About procedure for provision of political asylum to foreign citizens and stateless persons in the Republic of Kazakhstan
This instruction is developed on the basis of the Provision "About Procedure for Provision of Political Asylum to Foreign Citizens and Stateless Persons" approved by the Presidential decree of the Republic of Kazakhstan N 3057 of 15.07.1996 and is intended for practical use by diplomatic representations and consular establishments of the Republic of Kazakhstan abroad.
1. The political asylum in the Republic of Kazakhstan is granted to foreign citizens and stateless persons (further - persons) based on the universally recognized norms of international law, according to the Constitution of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan and the Provision "About Procedure for Provision of Political Asylum to Foreign Citizens and Stateless Persons".
2. The Republic of Kazakhstan grants political asylum to persons and members of their families who are looking for shelter and protection against prosecution or real threat to fall victim of prosecution in the country of nationality and/or accommodation for social and political activities, racial or national identity, for religious beliefs, and also in the cases of human rights violation provided by rules of international law.
3. The decision on provision of political asylum or on refusal in provision of political asylum in the Republic of Kazakhstan is accepted by the President of the Republic of Kazakhstan.
4. The political asylum in the Republic of Kazakhstan is not granted if person:
1) it is pursued for the actions (or failure to act) recognized by the legislation of the Republic of Kazakhstan crime or he is guilty of making of the actions contradicting the purposes and the principles of the United Nations;
