About modification and amendments in the Law of the Republic of Armenia "About service in police"

Article 1. In article 2 of the Law of the Republic of Armenia "About service in police" (on July 3, 2002, ZR-401, further - the Law):

Paragraph two of part 1 to state 1) in the following edition:

"Proceeding from features of separate services and positions in police on civil service in police in the procedure established by this Law citizens of the Republic of Armenia can arrive.";

Part 1 to add 2) with new paragraphs of the following content:

"The special civil service is type of public service.

The special civil service irrespective of change of ratio of political forces is the professional activity directed to implementation of the separate functions allocated for police by the legislation of the Republic of Armenia.";

Paragraph two of part 3 to state 3) in the following edition:

"In polices, that is those service duties, non-execution or improper execution of which can result rules of office discipline in disciplinary responsibility, are established by the normative order of the head of state body and other regulatory legal acts.".

Article 2. To add article 7 of the Law with parts 2.1 and 2.2 of the following content:

"2.1. Compliance of class ranks of civil servants to ranks of police, and also procedure and conditions of their assignment are established by the Government of the Republic of Armenia.

2.2. Compliance of class ranks and ranks of police is considered in case of appointment of the civil servant to positions, the stipulated in Article 4 presents of the Law, or appointment of the employee of police to the positions provided by part 2 of article 60.1 of this Law.".

Article 3. To recognize part 6 of Article 13 and part 3 of article 65 of the Law invalid.

Article 4. To state part 9 of article 14 of the Law in the following edition:

"9. Also the citizens conforming to requirements of part 1 of article 11 of this Law, however at the time of the address in the procedure established by the law of the citizens exempted from obligatory military service on the bases, stipulated in Item "and" parts 1 of article 12 of the Law of the Republic of Armenia "About conscription" exempted from obligatory military service, except for can be appointed to positions of police of younger and average group on results of three-months educational probation period.".

Article 5. To state Item 1 of part 1 of article 18 of the Law in the following edition:

"1) to other position, equivalent post, or according to the procedure of promotion in other division or organization of police after service in this position at least one year, and in exceptional cases according to the decision of the head of state body - before the expiration of fixed term;".

Article 6. Regarding the 2nd article 33 of the Law of the word of "eleven months" shall be replaced with words "six months".

Article 7. To add part 1 of article 45 of the Law with Item 11.1 of the following content:

"11. 1) in case of identification of violation of the procedure for revenues to service established by the legislation in police;".

Article 8. In paragraph five of part 1 of article 47 of the Law of the word of "the head of department, the deputy head of department" shall be replaced with words "the head of department, the deputy head of department and the chief of independent department".

Article 9. Add the law with Chapter 11.1 of the following content:

"Chapter 11.1. Special civil service in police

Article 60.1. Classification of positions of special civil service

1. Positions of special civil service are classified by groups proceeding from the organization of work and responsibility for management of work, powers on pronouncement of decisions, contacts and representation, complexity of tasks and the requirement to their creative decision, and also the necessary level of knowledge and abilities of persons holding this position.

2. Positions of special civil service are classified by the following groups:

1) the highest positions of special civil service;

2) main positions of special civil service;

3) leading positions of special civil service;

4) younger positions of special civil service.

3. The group of the highest positions of special civil service is classified by positions of the 1st and 2nd subgroups, and groups of the main, leading and younger positions of special civil service are classified by positions of 1st, 2nd and 3rd subgroups. In groups of positions of special civil service the 1st subgroup is the highest subgroup of this group.

4. The general description of each group of positions of special civil service affirms Council of civil service for the proposal of the head of state body.

Article 60.2. Class ranks of special civil service

1. The following class ranks are appropriated to civil servants:

1) the civil servant holding the highest positions of special civil service – class ranks of the counselor of state of the 1st and 2nd classes of special civil service of the Republic of Armenia;

2) for the main positions of special civil service:

- the civil servant holding positions of the 1st subgroup
