About introduction of amendments to some acts of the Government of the Russian Federation for the purpose of increase in efficiency of accounting of federal property

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. In 6-month time to provide to Federal Agency for State Property Management upgrade of the software of information subsystem "The automated system of accounting of federal property" of the federal state information and analytical system "Single System of Management of State-owned Property".

3. To the Ministry of Internal Affairs of the Russian Federation, the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response, Federal Agency for Sea and Inland Water Transport and Federal Air Transport Agency together with Federal Agency for State Property Management in 6-month time to develop and approve procedure for representation to Federal Agency for State Property Management (its territorial authorities) of the data necessary for accounting in the register of federal property (further - the register) and the vehicles containing respectively in the Register of registration, the register of small size vessels, the State ship register, the Russian international register of courts, the register of courts under construction and the Unified State Register of Rights on aircrafts and transactions with them.

4. To provide to Federal Agency for State Property Management (its territorial authorities):

assurance by the strengthened qualified digital signature of electronic documents and electronic images of documents for accounting of federal property in the register;

transfer to the archives of folders of the register and documents (copies of the documents) confirming the data containing in the register on papers in process of production of electronic images of the specified documents.

5. To federal executive bodies, other federal bodies of the government (federal state bodies) and the legal entities who are under their authority (concerning the federal property belonging to them on the corporeal right), and also to other organizations, the right of possession given in accordance with the legislation of the Russian Federation, uses and orders of federal property to submit documents for accounting of federal property in the register only in the form of electronic documents and electronic images of the documents certified by the strengthened qualified digital signature.

6. To federal executive bodies in 6-month time to bring the acts into accord with this resolution.

7. This resolution becomes effective after 6 months from the date of its official publication, except for Items 2, 3 and 6 these resolutions which become effective from the date of its official publication.

Changes which are made to acts of the Government of the Russian Federation

1. In Regulations on accounting, assessment and the order the property turned into property of the state, No. 311 approved by the order of the Government of the Russian Federation of May 29, 2003 "About accounting treatment, estimates and orders by the property turned into property of the state" (The Russian Federation Code, 2003, No. 22, Art. 2171; 2006, No. 14, Art. 1541; 2007, No. 34, Art. 4237):

a) declare Item 7 invalid;

b) state Item 10 in the following edition:

"10. The Federal Agency for State Property Management represents annually, no later than April 1 of the current year, to the Government of the Russian Federation the report on turnover of the property turned into property of the state, on the form approved by the Ministry of Economic Development of the Russian Federation.".

2. In the order of the Government of the Russian Federation of July 16, 2007 No. 447 "About enhancement of accounting of federal property" (The Russian Federation Code, 2007, No. 34, Art. 4237; 2009, No. 17, Art. 2095; 2010, No. 33, Art. 4435; 2011, No. 7, Art. 978; 2013, No. 5, Art. 407; No. 51, Art. 6876):

a) add Item 2 with the paragraph of the following content:

"In case of classification of data on the federal property considered in the register, all information about him and the documents confirming these data are subject to exception of the register.";

b) to replace paragraph two of Item 8 with the text of the following content:

"The request and submission of the specified documents (copies of documents) can be performed in the form of electronic documents and electronic images of the documents certified by the strengthened qualified digital signature with use of single system of interdepartmental electronic interaction or the interdepartmental portal on management of state-owned property on the Internet.

In case of submission of documents (copies of documents) in the document form on papers electronic images of documents (copies of documents) are created by Federal Agency for State Property Management (its territorial authority) independently.";

c) declare Item 12 invalid;

d) To state the regulations on accounting of federal property approved by the specified resolution in the following edition:

"It is approved by the Order of the Government of the Russian Federation of July 16, 2007 No. 447 (in edition of the Order of the Government of the Russian Federation of 16.06.2015 No. 590)

Regulations on accounting of federal property

I. General provisions

1. This Provision establishes structure of the federal property which is subject to accounting, procedure for its accounting and procedure for provision of information from the register of federal property (further - the register), and also other requirements imposed to system of accounting of federal property.

