About modification and amendments in the Law on the Government No. 64-XII of May 31, 1990

The Parliament adopts this organic law.

In the Law on the Government No. 64-XII of May 31, 1990 (repeated publication: The official monitor of the Republic of Moldova, 2002, No. 131-133, of the Art. 1018), with subsequent changes to make the following change and addition:

1. Part the tenth Article 4 to recognize invalid.

2. Add the law with Article 7-1 of the following content:

"Article 7-1. Functions of the operating (dismissed) Government

In case of expression of non-confidence vote by Parliament, resignation of the Prime Minister or elections of new Parliament the operating (dismissed) Government before bringing of the oath by members of the new Government performs only management functions by public affairs.

The main functions of the operating (dismissed) Government:

1) ensuring carrying out in life of the laws irrespective of the area regulated by them;

2) implementation of the common directorship and control of activities of the central industry bodies;

3) program implementation of economic and social development of the country;

4) safety of the state and its citizens, performing management functions by public affairs;

5) implementation of any activities for management and administration, concerning all society.

In pursuance of the functions established by this Article, the Government:

1) issues resolutions and orders for the purpose of execution of the laws;

2) draws the conclusions on legislative initiatives;

Develops 3) and submits to Parliament for approval the bill on the government budget, represents to Parliament legislative initiatives on:

a) to accomplishment of the obligations following from contents of the laws and their final provisions in the limits set by primary legislation;

b) to ensuring internal and external security of the state, maintenance of condition of legality, social, economic, financial and political stability and prevention of effects of the natural phenomena and unexpected factors constituting public danger;
