About modification of separate legal acts of the Russian Federation for the purpose of enhancement of the legislation regulating tourist activities

Article 1

Bring in the Federal Law of November 24, 1996 No. 132-FZ "About bases of tourist activities in the Russian Federation" (The Russian Federation Code, 1996, No. 49, Art. 5491; 2003, No. 2, Art. 167; 2004, No. 35, Art. 3607; 2007, No. 7, Art. 833; 2009, No. 1, Art. 17; No. 26, Art. 3121; No. 52, Art. 6441; 2010, No. 32, Art. 4298; 2011, No. 27, Art. 3880; 2012, No. 19, Art. 2281; 2015, No. 27, Art. 3946) following changes:

1) in Article 1:

a) the twenty fifth to state the paragraph in the following edition:

"the emergency help - actions on the organization of transportation of the tourist from the country of temporary stay (fee on transportation) and (or) other actions (including fee on placement) performed by merging of tour operators in the field of outbound tourism according to this Federal Law in connection with non-execution of agreement obligations by tour operator on realization of tourist product regarding non-rendering fully or partially to the tourist of the services in transportation and (or) placement entering it;";

b) add with paragraphs of the following content:

"the electronic permit - the document created on the basis of the agreement on realization of tourist product by tour operator or the travel agent in electronic form taking into account the features determined by this Federal Law;

tourism children's - tourism of organized group of minor tourists accompanied by the head who performs duties of their legal representative;

system of navigation and orientation in the field of tourism - set of information, necessary for orientation of tourists, on tourist resources and on objects of the tourist industry and means of placement of such information (the information signs, designs, constructions, technical devices and other carriers intended for distribution of information, except for the advertizing structures);

tourist information center - the organization performing activities for informing physical persons on tourist resources and about objects of the tourist industry and also to promotion of tourist products in the internal and world tourist markets.";

To add 2) with Article 3.1 of the following content:

"Article 3.1. Powers of public authorities of the Russian Federation in the field of tourism

In the field of tourism treat powers of public authorities of the Russian Federation:

development and realization of state policy in the field of tourism, including forming of the legal basis of the single tourist market in the Russian Federation, determination of the priority directions of tourism development in the Russian Federation;

development, approval (approval) and implementation of documents of strategic planning in the field of tourism on the questions carried to maintaining the Russian Federation;

creation and providing favorable conditions for development of the tourist industry in the Russian Federation;

establishment of procedure for rendering services in realization of tourist product;

establishment of procedure and conditions of rendering the emergency help to tourists;

establishment of procedure and financing terms of expenses on rendering the emergency help to tourists from reserve fund of merging of tour operators in the field of outbound tourism (further also - reserve fund);

establishment of requirements to selection criteria of credit institutions in which investment of funds of reserve fund is allowed, funds of the personal responsibility of tour operators in the field of outbound tourism (further also - fund of the personal responsibility of tour operator);

forming and maintaining the unified federal register of tour operators;

establishment of procedure of classification of the objects of the tourist industry including hotels and other means of placement, ski slopes, beaches;

establishment of procedure for carrying out accreditation of the organizations performing classification of the objects of the tourist industry including hotels and other means of placement, ski slopes, beaches;

approval of the rules of professional activity regulating procedure merging of tour operators in the field of outbound tourism and its members of the functions connected with forming and use of reserve fund;

development of national standards of the Russian Federation in the field of tourism, professional standards;

tourism safety, protection of the rights and legitimate interests of tourists in the territory of the Russian Federation and outside its territory;

informing tour operators, travel agents and tourists (tourists) on safety hazard of tourists (tourists) in the country (place) of temporary stay;

information support of tourism, including assistance in creation and functioning of tourist information centers, systems of navigation and orientation in the field of tourism;

assistance in creation and providing favorable conditions for easy access of tourists (tourists) to the tourist resources which are in the territories of subjects of the Russian Federation and to means of communication, and also obtaining medical, legal and other types of emergency aid;

the organization and holding actions for promotion of tourist products in the field of internal tourism and entrance tourism in the internal and world tourist markets;

the organization of carrying out scientific research in the field of tourism;

assistance in the organization of professional training for programs of training of specialists in the field of tourism in accordance with the legislation of the Russian Federation;

organization of the state awards of the Russian Federation, awards and other forms of encouragement of the Russian Federation in the field of tourism;

development and approval of the forms of the statistical reporting applied in the field of tourism;

the organization and holding the All-Russian and interregional actions directed to support of the priority directions of tourism development, including to development of internal tourism, entrance tourism, social tourism, children's tourism and amateur tourism (further - actions in the field of tourism), approval and implementation of the schedule of actions in the field of tourism;

implementation of interaction with the non-profit organizations performing activities in the field of tourism including merging of tour operators in the field of outbound tourism, including in the priority directions of tourism development, questions of safety of tourism, protection of the rights and legitimate interests of tourists;

implementation of interaction with foreign states, the international organizations in the field of tourism, including through representations of the representative the Government of the Russian Federation of federal executive body outside the Russian Federation;

participation in the organization of the international actions in the field of tourism;

coordination of sales activity of intergovernmental agreements in the field of tourism;

development and the organization of realization of package of measures for the organization of excursions and travel with the cultural and cognitive purposes for students in the general education organizations;

other powers established by this Federal Law, other Federal Laws, regulatory legal acts of the President of the Russian Federation, regulatory legal acts of the Government of the Russian Federation.";

To add 3) with Article 3.2 of the following content:

"Article 3.2. Powers of public authorities of subjects of the Russian Federation on creating favorable conditions for tourism development in subjects of the Russian Federation

On creating favorable conditions for tourism development in subjects of the Russian Federation treat powers of public authorities of subjects of the Russian Federation:

determination of the main objectives in the field of tourism and the priority directions of tourism development in subjects of the Russian Federation;

development, approval (approval) and implementation of documents of strategic planning in the field of tourism on the questions carried to powers of subjects of the Russian Federation;

creating favorable conditions for development of the tourist industry in subjects of the Russian Federation;

creation and providing favorable conditions for easy access of tourists (tourists) to the tourist resources which are in the territories of subjects of the Russian Federation and to means of communication, and also obtaining medical, legal and other types of emergency aid;

implementation of measures for creation of system of navigation and orientation in the field of tourism in the territories of subjects of the Russian Federation;