2. The concepts used in this Provision mean the following:

"the register of federal property" - the federal information system representing set of the data (documents) on federal property containing in the single database and information technologies providing processing of such data and realizing processes of accounting of federal property and provision of information about him;

"accounting of federal property" - obtaining, examination and document storage, containing data on federal property, and entering of the specified data into the register in the amount necessary for implementation of powers on management and the order of federal property;

"owner" - federal executive body (its territorial authority) or other federal body of the government (federal state body), federal state budgetary institution, federal state institution, federal autonomous institution, the federal state unitary enterprise, the federal state company or other legal or physical person to which the federal property belongs on the corporeal right or by law.

3. Objects of accounting of federal property (further - objects of accounting) is the following federal property located in the territory of the Russian Federation or abroad:

a) immovable things (the parcel of land or firmly the object connected with the earth which movement without disproportionate damage to its appointment is impossible, including the building, construction, rooms in them, object of construction in progress, single immovable complex, and also air and ocean ships which are subject to state registration, inland navigation vessels, space objects or other property carried by the law to real estate);

b) movable things (documentary securities (shares) or other property which is not relating to immovable things);

c) other property, including bank entry securities which is not relating to immovable and movable things.

4. Accounting of the natural resources (objects), precious metals and gemstones, museum objects and museum collections included in structure of Museum fund of the Russian Federation which are in federal property, and also means of the federal budget and state non-budgetary funds is regulated by the legislation on natural resources, precious metals and gemstones, museum fund and the budget legislation of the Russian Federation.

5. Accounting of the property of the Central bank of the Russian Federation which is in federal property is regulated according to the procedure, established by the Central bank of the Russian Federation in accordance with the legislation of the Russian Federation.

6. Accounting of federal property and maintaining the register perform:

a) Federal Agency for State Property Management - concerning the shares which are in federal property, shares (deposits) in the authorized (share) capital of economic societies and partnerships in which shareholder rights (participant) on behalf of the Russian Federation are performed by the Agency or other federal executive body or the state corporation;

b) territorial authorities of Federal Agency for State Property Management (further - territorial authorities) if other is not established by the Federal Laws, presidential decrees of the Russian Federation and orders of the Government of the Russian Federation, - in the relation:

the property (including the parcels of land including provided in use to legal entities and physical persons based on the relevant agreements) constituting the state treasury of the Russian Federation, located in the territory of the Russian Federation in the place of its stay according to the competence determined by regulations on territorial authorities;

the property (including the parcels of land) constituting the state treasury of the Russian Federation, located abroad;

the federal property (including the parcels of land) belonging to owners on the corporeal right in the place of state registration (for legal entities) or at the place of residence (for physical persons) in subjects of the Russian Federation in the territory of which territorial authorities perform activities (except as specified when accounting of property is within the competence of other territorial authorities).

7. The territorial authority performing accounting of the property constituting the state treasury of the Russian Federation and located in the territory of 2 and more subjects of the Russian Federation or abroad, and also belonging to the owners registered abroad is determined by Federal Agency for State Property Management if other is not established by presidential decrees of the Russian Federation and orders of the Government of the Russian Federation.

8. Accounting of federal property is followed by assignment to it register number of federal property which structure and rules of forming are established by Federal Agency for State Property Management.

9. The register is kept on electronic media in the single database and is subject to accounting in the register of federal state information systems.

10. Compatibility and interaction of the register with registers, registers and inventories which maintaining is assigned by the legislation of the Russian Federation to other federal executive bodies (further - the state information systems) are provided due to respect for the following single organizational, methodological and program and technical principles:

a) application in the register of the all-Russian qualifiers of technical and economic and social information placed in the Single system of normative reference information, the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically;

b) application by the parties participating in information exchange, digital signature facilities or other means of confirmation of lack of misstatements in documents on the electronic medium;

c) application of single protocols of telecommunication networks, document forms and formats of the data transferred on electronic media;

d) identification of users of the interdepartmental portal on management of state-owned property on the Internet (further - the interdepartmental portal) by means of unique logins and passwords, including with use of single system of identification and authentication.

11. The procedure for information exchange of Federal Agency for State Property Management with other federal executive bodies for the purpose of receipt of the data containing in the corresponding state information systems, and provision of data from the register in the form of electronic documents with use of single system of interdepartmental electronic interaction or the interdepartmental portal is determined by the specified bodies and the Agency.

12. The register consists of 3 Sections. Section 1 joins data on real estate, Section 2 joins data on personal and other estate and Section 3 joins the information about persons having rights to federal property and the information about him.

