About bases of tourist activities in the Russian Federation

This Federal Law determines the principles of the state policy directed to establishment of the legal basis of the single tourist market in the Russian Federation and governs the relations arising in case of realization of the rights of citizens of the Russian Federation, foreign citizens and stateless persons on rest, freedom of travel and other rights when making travel and also determines procedure for rational use of tourist resources of the Russian Federation.

Chapter I. General provisions

Article 1. Basic concepts

The institutes, concepts and terms of the civil, family legislation and other industries of the legislation of the Russian Federation used in this Federal Law are applied in that value in which they are used in these industries of the legislation if other is not provided by this Federal Law. For the purpose of this Federal Law the following basic concepts are used:

tourism - temporary departures (travel) of citizens of the Russian Federation, foreign citizens and stateless persons (further - persons) from the permanent residence in medical and improving, recreational, cognitive, sports, professional and business and other purposes without occupation the activities connected with income acquisition from sources in the country (place) of temporary stay;

tourist activities - tour operator and tourist's agency activities, and also other activities for the organization of travel;

tourism internal - tourism within the territory of the Russian Federation persons who are constantly living in the Russian Federation;

outbound tourism - tourism of persons who are constantly living in the Russian Federation to other country;

tourism entrance - tourism within the territory of the Russian Federation persons who are not living constantly in the Russian Federation;

tourism international - tourism exit or entrance;

tourism social - the tourism fully or partially performed at the expense of budgetary funds, means of state non-budgetary funds (including the funds allocated within the government public assistance), and also means of employers;

tourism amateur - the tourism organized by tourists independently;

the tourist - person visiting the country (place) of temporary stay in medical and improving, recreational, cognitive, sports, professional and business and other purposes without occupation the activities connected with income acquisition from sources in the country (place) of temporary stay, from 24 hours to 6 months in a row or performing at least one spending the night in the country (place) of temporary stay;

tourist resources - the natural, historical, welfare objects including subjects to tourist display, and also other objects capable to satisfy spiritual and other needs of tourists, to promote maintenance of their life activity, recovery and development of their physical forces;

the tourist industry - set of means of placement, automobiles, objects of sanatorium treatment and rest, objects of public catering, objects and means of entertainment, subjects to cognitive, business, medical and improving, sports and other appointment, the organizations performing tour operator and tourist's agency activities, operators of tourist information systems, the organizations, and also the individual entrepreneurs and physical persons applying special tax regime "Tax on the professional income" according to the Federal Law of November 27, 2018 No. 422-FZ "About carrying out experiment on establishment of special tax regime "Tax on the professional income" (further - the physical persons applying special tax regime) and the guides (guides), guide-interpreters and instructors-conductors providing services;

tourist product - range of services on transportation and placement, rendered for total price (irrespective of inclusion in total price of cost of excursion servicing and (or) other services) under the agreement on realization of tourist product;

tour operator activities - the activities for forming, promotion and realization of tourist product performed by the legal entity (further - tour operator);

tourist's agency activities - the activities for promotion and realization of tourist product performed by the legal entity or the individual entrepreneur, data on whom are entered in the unified federal register of travel agents, subagents according to the procedure, provided by this Federal Law (further - the travel agent);

the subagent - the legal entity or the individual entrepreneur to whom the travel agent transfers execution of the order of tour operator to promotion and realization of tourist product according to the procedure, provided by this Federal Law, and data on whom are entered in the unified federal register of travel agents, subagents according to the procedure, provided by this Federal Law;

the customer of tourist product - the tourist or the other person ordering tourist product on behalf of the tourist including the legal representative of the minor tourist;

forming of tourist product - activities of tour operator for the conclusion and execution of contracts with the third parties rendering the separate services entering tourist product (means of placement, carriers, guides (guides) and others);

promotion of tourist product - package of measures, directed to realization of tourist product (advertizing, participation in specialized exhibitions, fairs, the organization of tourist information centers, the edition of catalogs, booklets and another);

realization of tourist product - activities of tour operator or travel agent for the conclusion of the contract on realization of tourist product with the tourist or other customer of tourist product, and also activities of tour operator and (or) the third parties on rendering services to the tourist according to this agreement;

the tourist - the person visiting the country (place) of temporary stay in the cognitive purposes for less than 24 hours without spending the night in the country (place) of temporary stay and using services of the guide (guide), the guide-interpreter, the instructor-conductor;

the guide (guide) - person who is the citizen of the Russian Federation if other is not provided by international treaties of the Russian Federation, undergone certification, rendering in presentia services in acquaintance of tourists (tourists) with subjects to display, escort of tourists (tourists) and informing tourists (tourists) in transit in tourist route based on the agreement signed in accordance with the legislation of the Russian Federation;

