About conscription and military service

Chapter 1. GENERAL PROVISIONS

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) military service - special type of public service of the military personnel in Armed forces, other troops and military forming;

2) the military personnel is the citizens of the Republic of Kazakhstan who are in the military service in Armed forces, other troops and military forming;

3) persons liable for call-up are the citizens of the Republic of Kazakhstan staying on the military registry and staying in inventory to age limit of condition on military accounting;

4) military rank - the sign of military distinction appropriated to the serviceman and the person liable for call-up;

5) conscription - the constitutional obligation of citizens of the Republic of Kazakhstan on protection of the Republic of Kazakhstan;

13) pupils are the citizens of the Republic of Kazakhstan studying in the organizations of general secondary, technical and professional, postsecondary education with additional educational programs for military preparation;

14) general military education - compulsory education of citizens of the Republic of Kazakhstan to basic military training during introduction of warlike situation;

15) youths of premilitary age are the male citizens having training for military service before acceptance on military accounting;

The inventory of persons liable for call-up (stocked) 16) - the persons liable for call-up staying on the military registry in local authorities of military management of areas (the cities of regional value), used for the purpose of fitting, expansion and completion of losses of Armed forces, other troops and military forming;

17) the contract on passing of military service (further - the contract) the agreement establishing obligations and responsibility of the parties for the benefit of providing and execution of military service;

18) cadets are the military personnel of lists of soldiers (sailors), sergeants (foremen) studying in teaching departments (centers), average or highest military educational institutions;

19) mobilization - complex of the nation-wide actions connected with transfer of state bodies, organizations, Armed forces, other troops and military forming, the populations, the territories and economies of the Republic of Kazakhstan on the mode of warlike situation (general mobilization) or their any part (partial mobilization);

20) basic military training - obligatory subject of training (subject matter) in fundamentals of military science and safety and life activity of the person;

21) organizational and regular actions - the events held in Armed forces, other troops and military forming on creation, liquidation, re-deployment, reorganization, resubordination, increase and staff reduction;

22) delay - transfer of appeal of citizens on military service on the bases provided by this Law;

23) resignation - dismissal of the military personnel from military service or exception from military accounting of the persons liable for call-up who reached age limit of stay in inventory or persons recognized not suitable for military service with exception from military accounting;

24) officers are the military personnel to whom the corresponding military ranks of officers are given;

25) testing charges - type of the military charges which are carried out for the purpose of check of readiness of the military units intended to accomplishment of tasks in organizational and regular structure of wartime;

26) recruits are the male citizens attributed to draft sites of local authorities of military management of areas (the cities of regional value) and who are subject to conscription, other troops and military forming for passing of conscription military service;

27) the draft site - the site formed by local executive bodies of areas (the cities of regional value) for appeal and addition of citizens to draft sites;

28) recruiting station - Item of performing medical examination of citizens in case of addition to draft sites and their appeal on military service, and also military patriotic and sports and mass work;

29) stay in inventory - execution by persons liable for call-up of the obligations connected with military accounting and service on military charges during stay on military accounting;

30) the assembly point - Item of performing control medical examination of recruits, medical care, military patriotic, sports and mass work, forming and sending teams of recruits to Armed forces, other troops and military forming;

31) sergeants (foremen) are the military personnel to whom the military ranks of list of sergeants (foremen) are given;

32) soldiers (sailors) are the military personnel to whom the military ranks of list of soldiers (sailors) are given;

33) listeners are military personnel of officers, students in the highest military educational institutions, on advanced training courses (retraining) of officers;

34) special charges - type of military charges, the events for mitigation of consequences of emergency situations held for the purpose of accomplishment and in other cases determined by the President of the Republic of Kazakhstan;

35) conscription military service - the military service of male citizens based on their conscription, other troops and military forming according to the procedure determined by this Law;

36) training sessions - type of the military charges which are carried out for the purpose of preparation and retraining of persons liable for call-up.