Sections consist of subsections, each of which joins data respectively on the types of real, personal and other estate and persons having rights to objects of accounting and the information about them.

Data on object of accounting and specified persons are introduced in the card of object of accounting and cards of the corresponding persons, each of which is identified by number consisting of number of subsection and sequence number of the card in the corresponding subsection (further - cards of data on object of accounting).

13. Integral part of the register are:

a) the documents confirming the data containing in cards of data on object of accounting;

b) deeds register about provision of information containing in the register, including statements (further - register of statements).

14. The form of register of statements and the instruction for its filling affirm Federal Agency for State Property Management.

15. The register is stored and processed with observance of the requirements of information security providing confidentiality, integrity, availability, accountability, authenticity and accuracy of the information.

For the purpose of prevention of loss of the data containing in the register, the Federal Agency for State Property Management creates backup copies of the register which are stored in the places excluding their loss along with originals with observance of the conditions and requirements provided for originals.

16. Maintaining the register is performed by entering of data on federal property into cards of data on object of accounting in the corresponding subsections of the register and exception of them of the changed data on the federal property belonging to owners on the corporeal right or constituting the state treasury of the Russian Federation.

17. Technical means and information technologies of information subsystem "The automated system of accounting of federal property" (further - system of accounting), and also operating procedure in system of accounting are determined by Federal Agency for State Property Management.

18. The document confirming the fact of accounting of federal property in the register is the statement from the register containing number and date of assignment of temporary or permanent register number of federal property and others data, sufficient for identification of federal property, on their condition in the register on date of issue of the statement from it.

The statement from the register containing number and date of assignment of permanent register number of federal property is the document necessary in case of transactions with federal property, except for transactions with the parcels of land and other real estate units which are in the territory of the Russian Federation and relating to federal property if according to the Federal Laws lack of state registration of the property right of the Russian Federation is not obstacle for transactions with the specified objects.

II. Accounting treatment for federal property

19. The owner for entering into the register of data on the property acquired by it under agreements or on other bases, arriving in its economic maintaining or operational management according to the procedure, established by the legislation of the Russian Federation shall in 14-day time from the date of property acquisition send to system of accounting:

a) cards of data on object of accounting in forms of the register of federal property according to appendix No. 1;

b) the documents confirming acquisition of object of accounting by the owner and emergence of the appropriate corporeal right to object of accounting, and also the documents confirming the data containing in cards of data on object of accounting.

20. Concerning the federal property belonging to the owner on the right of economic maintaining, operational management, permanent (termless) use, the life inherited tenancy or by law and not considered in the register, the owner shall in 14-day time from the date of identification of such property send cards of data on object of accounting and documents to system of accounting.

21. In case of change of data on object of accounting or about persons specified in Item 12 of this provision the owner for entering into the register of new data on object of accounting or about the corresponding person shall in 14-day time from the date of receipt of the documents confirming changes of data, or the terminations of term of the submission of accounting (financial) records established in accordance with the legislation of the Russian Federation (in case of change of book, replacement or residual cost of object of accounting or property, plant and equipment (funds) of the owner), to send to system of accounting:

a) record about changes of data on object of accounting or about person having rights to object of accounting or the information about him, in form according to appendix No. 2 (further - record about changes of data) in the card of data on object of accounting or about person having rights to object of accounting or the information about him. If the changed data contain in other cards of data on object of accounting or about person having rights to object of accounting or the information about him, then the owner directs record about changes of data concerning each of them;

b) the documents confirming new data on object of accounting or on the corresponding person.

22. The owners who resulted from reorganization of the legal entity who is the owner or the founder of the specified person to whom the federal property which remained in case of liquidation of this person is transferred direct records about changes of data and the documents confirming changes of data to system of accounting in accordance with the established procedure.

In case of change of the place of state registration (residence) of the owner of record about changes of data and the documents confirming changes of data go it at the scheduled time to system of accounting for modification by territorial authority in subject of the Russian Federation in the territory of which it was registered (constantly or mainly lives) the owner and to which the territorial authority which earlier performed accounting in the register of the object of accounting belonging to the owner transfers maps of data on object of accounting and record about changes of data, and also documents, the confirmatory data containing in them. Such procedure for the direction and transfer of maps of data on object of accounting, records about changes of data and documents is effective also in case of transition of the right of economic maintaining, operational management, permanent (termless) use or the life inherited tenancy concerning object of accounting to other owner registered (constantly or mainly living) in the territory of other subject of the Russian Federation.