the guide-interpreter - person who is the citizen of the Russian Federation if other is not provided by international treaties of the Russian Federation, undergone certification, fluent in foreign language which knowledge is necessary for rendering in presentia for tourists (tourists) of services of the guide-interpreter in acquaintance of tourists (tourists) with subjects to display, escort of tourists (tourists) and informing tourists (tourists) on the way along tourist route. Rendering services of the guide-interpreter is performed based on the agreement signed in accordance with the legislation of the Russian Federation;

the instructor-conductor - the person who underwent certification, accompanying tourists (tourists) and ensuring their safety when passing tourist route (part of tourist route) determined by the Government of the Russian Federation of type and category of complexity when which passing by tourists (tourists) special maintenance is required (further - the tourist route requiring special maintenance);

the paragraph of ceased to be valid according to the Federal Law of the Russian Federation of 03.05.2012 No. 47-FZ

the emergency help - actions on the organization of transportation of the tourist from the country of temporary stay (fee on transportation) and (or) other actions (including fee on placement) performed by merging of tour operators in the field of outbound tourism according to this Federal Law in case of non-execution of the agreement obligations by tour operator on realization of tourist product in the field of outbound tourism regarding non-rendering fully or partially to the tourist of the services in transportation and (or) placement entering it in connection with the termination of tour operator activities for the reason of impossibility of performance of all agreement obligations about realization of tourist product;

the electronic permit - the document created electronically in unified information system of electronic permits on the basis of the data containing in the agreement on realization of tourist product and provided by tour operator according to the procedure established by this Federal Law;

rural tourism - the tourism providing visit of the rural zone, the small cities with population to thirty thousand people for the purpose of rest, familiarizing with traditional tenor of life and customs of the people of the Russian Federation, acquaintance with the objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation connected with agricultural industry and also acquaintance with agricultural production and (or) participation in agricultural works without extraction of material benefit with possibility of use of services in temporary placement, the organization of leisure, excursion and other services;

tourism children's - tourism of organized group of minor tourists accompanied by the head who performs duties of their legal representative;

system of navigation and orientation in the field of tourism - set of information, necessary for orientation of tourists, on tourist resources and on objects of the tourist industry and on methods of placement of such information (the information signs, designs, constructions, technical devices and other carriers intended for distribution of information, except for the advertizing structures);

tourist information center - the organization performing activities for informing physical persons and legal entities on tourist resources and about objects of the tourist industry and also to promotion of tourist products in the internal and world tourist markets;

tourist route - the transit of tourists (tourists) including visit and (or) use of tourist resources;

means of placement - the property complex including the building (part of the building) or structure, construction, the room, the land area, the equipment and other property and used for temporary accommodation and ensuring temporary residence of physical persons. Premises, except as specified, provided by other Federal Laws do not belong to means of placement;

hotel - type of means of placement in which hotel services are provided and which conforms to the requirements established by the regulations on classification of means of placement approved by the Government of the Russian Federation;

hotel services - range of services on provision to physical persons of places for temporary residence in hotel and other services provided by the Rules of provision of hotel services in the Russian Federation approved by the Government of the Russian Federation which are provided by individual entrepreneurs and legal entities;

classification of means of placement - assignment to means of placement of the certain type established by the regulations on classification of means of placement approved by the Government of the Russian Federation and in the presence of the conditions established by the rules of classification of means of placement approved by the Government of the Russian Federation, certain category based on assessment of conformity of means of placement and services provided in them to the requirements established by the specified provision;

classification of ski slopes, classification of beaches - assignment to the ski slope, the beach of the certain category established by the rules of classification of ski slopes, classifications of beaches approved by authorized federal executive body based on assessment of conformity of ski slopes, beaches to the requirements established by these rules;

national tourist route - the tourist route having special value for development of internal tourism and entrance tourism and determined by authorized federal executive body according to the procedure established by the Government of the Russian Federation;

unified information system of electronic permits - the state information system functioning on the basis of program, technical means and information technologies and providing collection, processing, storage, provision, placement and use of the data containing in agreements on realization of tourist product, and other data which are subject to representation by tour operator in unified information system of electronic permits, according to the procedure, established by this Federal Law;

services of means of placement - hotel services, services of other means of placement including range of services on provision to physical persons of places for temporary residence in means of placement, and also other services in servicing of the physical persons living in means of placement.

Article 2. Legislation of the Russian Federation on tourist activities

The legislation of the Russian Federation on tourist activities consists of this Federal Law, the Federal Laws and other regulatory legal acts of the Russian Federation, and also the laws and other regulatory legal acts of subjects of the Russian Federation adopted according to it.

The laws and other regulatory legal acts of subjects of the Russian Federation regulating tourist activities cannot contradict this Federal Law and the Federal Laws adopted according to it.

