 29 and 46";
2) in Item 1:
state paragraph two in the following edition:
"Procedure for carrying out survey, inspection, analysis, disinfecting and inspection (execution of phytosanitary and quarantine certificates) of subjects to regulation;";
third to exclude the paragraph;
the fourth to replace the paragraph with paragraphs of the following content:
"The list of subjects to regulation for the purposes of control of movement on the territory of Ukraine;
the list of subjects to regulation for the purposes of import, export and re-export.";
3) in Item 3:
word in paragraph one to "The public veterinary and phytosanitary service" shall be replaced with words "To public service on safety issues of foodstuff and consumer protections";
in the paragraph the second words", quarantine permissions" to exclude.
2. To state the procedure for carrying out survey, inspection, the analysis, fumigation (disinfecting) and inspection (execution of phytosanitary and quarantine certificates) of subjects to regulation in the field of quarantine of plants approved by the specified resolution in the following edition:
"No. 705 is approved by the Resolution of the Cabinet of Ministers of Ukraine of May 12, 2007
(in edition of the Resolution of the Cabinet of Ministers of Ukraine of November 16, 2016 No. 829)
1. This Procedure determines the procedure of carrying out survey, inspection, the analysis, disinfecting and inspection (execution of phytosanitary and quarantine certificates) of subjects to regulation.
2. In this Procedure the term "disinfecting" means processings (physical, chemical or biological), including fumigation, directed to liquidation of harmful organisms.
Other terms in this Procedure are used in the value given in article 1 of the Law of Ukraine "About quarantine of plants".
3. Results of survey, inspection, control of disinfecting are drawn up by the state phytosanitary inspector in the form of the act (appendix 1) in duplicate: the first copy is issued to the representative of the owner of object (objects) of regulation, the second - remains in body of Gosprodpotrebsluzhby which issued it.
4. Subjects to regulation in the field of quarantine of plants for the purposes of control of movement on the territories of Ukraine and subjects to regulation in the field of quarantine of plants for the purposes of import, export and re-export are subject to survey by the state phytosanitary inspector.
5. Inspection of subjects to regulation is performed by inspection during which sampling for conducting phytosanitary examination is performed.
6. In case of warehousing, concentration (accumulating) and sorting in sea and river ports, at railway stations, terminals and in avtoporta of subjects to regulation their inspection is performed.
7. For ensuring sampling in case of survey of crops, landings of plants, long-term plantings, storage facilities are used feromonny traps, food baits and lovilny belts.
8. For the purpose of determination of phytosanitary condition of subjects to regulation the state phytosanitary inspectors conduct systematic examinations of lands of agricultural purpose and lands of forest fund, Items of quarantine of plants and the territory (three-kilometer zone) adjoining to them, places of the address of subjects to regulation.
Inspection of the corresponding territory within zone (area) are carried out by the state phytosanitary inspector during vegetation of cultural plants with such frequency:
each half a year - on site production or production area on which it is officially established and the status free from regulated harmful organisms is supported;
annually - in the territories where elite seeds and landing (landing) material, at the state sorto-research stations, in nurseries, introduktsionno-quarantine nurseries and quarantine greenhouses of botanical gardens are grown up, in the territories where plants from import seed and landing material, and also in the territories of quarantine and regulated zones are grown up;
every two years - in the territories where production and conversion of agricultural products, on lands of persons where quarantine organisms, and in the territories adjoining to them are not revealed is performed.
9. For carrying out inspection specialists of organizations concerning quarantine of the plants belonging to the sphere of management of Gosprodpotrebsluzhby can be attracted (further - specialists).
For the purpose of involvement of the specialist the state phytosanitary inspector addresses to organization concerning quarantine of plants which treats the sphere of management of Gosprodpotrebsluzhby.
The state phytosanitary inspector determines the area and method of inspection.
The specialist in case of inspection of certain area selects samples of subjects to regulation, harmful and regulated harmful organisms about what constitutes the certificate of inspection (appendix 2) which together with the selected samples gives to the state phytosanitary inspector.
The state phytosanitary inspector for the purpose of conducting phytosanitary examination directs the inspections which are selected during samples to phytosanitary laboratory.
By results of the carried-out phytosanitary procedures the state phytosanitary inspector draws up the statement of inspection (appendix 3).