The order of interaction of territorial authorities in case of change of data on federal property in cases when the changed data on the federal property which is earlier considered in the register by one territorial authority be excluded from the register by other territorial authority, including receipt of object of accounting in the state treasury of the Russian Federation, is established by Federal Agency for State Property Management.

23. If the property right of the Russian Federation to property is stopped, person to whom it belonged on the corporeal right, for exception of the register of data on property shall in 14-day time from the date of receipt of data on the termination of the specified right to send to system of accounting:

a) record about the termination of the property right of the Russian Federation to property in form according to appendix No. 3 (further - record about the termination of the property right of the Russian Federation to property) for exception of data of the card of data on object of accounting. If the termination of the property right of the Russian Federation to property attracts exception of data of other cards of data on object of accounting, then person to whom it belonged on the corporeal right, directs record concerning each of them;

b) the document confirming the termination of the property right of the Russian Federation to property or state registration of the termination of the specified right if it is real estate.

24. In case of the termination of the property right of the Russian Federation to property as a result of insolvency proceeding of his owner record about the termination of the property right of the Russian Federation to property and the document provided by the subitem "b" of Item 23 this provision go the owner to system of accounting in 14-day time from the date of receipt of the arbitration court ruling about suit abatement about bankruptcy.

25. Cards of data on object of accounting, record and the documents specified in Items 19 - 23 this provision (further - documents of the owner), go to system of accounting by the owner, person to whom the property belonged on the corporeal right, in the form of electronic documents and electronic images of the documents certified by the strengthened qualified digital signature.

In case of impossibility of the direction of documents of the owner in electronic form they are created and certified by the owner, person to whom the property belonged on the corporeal right, in territorial authority which creates necessary conditions for the direction them in system of accounting.

26. In case of liquidation of the legal entity who is the owner forming and assurance of record about the termination of the property right of the Russian Federation to property and records about changes of data, and also exception of all data on object of accounting of the register are performed by territorial authority in 14-day time after receipt of the extract from the Unified State Register of Legal Entities and the liquidation balance sheet. The liquidation balance sheet is not required if person was acknowledged as court insolvent (bankrupt) and is liquidated according to the procedure of bankruptcy proceedings.

27. The territorial authority in 21-day time from the date of receipt of documents of the owner shall carry out expertize of documents of the owner and by its results to accept one of the following decisions:

a) about accounting in the register of object of accounting at permanent register number of federal property, exception of the changed data on object of accounting of the register and entering into it of new data on object of accounting or exception of all information about him of the register if authenticity and completeness of documents of the owner, and also reliability and completeness of the data containing in them are established;

b) about refusal in accounting in the register of object of accounting if it is determined that the property provided to accounting, including the property, the property right of the Russian Federation to which is not registered or is not subject to registration, is not in property of the Russian Federation;

c) about suspension of accounting procedure in the register of object of accounting in the following cases:

incompleteness and (or) unauthenticity of the data containing in documents of the owner are established;

the official of territorial authority had doubts in authenticity, completeness and (or) reliability of documents of the owner and data containing in them;

documents of the owner on form and content do not correspond to the requirements established by this Provision and the legislation of the Russian Federation.

28. In case of the decision making specified in the subitem "an" of Item 27 of this provision, the territorial authority shall consider in day of decision making in the register object of accounting at permanent register number of federal property, exclude the changed data on object of accounting from the register and enter new data on object of accounting or exclude all information about him from the register.

On the same day to the owner the notification on assignment to object of accounting of permanent register number of federal property, exception of the changed data on object of accounting of the register and entering into it of new data on object of accounting or on exception of all information about him of the register goes.

The specified notification, and also other notifications, notices and requirements provided in this Provision go to the owner by means of system of accounting.

29. In case of the decision making specified in the subitem "b" of Item 27 of this provision, the territorial authority shall inform in day of decision making the owner on the made decision (with reasons for adoption of such decision).

30. In case of the decision making specified in the subitem "v" of Item 27 of this provision, the territorial authority shall suspend accounting procedure in day of decision making and inform on it the owner (with reasons for adoption of such decision).