The regulations containing in other laws and regulatory legal acts regulating tourist activities shall not contradict this Federal Law.

The features of implementation of tourist activities connected with the organization and holding the XXII Olympic winter Games and the XI Paralympic Winter Games of 2014 in the city of Sochi are established by the Federal Law of December 1, 2007 N 310-FZ "About the organization and about holding the XXII Olympic winter Games and the XI Paralympic Winter Games of 2014 in the city of Sochi, development of the city of Sochi as mountain resort and modification of separate legal acts of the Russian Federation".

Operation of this Federal Law does not extend to the pilgrim activities performed by the religious organizations and to making and the organization by pilgrims of own pilgrim trips according to the Federal Law of September 26, 1997 No. 125-FZ "About liberty of conscience and about religious associations".

Chapter II. State regulation of tourist activities

Article 3. Principles of state regulation of tourist activities

The state, recognizing tourist activities of one of priority industries of economy of the Russian Federation,

promotes tourist activities and creates favorable conditions for its development;

determines and supports the priority directions of tourist activities;

creates idea of the Russian Federation as to the country favorable for tourism;

performs support and protection of the Russian tourists, tour operators, travel agents and their associations.

Article 3.1. Powers of public authorities of the Russian Federation in the field of tourism

In the field of tourism treat powers of public authorities of the Russian Federation:

development and realization of state policy in the field of tourism, including forming of the legal basis of the single tourist market in the Russian Federation, determination of the priority directions of tourism development in the Russian Federation;

development, approval (approval) and implementation of documents of strategic planning in the field of tourism on the questions carried to maintaining the Russian Federation;

creation and providing favorable conditions for development of the tourist industry in the Russian Federation;

establishment of procedure for rendering services in realization of tourist product;

establishment of procedure and conditions of rendering the emergency help to tourists;

establishment of procedure and financing terms of expenses on rendering the emergency help to tourists from reserve fund of merging of tour operators in the field of outbound tourism (further also - reserve fund);

establishment of requirements to selection criteria of credit institutions in which investment of funds of reserve fund is allowed, funds of the personal responsibility of tour operators in the field of outbound tourism (further also - fund of the personal responsibility of tour operator);

forming and maintaining the unified federal register of tour operators;

approval of regulations on classification of means of placement;

establishment of procedure for accreditation and confirmation of competence of the organizations performing classification of means of the placement, classification of ski slopes, classification of beaches (further respectively - the organizations performing classification in the field of the tourist industry, subjects to classification in the field of the tourist industry) including procedure for certification of experts in classification;

accreditation of the organizations performing classification in the field of the tourist industry and also confirmation of competence of the organizations performing classification in the field of the tourist industry;

approval of the notification procedure by the organization performing classification in the field of the tourist industry, authorized bodies of the government of subjects of the Russian Federation about the planned implementation of classification of subjects to classification in the field of the tourist industry in the territory of appropriate subjects of the Russian Federation including the list and the description of the data containing in such notification;

approval of rules of classification of ski slopes, classifications of beaches;

establishment of procedure for forming and maintaining the register of the organizations performing classification in the field of the tourist industry;

establishment of procedure for forming and maintaining the unified register of subjects to classification in the field of the tourist industry;

the organization of forming and maintaining the register of the organizations performing classification in the field of the tourist industry, and the unified register of subjects to classification in the field of the tourist industry;

approval of rules of provision of hotel services, and also in need of rules of provision of services of other means of placement;

approval of the rules of professional activity regulating procedure merging of tour operators in the field of outbound tourism and its members of the functions connected with forming and use of reserve fund;

development of national standards of the Russian Federation in the field of tourism, professional standards;

tourism safety, protection of the rights and legitimate interests of tourists in the territory of the Russian Federation and outside its territory;

informing tour operators, travel agents and tourists (tourists) on safety hazard of tourists (tourists) in the country (place) of temporary stay;

information support of tourism, including assistance in creation and functioning of tourist information centers, systems of navigation and orientation in the field of tourism;

assistance in creation and providing favorable conditions for easy access of tourists (tourists) to the tourist resources which are in the territories of subjects of the Russian Federation and to means of communication, and also obtaining medical, legal and other types of emergency aid;

the organization and holding actions for promotion of tourist products in the field of internal tourism and entrance tourism in the internal and world tourist markets;

the organization of carrying out scientific research in the field of tourism;

assistance in the organization of professional education, additional education and professional training in the field of tourism;

organization of the state awards of the Russian Federation, awards and other forms of encouragement of the Russian Federation in the field of tourism;

approval of methodical recommendations about development and implementation of state programs of the subject of the Russian Federation and municipal development programs of tourism;

development and approval of the forms of the statistical reporting applied in the field of tourism;

the organization and holding the All-Russian and interregional actions directed to support of the priority directions of tourism development, including to development of internal tourism, entrance tourism, social tourism, rural tourism, children's tourism and amateur tourism (further - actions in the field of tourism), approval and implementation of the schedule of actions in the field of tourism;

implementation of interaction with the non-profit organizations performing activities in the field of tourism including merging of tour operators in the field of outbound tourism, including in the priority directions of tourism development, questions of safety of tourism, protection of the rights and legitimate interests of tourists;

implementation of interaction with foreign states, the international organizations in the field of tourism, including through representations of the representative the Government of the Russian Federation of federal executive body outside the Russian Federation;

the organization of the international actions in the field of tourism including directed to forming of idea of the Russian Federation as to the country favorable for tourism, disclosure of tourist capacity of the Russian Federation and subjects of the Russian Federation;

coordination of sales activity of intergovernmental agreements in the field of tourism;

establishment of procedure for maintaining the unified federal register of travel agents, subagents (further - the register of travel agents);

maintaining register of travel agents;

development and the organization of realization of package of measures for the organization of excursions and travel with the cultural and cognitive purposes for students in the general education organizations;

establishment of procedure for placement of data on national tourist routes and about guides (about guides) or about the guide-interpreters who underwent certification for national tourist routes on the official site of authorized federal executive body on the Internet and placement of such data;

approval of the list of the organizations authorized on carrying out certification of instructors-conductors;

establishment of procedure for determination of national tourist routes;

maintaining the unified federal register of guides (guides) and guide-interpreters, forming and maintaining the unified federal register of instructors-conductors;

establishment of procedure for reference of tourist route (part of tourist route) to the tourist routes requiring special maintenance including procedure for placement of data on the tourist routes requiring special maintenance;

establishment of rules of rendering services of the guide (guide), guide-interpreter, rules of rendering services of the instructor-conductor;

establishment of types of the tourist routes requiring special maintenance, categories of their complexity, and also criteria of reference of tourist route to the corresponding category of complexity including taking into account safety of tourists (tourists);

approval of form of breast identification card of the instructor-conductor;

other powers established by this Federal Law, other Federal Laws, regulatory legal acts of the President of the Russian Federation and regulatory legal acts of the Government of the Russian Federation;

determination of the main objectives in the field of tourism and the priority directions of tourism development in subjects of the Russian Federation;

participation in information support of tourism, creation in subjects of the Russian Federation of tourist information centers and ensuring their functioning;

creation of certifying commission for certification of guides (guides) and guide-interpreters, introduction of information about guides (about guides) and about guide-interpreters in the unified federal register of guides (guides) and guide-interpreters;

approval of form of breast identification card of the guide (guide) or guide-interpreter;

the organization and implementation of regional state control (supervision) in the field of the tourist industry, and also approval of regulations on this type of control (supervision);

approval of regulations on the certifying commission performing certification of guides (guides) or guide-interpreters, including structure of the specified certifying commission;

other established by this Federal Law, other Federal Laws of power.

Public authorities of subjects of the Russian Federation in the field of tourism have the right:

participate in realization of state policy in the field of tourism;

participate in strategy implementation of tourism development, state programs of the Russian Federation, federal target and other development programs of tourism;

participate in the organization and holding the international actions in the field of tourism, actions in the field of tourism at the All-Russian and interregional level;

participate in the organization of professional education, additional education and professional training in the field of tourism;

participate in the organization of carrying out scientific research in the field of tourism;

perform interaction with the non-profit organizations performing activities in the field of tourism including merging of tour operators in the field of outbound tourism, including in the priority directions of tourism development, questions of safety of tourism, protection of the rights and legitimate interests of tourists;

render assistance in determination of the priority directions of tourism development, including by support of development of objects of the tourist industry in the territories of municipalities;

perform reference of tourist routes (parts of the tourist routes) passing on the territory of the subject of the Russian Federation to the tourist routes requiring special maintenance and to place data on the tourist routes requiring special maintenance on the official site on the Internet.

Article 3.3. The rights of local government bodies on creating favorable conditions for tourism development

On creating favorable conditions for tourism development treat the rights of local government bodies:

implementation of measures for development of the priority directions of tourism development in the territories of municipalities, including social tourism, rural tourism, children's tourism and amateur tourism;

assistance to creating favorable conditions for easy access of tourists (tourists) to the tourist resources which are in the territories of municipalities and to means of communication, and also obtaining medical, legal and other types of emergency aid;

the organization and holding actions in the field of tourism at the municipal level;

participation in the organization and holding the international actions in the field of tourism, actions in the field of tourism at the All-Russian, interregional, regional and intermunicipal level;

assistance in creation and functioning of tourist information centers in the territories of municipalities;

development, approval (approval) and implementation of municipal development programs of tourism.
